Adjudicator butchered my ESD claim - now appealing while facing eviction
I am absolutely at my wit's end with ESD. My adjudicator completely mishandled my claim despite me providing ALL the requested documentation. They somehow concluded I wasn't eligible based on information that wasn't even correct about my previous employment! Now I've filed an appeal but was told it could take 6-10 weeks just to get a hearing date. Meanwhile, I have 8 weeks of back benefits they owe me (about $4,200) and rent is already 2 weeks late. My landlord is threatening eviction proceedings if I don't pay by next Friday. I've called ESD 27 times this week alone and either get disconnected or told 'someone will call you back' - which NEVER happens. I'm literally shaking with stress typing this. Has anyone successfully expedited an appeal due to financial hardship? Or gotten their benefits while waiting for an appeal hearing? Any advice before I end up homeless thanks to ESD's incompetence?

•Thank you. Did you do anything to speed up the appeal process? I'm scared we'll be out on the street before I even get a hearing date.

You can request an expedited hearing due to financial hardship. Call the Office of Administrative Hearings (OAH) directly, not ESD. Explain your eviction risk and ask for an urgent hearing. Also, contact your local housing authority immediately about emergency rental assistance programs - most counties have funds specifically for this situation. The law generally requires that OAH schedule your hearing within 30 days of your appeal, but hardship cases can be prioritized. Make sure you've prepared all your evidence for when the hearing happens - employment records, communications with your employer, and anything that contradicts what the adjudicator claimed.

•Thank you so much for this information. I'll call OAH first thing Monday morning. Do you know if I need anything specific to prove the financial hardship besides the eviction notice? I'm worried they won't believe me.

The adjudicators are completely USELESS these days!!! I had one who didn't even LOOK at the documents I uploaded - she literally told me on the phone she "couldn't find them" even though I could see them right there in my account!!! They're just denying claims to meet quotas or something. It's CRIMINAL what they're doing to people. I ended up having to reapply completely and lost 6 weeks of benefits I'll never get back. The whole system is BROKEN. Fight them with everything you've got!!

hey i used claimyr.com to get through to ESD when i was in a similar situation and it actually worked. they got me connected to a real agent in like 20 minutes when i had been trying for days. there's a video that shows how it works here: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. the agent i talked to was able to flag my case as hardship and speed things up. might be worth trying since you're facing eviction.

•I've never heard of this service before. Did you have to provide a lot of personal information? I'm desperate but also wary of scams.

•no scam! they just help you bypass the phone system. you still talk directly to real ESD agents. i was skeptical too but when you're facing eviction you try anything, right? they don't ask for anything except basic contact info.

I work for a non-profit that assists with unemployment issues, and there are a few important things you should do immediately: 1. Document your hardship - Get your eviction notice in writing if possible 2. Call OAH at 855-928-1443 and specifically request an expedited hearing due to imminent homelessness 3. Contact your county's Emergency Rental Assistance Program 4. File a formal complaint with the ESD Commissioner's Office simultaneously 5. Reach out to your state representative's office - they can often intervene For your appeal hearing, focus specifically on the factual errors the adjudicator made. Don't get emotional (even though it's incredibly frustrating). Stick to demonstrable facts and documentation. Appeals judges respond best to clear evidence that contradicts the adjudicator's findings.

•Thank you for these specific steps. I'll start working on all of this today. My landlord did give me a written notice, so I have that documentation. Do you know roughly how much faster an expedited hearing might be compared to the regular timeline?

•Expedited hearings are typically scheduled within 7-14 days instead of the usual 30+ days. Make sure to use the specific phrase "imminent risk of homelessness" when requesting it. Also, please check if you qualify for the Housing and Essential Needs (HEN) program while waiting for your unemployment to be resolved.

A few years back, I had a similar nightmare with ESD. What helped me was contacting my state representative's office. Their constituent services staff called ESD on my behalf and suddenly my case was "under review." Got my backpay within a week after 2 months of nothing. It's ridiculous that this is what it takes, but politicians have channels we don't. Also check with Catholic Community Services - they sometimes have emergency rental assistance even if you're not Catholic.

In case nobody mentioned it, PRINT ALL YOUR DOCUMENTS before your hearing!!! My internet went out during my phone hearing and I couldn't access my evidence. The judge was actually nice and rescheduled, but it delayed things another 2 weeks. Have everything in hard copy and organized by date. And definitely write out your main points so you don't forget anything important when you're nervous.

•That's really good advice about printing everything out. I hadn't thought about technical issues during the hearing. I'll definitely prepare physical copies of everything.

Just checking back - were you able to contact OAH about expediting your hearing? Any progress with rental assistance?

•Yes! I finally got through to OAH and submitted my hardship request with copies of the eviction notice. They said they'll try to schedule my hearing within 10 days. I also applied for emergency rental assistance through the county and they're processing my application. My landlord agreed to wait for the assistance determination before moving forward with eviction. It's still incredibly stressful, but at least there's some progress. Thank you all for the advice.
