ESD adjudication stuck waiting for employer response - what happens at deadline?

I'm so stressed right now! My claim has been in adjudication for almost 3 weeks because of a job I left back in February (during my base year). The ESD agent I finally reached today said they're waiting on my former employer to respond to questions about my separation. Here's the thing - I called my old manager out of desperation and she swears they haven't received ANY communication from ESD! The agent mentioned there's some deadline (April 12th) for the employer to respond. Has anyone dealt with this? What happens if my employer misses this deadline or never gets the message? Will my claim be automatically approved or just sit in limbo forever? I have bills due next week and this waiting game is killing me.

If the employer doesn't respond by the deadline, ESD is supposed to make a determination based on the information they have, which is your statement about why you left. In many cases, this works in your favor because they have to go with your side of the story. Make sure you've clearly explained your separation reason in your application or to the adjudicator. Keep documenting everything - write down the date you called, who you spoke with, what they said about the deadline, etc.

The employer has 10 business days to respond to ESD's request for information. If they don't respond by the deadline, ESD is supposed to make a determination based solely on the information you provided. However, this doesn't always happen automatically or quickly. If you're approaching that April 12th deadline and haven't heard anything, call ESD again and specifically reference that the employer response deadline has passed. Also, there's an important distinction - was this a voluntary quit or were you laid off? If you voluntarily quit, you'll need to have had a good cause reason according to ESD regulations. If you were laid off due to lack of work, that's generally an easier approval.

It was technically a voluntary quit, but they reduced my hours from 40 to 25 per week, which I couldn't financially survive on. The adjudicator said that could qualify as good cause if it was a substantial reduction (which it was - about 37%). I'll definitely call again if I don't hear anything by the 13th or 14th. That can happen if the claimant didn't establish good cause for quitting in their initial application or interview. Even if the employer doesn't respond, ESD still needs the claimant to show they had a qualifying reason to leave the job. Did your cousin's boyfriend appeal the decision? Many initial denials get reversed on appeal.

I went through EXACTLY this situation in January. My former employer claimed they never received anything from ESD (though I suspect they were just ignoring it). After the deadline passed, I couldn't get anyone on the phone at ESD to check on my status. I spent DAYS trying to get through. ESD IS A COMPLETE DISASTER!!! They do this ALL THE TIME! They claim to send notices to employers but half the time the employers never get them or they go to some random department that ignores them. Then YOUR benefits get held up because of THEIR incompetence!!! I had to wait SEVEN WEEKS last year for adjudication because of this exact situation. The deadline means NOTHING - they'll just keep extending it without telling you. CALL EVERY SINGLE DAY and document EVERYTHING.

Seven weeks? I waited nearly 12 weeks during the pandemic. The whole system is broken. But calling every day doesn't necessarily help - the frontline agents can't do anything to speed up adjudication. They just put notes in your file that the adjudicators may or may not read.

Many employers (especially larger companies) have dedicated staff who handle unemployment claims through this system. Your direct manager might not be aware of these communications. It might be worth contacting your former employer's HR department specifically, not just your old manager, to see if they've received anything from ESD. Sometimes these requests go to a centralized department or even a third-party company that handles unemployment claims for the employer.

That makes so much sense! I worked for a small business (about 30 employees) but they do have an HR consultant who handles these things. My manager probably wouldn't be in the loop. I'll try to get in touch with the HR person tomorrow. Thank you for explaining this!

u should call esd again and ask 4 a tier 3 agent!! they have more powers to c whats happening with ur claim! the regular agents just read the notes on the screen but tier 3 can actually DO stuff!!

This is good advice. Ask specifically to speak with a claims specialist or tier 3 agent who can view the details of your adjudication status. Regular agents often can't see the specific notes or take any action on adjudication cases.
