Normal timeframe for employer response during ESD adjudication? Stuck for a week

I got laid off three weeks ago from my warehouse job and filed for unemployment right away. ESD put my claim in adjudication status last Friday with a message saying they're waiting for my employer to respond. It's been a full week now with zero movement. Does anyone know how long employers legally have to respond to ESD? The bills are piling up fast and I'm getting really worried. My ESD account just shows 'adjudication in progress' with no other details. Will they eventually approve my claim if my employer never responds? This waiting game is driving me crazy!

Employers typically have 10 business days to respond to ESD regarding a claim, but that's not a hard deadline. Some employers take longer, and ESD usually tries to make a determination within 2-3 weeks from when adjudication starts. If your employer doesn't respond at all, ESD will eventually make a decision based on the information they have available, which can often favor the claimant. They're dealing with a lot of claims right now, so one week in adjudication is actually pretty normal.

Thanks for the info. Is there anything I can do to help move things along? Should I try calling ESD to check on status or just keep waiting?

I was in adjudication for 2 weeks, then received an 'additional information needed' alert in my eServices account. Turned out they had questions about my availability for work that weren't related to my employer's response. Check your eServices account daily - sometimes they need stuff from YOU and don't make it obvious. Keep filing your weekly claims during adjudication no matter what! That's super important.

Definitely checking eServices multiple times a day! Nothing new there yet. And yes, I'm filing my weekly claims faithfully every Sunday. Just feels like everything's in limbo.

Ugh, the ESD system is a JOKE. They give employers all the time in the world while we sit here broke!!! My employer took 3 WEEKS to respond and then ESD took ANOTHER 2 weeks to process everything. Meanwhile I was about to get evicted. The system is completely rigged against workers. Don't expect fairness or efficiency from ESD.

While I understand your frustration, ESD does have to give employers reasonable time to respond as part of due process. They're dealing with thousands of claims. If you're facing eviction while waiting for benefits, you should contact your local DSHS office as they may have emergency assistance programs available.

After I got laid off from construction work last September my claim was in adjudication for almost a month because my employer disputed that I was laid off (they tried claiming I quit). I had to provide additional documentation. Make sure you have any termination notices or emails saved just in case. Took forever but I eventually got approved and got backpay.

If you're struggling to get through to ESD on the phone, I highly recommend trying Claimyr. I was in the same boat last month - stuck in adjudication with no way to talk to a real person at ESD. Claimyr got me connected to an actual ESD agent in about 20 minutes after I'd spent days trying on my own. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. Just go to claimyr.com - it saved me so much stress during my adjudication period.

Thanks for the tip! If I don't see movement in another week I might try this. Did talking to an agent actually help speed up your adjudication or did they just give you more information?

It definitely helped in my case. The agent was able to see notes on my claim that weren't visible in my online account. They told me exactly what was missing and what I needed to submit. Got approved about 3 days after that call.

Claims specialist here. The standard employer response window is 10 business days, but ESD won't automatically approve your claim if they don't respond. Instead, the adjudicator will review whatever information is available and make a determination. One week in adjudication is entirely normal - I'd recommend waiting at least another week before becoming concerned. Meanwhile, be sure to: 1. Check your online account AND physical mail daily 2. Continue filing weekly claims 3. Complete all job search requirements (3 activities per week) 4. Answer any phone calls from unfamiliar numbers (often ESD calls from blocked numbers) If you reach the 3-week mark in adjudication with no movement, then it might be time to contact ESD directly for an update.

This is really helpful, thank you! I've been doing all those things except answering unknown calls (been getting too many spam calls lately). I'll start answering everything now just in case it's ESD.

my cousin went thru this last month it took 12 day total before they approved him but he got all the back money so dont worry you'll get paid for all the weeks even while waiting

Give it a bit more time - one week is still early in the process. If you don't see movement after 3 weeks total, you can request an escalation through your state representative's office. Most have constituent services that can help with ESD issues. The process moves MUCH faster when a state rep gets involved.

I didn't even think about contacting my state rep. That's a good backup plan if this drags on. Thanks for the suggestion!

Just went through this exact situation myself! Got laid off from my retail job in January and was stuck in adjudication for about 10 days. The waiting is absolutely nerve-wracking, especially when bills are due. What really helped me was setting up email alerts in my eServices account so I'd know immediately if anything changed. Also, I started a simple spreadsheet tracking my job search activities since you need those 3 per week anyway - kept me productive while waiting. The good news is that once they made their decision, I got all the backpay deposited within 2 business days. Hang in there - one week really is still normal timing even though it feels like forever when you're living it!

That's really reassuring to hear from someone who just went through the same thing! I'm definitely going to set up those email alerts - didn't even know that was an option. And the spreadsheet idea is smart, keeps me organized for the job search requirements. It's good to know the backpay comes through quickly once they decide. Thanks for sharing your experience, it helps knowing I'm not alone in this waiting game!
