Will ESD reverse disqualification after online appeal evidence without OAH hearing?

I just got disqualified from benefits last week because ESD says I didn't provide enough documentation about my job separation. I submitted an online appeal yesterday and uploaded all the emails between me and my former manager showing I was laid off due to budget cuts, not fired for misconduct like they're claiming. \n\nI read somewhere that ESD might actually review this new evidence and possibly reverse their decision before it even gets scheduled with the Office of Administrative Hearings. Has anyone experienced this? Does ESD actually reconsider decisions when you submit strong evidence, or am I definitely going to need to wait for a hearing date? Bills are piling up and I'm freaking out about how long this process might take.

Yes, this definitely happens! When you appeal and submit new evidence, ESD is required to review it before sending the case to OAH. It's called a \

That's really helpful to know! Did they notify you by mail or online when they reversed it? I check my eServices account obsessively but nothing has changed yet.

they can but dont count on it lol... my friend waited 4 months for her hearing and ESD didnt change nothing even tho she had proof. depends who reviews ur case i guess

Same. I had all the proof they needed and they still made me do the OAH thing. The judge took like 2 seconds to rule in my favor once we actually had the hearing. Waste of everyone's time!

I had a similar situation happen to me in March but about job search activities. I disagree with what someone said about 10 days - mine took almost 4 weeks to get reversed! And ESD never actually told me they reversed it!!! I just happened to check my account one day and saw a payment had been processed!! So keep checking your account daily, they're not great about communicating status updates.

Seriously?? They didn't even notify you when they reversed their decision? That's ridiculous. I guess I'll just keep checking my account every day then.

The redetermination process does happen but the likelihood depends on a few factors:\n\n1. Quality of evidence (emails from management are strong)\n2. Current workload at ESD (they're backlogged after year-end)\n3. How clear-cut your case is\n\nIn my experience helping clients, about 30-40% of well-documented appeals get reversed without OAH hearings. However, you should still prepare for a hearing just in case. The redetermination typically takes 2-3 weeks, though I've seen it take as little as 5 days or as long as 6 weeks.\n\nIf you need to get through to an ESD agent to check on your appeal status, I'd recommend Claimyr (claimyr.com). They can connect you with an ESD rep usually within an hour instead of spending days calling. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. I've had several clients use it successfully to resolve issues quicker.

That 30-40% statistic is super helpful, thanks. I'll check out that Claimyr service - spending hours on hold is driving me crazy. Has anyone else used this?

I used to work at ESD (quit last year) and can confirm this happens all the time. We called it \

This is fantastic advice, thank you! I didn't even think about faxing the documents. I'll do that first thing tomorrow morning. Is there anything else I should be doing while I wait?

THEY ARE ALL LIARS!!! I provided MOUNTAINS of evidence and they still forced me to have a hearing. Then the judge ruled in my favor in like 10 minutes but I had to wait 8 WEEKS with NO MONEY to get that hearing. The whole system is designed to make us give up!!!! Don't believe anyone who says ESD will do the right thing - they want to save money by denying as many claims as possible!!

I understand your frustration but in my experience it really depends on the specific circumstances and the evidence. My cousin had his decision reversed within 3 weeks with the right documentation. Not saying your experience isn't valid - it definitely happens the way you described too.

I used that Claimyr thing someone mentioned above when I was dealing with a similar issue back in February. Got through to someone at ESD in like 40 minutes after trying for a week on my own. The agent looked at my file and could see that my appeal was

Did you have to give them all your personal info?? Sounds sketchy to me.

No more info than what you'd need to give ESD directly. They just connect you to ESD and then you talk directly with the ESD agent. It's just a connecting service.

Quick update to my earlier comment - when ESD does a redetermination review, they're supposed to send you a new determination letter regardless of whether they change their decision or not. So you should get something in the mail either way. If it's been more than 3 weeks and you haven't received anything, definitely try to contact them to check the status.

Thank you for the update! I'll give it another week and then try to get in touch with them if I don't hear anything.
