7 weeks after favorable appeal - ESD still showing adjudication in progress with no payment
I'm at my wits end with ESD. My claim was initially denied, I appealed, and on 11/4 the appeal was decided IN MY FAVOR. It's now been 7 weeks since then and I haven't received a penny. My weekly claims all show as 'pending' and my overall status says 'adjudication in progress.' Every time I call ESD (when I actually get through), they just ask me to upload more documents! I've already sent them my ID, paystubs, separation letter, and the appeal decision. I'm behind on rent and utilities now. Has anyone been in this situation before? Should I contact the Attorney General or Governor's office? I've heard some people do that when ESD isn't responding. Any advice would be greatly appreciated because I'm desperate at this point.

I went through something similar last year. After my appeal was approved, I still had to wait 5 weeks before they released payment. What helped me was contacting my state representative. Find yours here: https://app.leg.wa.gov/DistrictFinder/ - I emailed mine explaining my situation including my claim ID and the date of my appeal decision. Their office reached out to ESD directly and within a week my funds were released. They seem to have some kind of special contact channels.

•Thank you for this suggestion! I hadn't thought about contacting my state rep. Did you just email them or did you call their office? I'm willing to try anything at this point.

omg this system is so broken!! i won my appeal in october and still waiting too. they keep saying "we're processing your payment" but nothing happens. its like they purposely drag it out hoping people will just give up

•It really does feel like they're hoping we'll just go away. Have you tried anything that's gotten any response from them? I call almost every day but usually just get disconnected.

You need to specifically request an 'Implementation of Decision' from ESD. When you win an appeal, they don't automatically process payment - they have to implement the judge's decision, which is a separate process. Call and specifically ask for that. Also, make sure you're still filing weekly claims even while waiting, since they won't pay for weeks you haven't claimed.

•Thank you! I had no idea this was a separate process. I've been filing my weekly claims religiously, so at least I'm doing that right. I'll try calling tomorrow specifically asking about implementing the decision.

Hey, I was stuck in adjudication for 9 weeks after winning my appeal. Calling regular ESD numbers got me nowhere. I finally tried a service called Claimyr (claimyr.com) and they got me connected to an actual ESD agent in about 20 minutes. The agent was able to expedite my case and I had payment within 4 days. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 - Seriously worth trying since you've already been waiting 7 weeks. I wish I'd known about it sooner!

•Yes it worked for me! I was super skeptical too, but after 9 weeks of no progress I was desperate. The difference was actually talking to a real ESD agent who could look at my specific case, rather than the general call center people who just read scripts.

Have you checked your ESD Notices section in your online account? Sometimes they need additional info but don't tell you directly - the notice just sits in your account. My sister had her benefits held up because there was a questionnaire she hadn't completed that was buried in her online notices.

•Good suggestion! I just checked and there's nothing new in my notices section. Just the original denial and then the appeal approval. But nothing explaining why it's still in adjudication or what they're waiting for.

Just FYI, going to the Attorney General or Governor won't speed things up much, I tried both routes. What DID work was contacting my state senator's office. They have caseworkers specifically for helping constituents with unemployment issues. I had been waiting for 11 weeks after my appeal, called my senator's office, and had payment within 8 days. Also, during this waiting period, be EXTRA careful with your weekly claims - answer everything exactly the same way you have been, any inconsistency can trigger yet another review.

•This is really helpful advice, thank you. I'll try my state senator's office too. And good point about being consistent with the weekly claims - I've been super careful with those because I'm terrified of causing any more delays.

My cousin works for ESD (not saying that publicly lol) and she says they're SUPER backed up right now because of system updates and staff shortages. Like worse than usual. Not helpful for your immediate problem but might explain why even after winning your appeal it's taking forever. The system is basically held together with duct tape at this point.

•This is 100% accurate. I have a contact there too, and they told me they're still dealing with the aftermath of those pandemic-era claims plus they had a major software update that caused huge backlogs. It's especially bad for claims that had appeals because those have to be manually processed.

Update for everyone: I just checked the ESD website and they've posted a notice about implementation delays for appeal decisions. They're currently processing implementations from early October, so that explains the 7+ week wait for more recent decisions. Still worth contacting your representatives though!

•Thank you for this update! At least that confirms it's a system-wide issue and not just my claim being overlooked. I'm still going to try contacting my rep and senator though - can't afford to wait much longer.
