Employer missed 10-day ESD response deadline during adjudication - what happens now?
So I left my toxic job at a restaurant about 3 weeks ago (couldn't take the manager's verbal abuse anymore) and applied for unemployment. My claim went into adjudication right away which I expected since I quit. ESD sent my employer the questionnaire thing but they NEVER responded within the 10-day deadline! My eServices account shows the employer response status as "No Response Received" and it's been over 10 days now. I'm in week 3 of adjudication limbo and getting super anxious about bills.\n\nDoes anyone know what happens when an employer misses the response deadline? Does this help my case since they didn't dispute my reason for quitting? Or will ESD just keep my claim stuck forever anyway? I've been doing my weekly claims but they all show as "pending" with no payments.\n\nReally need some insight on what to expect next! Thanks in advance 🙂

If they later contest a favorable decision, you'll have documentation showing they missed their opportunity to provide input during the initial investigation.\n\nKeep doing your weekly claims even while in adjudication. If approved, you'll receive backpay for all weeks properly claimed.

If you're still waiting, try calling ESD early in the morning right when they open (usually 8am). I've had the best luck getting through around 8:05-8:15am. Later in the day it's almost impossible. Sometimes an adjudicator can look at your case while you're on the phone if you get the right person. Worth a shot!
