ESD adjudication stuck waiting for unresponsive employer - will my claim ever get approved?
My unemployment claim has been sitting in adjudication for almost 3 weeks now because ESD says they need to hear from my former employer (Sunset Manufacturing). The problem is, I already know this company NEVER responds to ANY official requests - they didn't even respond when I filed a L&I claim last year! The ESD agent I finally reached yesterday told me they sent the employer request on May 12th and are 'still waiting for a response.' Meanwhile I'm burning through savings while rent is due next week. What happens when an employer just ignores ESD? Will my claim be stuck in adjudication limbo forever? Does anyone know if they eventually give up and just approve the claim anyway? I'm getting desperate and the stress is keeping me up at night.

same thing happened with my claim when West Valley Retail ghost them... took FOREVER but eventually got approved

After a certain period (usually 10 business days), ESD will make a determination with or without your employer's response. They're required by law to move forward even if an employer doesn't reply. However, the adjudicator may still need to talk to you to get your side of the story before making a decision. I'd recommend calling ESD again and specifically asking if they can note in your file that the employer has a history of non-response. Also ask if there's anything you can provide to help them make a determination without the employer's input.

•but i thought the burden of proof is on the CLAIMAINT not the employer?? ESD denied my claim when my boss never responded cuz they said i didnt provide enough evidence that i was laid off instead of quit. thats why i had to appeal.

I went through this exact nightmare last winter! My former employer (restaurant chain) never bothered responding to ANY of ESD's inquiries. My claim sat in adjudication for 5 weeks before I finally figured out a solution. The key was documenting EVERYTHING from my side - I sent in my final paycheck stub, termination letter, text messages with my manager, etc. I also called ESD repeatedly until I found a helpful agent who escalated my case. The adjudicator eventually approved my claim WITHOUT employer input, but only after I provided overwhelming evidence of my eligibility. Don't just wait passively - be proactive about submitting any documentation that proves your side of the story!

my claim was in adjducation for 2 MONTHS becuz my employer kept ignroing ESD calls!!! its ridiculous they make us wait when its not even our fault!!

If you're having trouble reaching ESD agents by phone (which is likely given their call volume), I'd recommend trying Claimyr. I was in a similar situation last month with an unresponsive employer, and after days of trying to reach ESD on my own, I used Claimyr (claimyr.com) and got through to an agent within 25 minutes. They were able to add notes to my file about my employer's non-response history and actually expedited my adjudication. From what I understand, ESD has to make a decision within a certain timeframe regardless of whether your employer responds or not. My cousin went through something similar and her claim was eventually approved after like 6 weeks with no employer response.

One important thing to know: While waiting for adjudication to complete, make sure you're still filing your weekly claims! Even though you're not receiving payments yet, you need to keep submitting those weekly certifications. If your claim is eventually approved, you'll receive back payments for all the weeks you properly filed. Missing weekly claims during adjudication can create bigger problems down the road.

when I had something similar the ESD person told me they have to wait a specific ammt of time before moving fwd. I think it was 12 days? But then they got so backed up cuz of staffing issues it took way longer.

Update us on what happens! I'm curious if they'll move forward without your employer's input soon. In my experience, being persistent with calling ESD (even though it's frustrating) is still the best way to get movement on these issues. Ask specifically for an estimated timeline when you call - sometimes they can give you more information about where you are in the queue and how much longer you might have to wait.
