EDD appeal timeline - how long to wait after filing my appeal?
It's been 17 days since I filed my appeal with EDD after being disqualified for supposedly not reporting my last day of work correctly. I've received the confirmation notice that they got my appeal, but nothing since then. My rent is due in 2 weeks and I'm getting really anxious about how long this whole process takes. Has anyone gone through an appeal recently? How long did you have to wait before hearing anything back or getting a hearing date? I'm checking my UI Online account daily but there's no updates there either. Starting to feel like I'm in limbo.

My appeal took like 3 MONTHS!!! The system is completely broken. They expect us to wait forever with no income while they take their sweet time deciding if we deserve benefits that we paid into. I had to borrow money from family just to survive. Good luck but don't expect anything soon.

•3 MONTHS?? Oh no...I don't know how I'm going to make it that long without benefits. Did you get backpay for all that time once they approved you?

The appeal process typically takes 6-8 weeks to get scheduled for a hearing, but it can be longer depending on their current backlog. After you get the acknowledgment letter, the next thing you'll receive is the hearing notice about 7-10 days before your actual hearing date. Make sure all your documentation is organized and ready - proof of your last day worked, any communication with your employer, etc. The judge will want to see evidence supporting your side of the story.

•Thank you! This is really helpful. I have all my paystubs and emails from my manager about my last day. Should I send those documents to EDD now or wait until the hearing?

•Wait until you get the hearing notice. It will have instructions for submitting evidence before the hearing. Generally you need to submit documents at least 7 days before the hearing date so all parties have time to review them. Make copies of everything - don't send originals.

While you're waiting for your appeal to be processed, I'd recommend trying to speak with an EDD representative to see if there's any way to expedite your case due to financial hardship. Getting through to EDD can be nearly impossible though - I spent weeks calling hundreds of times. I ended up using Claimyr (claimyr.com) which got me connected to an EDD rep in about 20 minutes. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km. The rep I spoke with was able to give me more specific information about my appeal timeline and marked my case as urgent due to my situation.

•I've never heard of this service before. I've been calling every day with no luck. Did the EDD rep actually help speed things up when you got through?

•Yes, the rep was able to see exactly where my appeal was in the process and put a note on my file about my financial hardship. My hearing was scheduled about 2 weeks after that call. It's not guaranteed to speed things up, but speaking to someone directly definitely helped in my case.

my sister had an appeal last year and it took exactly 43 days from when she sent the appeal form to getting the hearing date. then another two weeks until the actual hearing. she won her appeal btw. the judge was super nice.

•That's not too bad - about 2 months total then? Do you know if she did anything special to prepare for the hearing?

•yeah she just had all her emails from hr and her termination letter and stuff. the hearing was over the phone and only took like 30 minutes. she just answered the judges questions honestly. the employer didnt even show up for the call lol

I had an appeal hearing back in January and waited about 5 weeks for the hearing date. But then I got a letter saying it was postponed another 3 weeks! So frustrating! But on the plus side when I finally won my appeal (for a similar issue about reporting my last day incorrectly), I got all the backpay from the weeks I was waiting. So at least you should get all that money eventually if you win.

•Yeah but how are people supposed to survive with NO INCOME for months while waiting??? Not everyone has savings or family to help. The system is designed to make people give up.

The current average wait time for appeals in California is 45-60 days before getting a hearing date scheduled, and then typically 10-14 days after that before the actual hearing occurs. However, your location within California can affect this timeline - some offices have longer backlogs than others. You can call the Appeals Board directly at 1-800-300-5616 to check on your appeal status, though getting through is difficult. Important: continue certifying for benefits every two weeks while your appeal is pending. If you win your appeal, you'll receive all back benefits for properly certified weeks.

•Thank you for the detailed info. I'm in Los Angeles - is that area known for longer or shorter wait times? And is the hearing usually in person or over the phone?

Benjamin Johnson
•Los Angeles typically has longer wait times due to higher case volume. Since 2020, most EDD appeal hearings are conducted by phone, though you can request an in-person hearing if needed. When you receive your hearing notice, it will specify whether it's by phone or in person. For phone hearings, make sure you're in a quiet place with good reception and have all your documents readily available to reference during the call.

I went through this exact same situation about 6 months ago - also got disqualified for reporting issues and had to appeal. Mine took about 7 weeks total from filing the appeal to getting the hearing scheduled. I know 17 days feels like forever when you're stressed about rent, but you're still relatively early in the process. One thing that helped me was calling my local assembly member's office - they have caseworkers who can sometimes help expedite EDD issues or at least get you better information about where your case stands. Also, if you haven't already, start looking into local food banks and rent assistance programs in your area to help bridge the gap while you wait. The waiting is brutal but hang in there - most people do win their appeals when it's just a reporting error like yours.

