ESD denied my unemployment after 'job abandonment' claim - how long should adjudication take?
My employer reported that I 'abandoned my position' when I was actually let go without warning after raising concerns about workplace safety. Now my unemployment claim from three weeks ago is stuck in adjudication and I haven't heard anything from ESD. I've tried calling but can't get through to anyone who can tell me what's happening. The online portal just shows 'pending adjudication' with no other details. I'm getting really worried about bills piling up while this gets sorted out. Has anyone dealt with a similar false accusation from an employer? How long did adjudication take in your case? Is there anything I can do to speed this up or should I just keep waiting?

ur not alone. same thing happend to me last year. employer said i quit when they actually cut my hours to nothing trying to force me out. took almost 5 WEEKS before i even got to talk to anyone at esd about it!

This is a common issue that happens when an employer contests your claim. When there are conflicting statements about job separation, ESD has to conduct an investigation through the adjudication process. Unfortunately, adjudication is taking about 4-6 weeks right now based on what I've seen with other claimants. Make sure you've submitted any documentation that supports your side of the story - emails, texts, performance reviews, anything that shows you didn't abandon your job. Also, continue filing your weekly claims even while waiting for adjudication. If approved, you'll get backpay for all eligible weeks.

The ESD system is COMPLETELY BROKEN!! I was falsely accused of misconduct and had to wait 8 WEEKS for adjudication, then they sided with my employer without even considering my evidence!!! Had to appeal to OAH and wait ANOTHER 6 weeks for a hearing. The whole time I couldn't pay rent and almost got evicted. The system is designed to wear you down until you give up!!!

anyone else notice that adjudication seems to take longer when the employer is fighting the claim? when i got laid off last year with no dispute my benefits started in like 10 days. but my friend who got fired for "performance" (totally bogus btw) waited like 6 weeks for adjudication. seems like they put the complicated ones at the bottom of the pile...

•Yeah thats exactly what happens! My wife's claim went through in a week cause her company didn't contest it. But mine is on week 4 of adjudication because my boss is claiming I was "insubordinate" when actually I just refused to do something unsafe. ESD is definitely prioritizing the easy cases.
