Appeal stuck in limbo after wrongful termination - ESD never responded

I've been dealing with a real nightmare scenario since getting fired back in March without any proper investigation. I worked at a healthcare facility for almost 3 years when suddenly I was terminated because of allegations reported by another regulatory agency. My employer didn't even bother to investigate or ask for my side of the story - they just let me go on March 23rd. The worst part? I later found out the regulatory agency completed their investigation and determined all allegations were "unsubstantiated and without merit." I have the official documentation clearing my name completely. I filed for unemployment right away but my employer contested it. ESD denied my initial claim despite me submitting the official documentation proving my innocence. I filed an appeal on April 15th with all supporting evidence, but it's now been almost 2 months and I haven't heard ANYTHING about my appeal status. I've sent multiple messages through eServices to the appeals department but received zero response. I've tried calling 75+ times but can never get through to a human being. My savings are completely gone now and I'm borrowing money from family just to pay rent. What are my options here? Is this normal for appeals to take this long with no updates? Should I contact my state representative? Any advice would be really appreciated because I'm desperate at this point.

this happened to me too!! my appeal took like 3 months before i got a hearing date. the esd system is completely overwhelmed right now and theyre prioritizing new claims. its so frustrating bc they don't tell u anything while ur waiting. the only way i found out anything was when i finally got through to an actual person

3 months?! That's insane. Did you do anything special to finally reach someone? I feel like I'm just shouting into the void at this point.

Appeals are severely backlogged right now, but there are several steps you can take to potentially get movement on your case: 1. Contact the Office of Administrative Hearings (OAH) directly at 360-407-2700 or 800-366-0955. They handle the actual appeal hearings, not ESD, and might be able to tell you if your appeal has been assigned a docket number yet. 2. Submit a formal status request through eServices specifically asking for your appeal status and hearing date (use the "Appeals" category in the dropdown). 3. If it's been more than 60 days, you should absolutely contact your state representative. They often have dedicated staff who can expedite unemployment issues. 4. Make sure you're continuing to file weekly claims during this entire process, even while waiting for appeal resolution. Your situation is exactly why appeals exist - you were cleared by the investigating agency, which is strong evidence. When you finally get a hearing, bring all documentation showing the regulatory agency found the allegations unsubstantiated.

Thank you so much for this detailed advice! I didn't realize OAH was separate from ESD - that's really helpful. I've been filing my weekly claims religiously, so at least I'm doing that right. I'll try contacting OAH tomorrow and reach out to my representative if that doesn't work.

I went through almost the exact same thing last year. Fired from my job in healthcare because of a complaint, later cleared by the investigating board, but my former employer fought my UI claim. I actually ended up getting backdated benefits after my appeal hearing, but it took FOUR MONTHS from when I filed the appeal until I got a hearing date. The system is ridiculous. One thing that helped me - I filed a complaint with the state ombudsman about the lack of response. Within a week, I suddenly got my hearing notice! I think that lit a fire under somebody.

How do you file a complaint with the ombudsman? I've been waiting 10 weeks for an appeal hearing and can't get anyone to even acknowledge my existence.

You can submit it online through the WA State Office of the Governor. Search for "Washington State Ombudsman unemployment" and it should come up. You fill out a form explaining how long you've been waiting with no response. Make sure you include all your claim details and appeal confirmation number.

After dealing with ESD for years (unfortunately), I can tell you their appeals system is incredibly frustrating. However, there's a service called Claimyr that helped me actually reach a human at ESD when I was in a similar situation. They basically call ESD for you and get you connected with an agent without the wait. I was skeptical at first, but it worked when nothing else did. You can check them out at claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 showing how it works. In my case, I finally got through to someone who could tell me my appeal status and escalate my case since it had been pending so long. For your specific case, you'll want to push for info about whether your appeal has been assigned to OAH yet, and if not, request expedition based on financial hardship.

Thank you for this tip! I've never heard of this service before but at this point I'm willing to try anything. I'll definitely check out that demo video.

does anyones elses eservices account show NOTHING about their appeal at all?? like ive been waiting 6 weeks and when i log in i see my denied claim but NOTHING about an appeal status. makes me think they never even got it???

That's actually normal - your appeal status won't show in eServices because appeals are handled by the Office of Administrative Hearings (OAH), not ESD directly. Once your appeal is transferred to OAH, you should receive a separate confirmation letter with a docket number. However, there's often a gap of several weeks between when you submit your appeal and when it gets transferred to OAH.

THE SYSTEM IS DELIBERATELY DESIGNED TO MAKE PEOPLE GIVE UP!!!!! I waited 5 MONTHS for my appeal hearing and they NEVER responded to any messages. They hope people will just go away and stop trying. Once you get a hearing with the judge, you'll probably win based on what you said about being cleared by the agency, but they make the process as painful as possible. YOUR TAX DOLLARS AT WORK FOLKS

5 months?? I seriously can't wait that long - I'll be homeless by then. This is so discouraging.

While the wait times are definitely frustrating, appeals with documented evidence of wrongful termination (like the OP has) often get prioritized. The system is backlogged but not deliberately designed to make people give up. If you specifically mention financial hardship in your communications, that can help expedite your case.

Have you tried contacting your state representative? I was stuck in appeals limbo for months when someone on Reddit suggested I contact my district rep. Their office has a staff person who specializes in ESD issues - I had movement on my case within a week after they got involved. Google "WA state representative finder" to locate yours based on your address.

No, I haven't tried that yet! Thank you for the suggestion - I'll look up my representative today. Did you just call their office or send an email?

I emailed first with all my claim details (claim ID, date filed, etc) and then they called me back to get more info. Make sure you emphasize your financial hardship situation - that helps them prioritize your case when they reach out to ESD.

just remember to keep filing ur weekly claims even tho ur waiting for appeal!! if u win the appeal they'll only pay u for weeks u submitted claims for

Yes, I've been making sure to do that every week! Feels pointless when they keep saying "disqualified" but I know I need to keep doing it.

One more recommendation since you mentioned you were fired due to allegations that were later found to be unsubstantiated - make sure you've uploaded all documentation showing you were cleared of wrongdoing to your eServices account. Specifically: 1. The official findings document from the regulatory agency 2. Any correspondence showing you requested an internal investigation from your employer 3. Documentation showing the timeline between your termination and when you were cleared At your eventual hearing, the Administrative Law Judge will focus heavily on whether there was misconduct. Having clear documentation that an official investigation cleared you is extremely valuable evidence.

I did upload the official findings report when I filed my appeal, but I'll double-check to make sure everything is there. Should I re-upload these documents with my weekly claims too, or just keep them ready for the hearing?

Keep all documents ready for the hearing, but also send a message through eServices specifically to the Appeals department with these documents attached again. Reference your appeal confirmation number in the message. While this might not speed things up, it ensures the documents are in multiple places in your file, reducing the chance they'll be overlooked.