•That's really helpful advice about contacting the assembly member's office - I never thought of that! Which office did you contact and did they actually help speed things up? I'm also in a similar situation with rent coming due soon, so knowing there might be another avenue to get help or at least information would be huge. Thanks for mentioning the food banks too - I've been too proud to consider that but you're right that I need to think practically about getting through this waiting period.

I'm currently going through an appeal process too and it's been 32 days since I filed. Got the acknowledgment letter but nothing since. I've been calling EDD daily with no luck getting through - the automated system just hangs up on me every time. Reading everyone's experiences here is both helpful and terrifying honestly. The range seems to be anywhere from 5-12 weeks which is insane when people have bills to pay. I started driving for DoorDash just to have some income coming in while I wait. It's not much but at least it's something. Madison, have you considered any gig work to help with rent while you wait? I know it's not ideal but it might help ease some of the financial pressure.

•That's a great suggestion about gig work! I actually just signed up for Instacart yesterday because I'm getting really worried about making rent. It's frustrating having to do this when I should be getting my unemployment benefits, but you're right that having some income coming in helps with the stress. 32 days for you is making me realize I probably have a long wait ahead still. Have you had any luck getting through to EDD at specific times of the day? I've been calling right when they open at 8am but maybe there are better times to try?

I'm going through the same thing right now - filed my appeal 11 days ago and the waiting is killing me! Reading through everyone's experiences here is both reassuring and nerve-wracking. It sounds like 6-10 weeks is pretty typical which is rough when you're already stressed about money. I've been trying the callback services people mentioned and also started doing Uber Eats to at least have something coming in. One thing my friend told me is to make sure you're still certifying every two weeks even though you're disqualified - apparently that's super important for getting backpay if you win. Hang in there Madison, sounds like most people do win these appeals when it's just reporting errors like ours.

•Thanks Mae, it's really reassuring to hear from someone else going through the exact same timeline! 11 days vs my 17 days - we're both still pretty early in the process it sounds like. I definitely have been certifying every two weeks like you mentioned, my case worker told me that was crucial when I first got disqualified. The gig work idea keeps coming up and I think I really need to just swallow my pride and sign up for something this week. Uber Eats might be perfect since I can work around my job search schedule. It's so frustrating that we have to do this when we should be getting our rightful benefits, but at least it's something. Keep me posted on how your appeal goes - maybe we'll both get good news around the same time!

I'm going through almost the exact same situation as you right now - filed my appeal 22 days ago after being disqualified for a work separation issue. The anxiety about rent and bills is just overwhelming when you're stuck in this limbo! Reading through all these responses is really eye-opening about how broken the system is. It sounds like we're both looking at potentially 2+ more months of waiting which is absolutely brutal. I've started applying for local rent assistance programs and signed up for Uber Eats like some others mentioned - not ideal but better than nothing. One thing I learned from calling my local legal aid office is that you can sometimes get free legal help for EDD appeals if you qualify based on income. Might be worth looking into if you haven't already. The waiting game is torture but it sounds like most people with reporting issues like ours do eventually win. Hang in there!

•Thanks Connor, it really helps to know I'm not alone in this! 22 days vs my 17 days - we're both in that awful waiting period. I hadn't thought about legal aid for EDD appeals, that's really smart. Do you know if they help with the actual hearing or just with paperwork? I'm definitely going to look into that. The rent assistance programs are a great idea too - I've been putting that off but I think I need to swallow my pride and apply. It's crazy that we're all having to scramble for backup plans when we should just be getting our unemployment benefits that we paid into. Really hoping we both get some movement on our cases soon - this limbo is exhausting!

I'm in a very similar situation - filed my appeal 19 days ago after getting disqualified for a work separation issue and the waiting is absolutely nerve-wracking! Reading everyone's experiences here has been both helpful and scary honestly. It sounds like we're all looking at 6-10 weeks minimum which is just brutal when you're already struggling financially. I started doing Grubhub deliveries last week because I couldn't just sit around waiting anymore - it's not much but at least it's something coming in. One thing that's helped me cope with the anxiety is setting up payment plans with my utilities and talking to my landlord about the situation. Most places are more understanding than you'd expect if you're upfront about what's happening. Madison, definitely look into those local assembly member offices people mentioned - I called mine yesterday and they said they'd look into my case. The whole system is just broken but it sounds like most people with reporting errors like ours do win eventually. Hang in there!

•Thank you so much Jasmine, this is really helpful! 19 days vs my 17 days - we're basically at the same point in this frustrating process. I love that you were proactive about setting up payment plans and talking to your landlord - that's actually really smart and something I should probably do this week before my rent is due. I've been dreading that conversation but you're right that being upfront is probably better than waiting until I can't pay. The Grubhub idea is great too - I keep hearing about different gig work options and I think I really need to just pick one and get started. How has the assembly member's office been so far? Did they give you any timeline for when they might have updates? It's so reassuring to connect with others going through the exact same timeline and situation. Definitely going to look into those payment plan options you mentioned!

