I was denied unemployment benefits last week because my former employer claimed I was fired for 'misconduct' when actually I was let go during company downsizing. They're saying I violated company policy but that's completely false - I had perfect performance reviews for 2 years! Has anyone gone through the ESD appeal process when your employer lied about why you were fired? How long does it typically take until I get a hearing date? And what kind of evidence should I be gathering to prove my side of the story? went thru this last summer. my boss said i was a no-show for 3 days but actually i had approved time off. took 7 weeks to get my hearing and another 3 weeks to get the decision. ESD is sloooooooow

Also, send a detailed letter to OAH explaining your situation and providing all your evidence ahead of time - don't wait for the hearing. This gives them time to review your documentation. •she said hardship requests sometimes work if ur facing eviction or have medical issues that depend on having income. you have to call and specifically ask for a hardship expedite tho. they dont advertise it
