EDD appeal hearing wait time - still no court date after 6 weeks
I filed my appeal with EDD back on January 15th after being disqualified for supposedly not being available for work (which is complete BS). It's now March 1st and I haven't received any notice about a court date. The determination letter said I had 30 days to appeal, which I did right away, but now it's been 6 weeks of silence. My rent is due next week and I'm seriously panicking. Has anyone gone through the appeal process recently? How long did it take to get your hearing scheduled? I've called the appeals office three times but keep getting a recording saying they're experiencing high call volumes. I'm at my wit's end here!

The appeals process is taking FOREVER right now. I filed my appeal in early December and didn't get my hearing date until mid-February - that's over 2 months of waiting! And my hearing isn't scheduled until late March, so almost 4 months total from appeal to actual hearing. The ALJ (Administrative Law Judge) backlog is ridiculous. When you filed your appeal, did you receive a confirmation letter with an appeal number? You should have gotten that within 10 days of filing.

•Yes, I got the confirmation letter about a week after I mailed in my appeal form. It has my appeal number and says they'll contact me when a hearing is scheduled, but nothing else. Did you do anything special to get your hearing date? I'm worried they lost my paperwork or something.

I've gone through 2 appeals with EDD in the last year. The first one took about 7 weeks to get a hearing date, and the second one took almost 10 weeks! It's completely normal (though frustrating) to wait 6-8 weeks just to get the hearing scheduled. Then you'll typically wait another 3-4 weeks for the actual hearing date. My advice - make sure you're preparing your case while you wait. Gather all documentation showing you were available for work (job applications, emails with potential employers, LinkedIn activity, etc). The more evidence you have, the better your chances. I know its fristrating but my neibor had same issue and waited like 8 weeks for the court date letter. Then another month for actual hearing. EDD is backed up big time. She won her appeal tho and got all backpay so hang in there!!

If you're trying to check on your appeal status, you should know that calling the main EDD number won't get you anywhere. You need to contact the Office of Appeals directly. I was in the same situation and couldn't get through for weeks until I discovered Claimyr (claimyr.com). They helped me get through to EDD quickly instead of dealing with busy signals and disconnections. •I used Claimyr too when I was dealing with my disqualification. Saved me hours of redial hell. Just be ready with all your questions when you get through because the EDD reps don't like to stay on the phone long.

The wait times are absolutely CRIMINAL!!! I appealed in November and didn't get my hearing until February. That's 3 MONTHS with NO INCOME while these bureaucrats take their sweet time. And guess what? I WON my appeal because EDD made a mistake in the first place! So I was without money for 3 months because of THEIR ERROR. The system is designed to make people give up. DON'T GIVE UP! Keep calling, document EVERYTHING, and be prepared to wait. This is how they operate - they hope people just stop fighting.

One thing to keep in mind - while you're waiting for your appeal hearing, you should still continue to certify for benefits every two weeks. If you win your appeal, EDD will process backpay for all the weeks you properly certified, even though they're showing as disqualified right now. If you don't certify during this waiting period, you might not get paid for those weeks even if you win your appeal. Also, when you do get your hearing notice, it will typically come 10-14 days before the actual hearing date. The notice will include instructions for submitting evidence and how to prepare. Make sure to submit any documents at least 5 business days before your hearing date.

•That's really good advice - I've been certifying every two weeks still, even though they all say disqualified. Fingers crossed I win and get all that backpay. I'm already working on organizing my evidence for when I finally get that hearing date.

•Still nothing as of today (March 5th). I actually got through to someone at the Appeals office yesterday using that Claimyr service. They confirmed my appeal is in the system but said they're scheduling January appeals right now, so I should get my notice within the next 2 weeks. At least I know it's not lost in the system!