I'm going through this exact same thing right now - just hit the 3 week mark since filing my appeal for a similar reporting issue. The financial stress while waiting is absolutely crushing, especially with rent and bills piling up. I ended up having to ask my landlord for an extension and started doing DoorDash just to have some income coming in. It's humiliating having to explain to everyone why I can't pay my bills when I should be getting unemployment benefits I earned. Reading all these timelines here is both reassuring and terrifying - sounds like we're all looking at 2+ more months of waiting. I called that Claimyr service someone mentioned and actually got through to EDD for the first time in weeks. The rep couldn't speed things up but at least confirmed my appeal was "in process" which was something. Also started looking into emergency rent assistance programs in my area. Madison, definitely don't wait on exploring those options - the applications can take time too. This whole system is designed to make people give up but we just have to keep pushing through. Most people seem to win these reporting error appeals eventually.

•Aisha, thank you for sharing your experience - it really helps to know others are going through the exact same thing! I'm at 17 days so we're basically in the same boat timeline-wise. I'm definitely going to look into that Claimyr service you mentioned since getting through to EDD has been impossible for me. Even just getting confirmation that the appeal is "in process" would give me some peace of mind right now. The landlord extension is a smart move - I've been dreading that conversation but you're right that I shouldn't wait until I actually can't pay. How did your landlord react when you explained the EDD situation? I'm also going to start looking into DoorDash or one of the other gig options people have mentioned. It's so frustrating that we have to scramble like this when we should be getting our rightful benefits, but having some income coming in would definitely help with the stress. Thanks for the encouragement about most people winning these appeals - I really needed to hear that today!

I'm in almost the exact same situation - filed my appeal 20 days ago for a reporting issue and the waiting is absolutely brutal! Reading through everyone's experiences here has been both helpful and terrifying honestly. It sounds like most people are waiting 6-10+ weeks which is just devastating when you're already struggling financially. I had to have that dreaded conversation with my landlord yesterday about potentially being late on rent and thankfully they were understanding, but the stress is still overwhelming. I also just signed up for Instacart after seeing so many people mention gig work as a way to bridge the gap. It's not ideal but at least it's something coming in while we wait for this broken system to work. Madison, definitely look into those local assembly member offices and rent assistance programs people mentioned - I'm going to call mine today. It's so frustrating that we all have to scramble for backup plans when we should just be getting the unemployment benefits we paid into. But it's reassuring to see that most people with reporting errors like ours do eventually win their appeals. Hang in there - we're all in this together!

•Thank you Selena! It's both comforting and frustrating to see so many of us going through the exact same timeline and stress. 20 days vs my 17 days - we're right there together in this awful waiting period. I'm really glad your landlord was understanding - that gives me hope for when I have that conversation this week. The Instacart idea sounds perfect, I think I'm going to sign up today since so many people have mentioned gig work as a lifeline during this wait. It's absolutely ridiculous that we're all having to scramble for alternative income when we should just be getting our rightful unemployment benefits, but you're right that at least it's something coming in. I'm definitely going to call my assembly member's office tomorrow after reading about everyone's experiences with that. This whole process is so broken but knowing that most people with our type of reporting issues do win their appeals eventually is keeping me going. Thanks for the encouragement - it really does help to know we're all supporting each other through this nightmare!

I'm going through the exact same situation right now - filed my appeal 25 days ago after being disqualified for a work separation issue and the anxiety is just overwhelming! Reading through everyone's experiences here has been incredibly helpful but also shows how broken this system really is. It's insane that we're all having to wait 2+ months for benefits we rightfully earned while struggling to pay basic bills. I ended up having to ask family for help with rent this month which was humiliating, but I also started doing Uber Eats to at least have some income coming in. The uncertainty is the worst part - not knowing if it'll be 6 weeks or 12 weeks makes it impossible to plan anything. Madison, definitely look into those assembly member offices people mentioned and don't wait on the gig work if you can manage it. Even small amounts help with the stress. I keep telling myself that most people seem to win these reporting error appeals eventually, but the waiting process is just brutal. We shouldn't have to go through this when we already paid into the system. Hang in there - sounds like we're all supporting each other through this mess!

•Sara, I'm so sorry you're going through this too - 25 days vs my 17 days and we're both stuck in this awful limbo! It's really hard to read about everyone having to ask family for help or scramble for gig work when we should just be getting our unemployment benefits. I totally understand the humiliation of having to ask for financial help - I'm dreading that conversation but it might be unavoidable at this point. The uncertainty really is the worst part like you said - if I knew it would be exactly 8 weeks I could plan for that, but not knowing if it'll be 6 weeks or 3 months makes everything so much harder. Thank you for the encouragement about the assembly member offices and gig work - I think I really need to just take action on both of those this week instead of just worrying. It's crazy that there are so many of us all going through the identical situation and timeline right now. This system is completely broken but at least we're all here supporting each other through it. Hoping we both get some good news soon!
