Employer responded to ESD 3+ weeks ago - still no payment or denial. Is this normal?

I filed my unemployment claim in early January, and according to the ESD website, my former employer submitted their response on January 27th. It's been over 3 weeks since then, and I haven't received any decision or payment. My weekly claims all show as "pending" with no explanation. Wouldn't ESD have told me by now if my claim was denied? Is it normal to wait this long after the employer responds? My savings are getting dangerously low, and I'm starting to worry. Has anyone else experienced this kind of delay recently?

This is actually pretty common right now. ESD is experiencing delays with processing claims, especially if there's anything they need to verify or if your claim requires adjudication. If your weekly claims are showing as "pending" instead of "denied" or "disqualified," it usually means they're still processing. Have you checked your eServices account for any alerts or messages that might indicate they need additional information from you?

Thanks for responding! I've been checking my eServices account daily and there are no alerts or messages requesting additional information. My anxiety keeps growing because I have no idea if I'm going to get approved or not. Is there a way to tell if my claim is in adjudication?

5 weeks? That's so long! Did they at least backpay you for all those weeks you were waiting?

The SAME EXACT THING is happening to me right now!!! Filed in January, employer responded, and NOTHING for almost a month now. I've called at least 30 times and either get disconnected or told "the queue is full try again later" BS. This system is BROKEN beyond belief. Meanwhile bills are piling up and they don't care at all!!!

ya its crazy frustrating. they will backpay u tho so dont worry too much

Your claim is almost certainly in adjudication, which is why you're seeing "pending" status. Adjudication can take anywhere from 3-6 weeks currently, sometimes longer depending on claim complexity and current volume. The key things to know: 1. Check under "Decisions" in your eServices account - if nothing is there, no decision has been made yet 2. Make sure you continue filing weekly claims even while waiting 3. When approved, you'll receive all back payments for eligible weeks 4. If there's an issue requiring information from you, you'll receive a notice in your eServices account or by mail I recommend calling ESD to confirm the status, though I know getting through is extremely difficult right now.

Thank you for such a detailed response! I checked the "Decisions" tab and there's nothing there. I've been filing my weekly claims religiously. I'll keep doing that. It's such a relief to know this timeline isn't unusual, even though it's stressful.

Have you tried using Claimyr to reach an ESD agent? After trying for weeks to get through the normal ESD phone lines, I finally used their service and got connected to an agent within 30 minutes. They were able to tell me exactly what was happening with my claim and how much longer I could expect to wait. Saved me a ton of stress! Their website is claimyr.com and they have a video demo at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 that shows how it works. Definitely worth it when you're anxious about your claim status.

Is this service legit? I'm so desperate to talk to someone but I'm wary of third-party services asking for my information.

It's completely legitimate - they just help you get through the phone queue. They don't access your claim or personal information. They basically just hold your place in line and call you when they have an agent on the line. The ESD agents I spoke with seemed familiar with the service too.

my adjudication took 7 weeks last month so yours isnt even that bad yet lol. the whole system is a joke tbh. keep filing every week and when they finally approve it youll get all your money at once. also check your spam folder for emails from them, they sent me something important and it went to spam

7 weeks?? That's insane! Thanks for the tip about checking spam - just looked and nothing there, but I'll keep an eye on it.

You might be in adjudication without being told explicitly. I was in the same situation back in December 2024. My claim sat for weeks with no updates, and then I suddenly got a letter requesting more information about my separation reason. After I responded, it was resolved within a week. Also, did you have any unusual circumstances with your job loss? Like, did you quit or were you fired rather than laid off? Those situations almost always trigger adjudication and longer wait times.

It was a standard layoff, but my employer did contest it initially saying I was terminated for performance reasons, which isn't true. I provided documentation showing it was part of a larger departmental restructuring. I guess that disagreement could definitely have triggered adjudication.

Based on your last comment about the employer contesting the reason for separation, your claim is definitely in adjudication. When there's a discrepancy between your stated reason for separation and your employer's, ESD has to investigate before making a decision. This will typically add 3-6 weeks to the process. Since you provided documentation about the department restructuring, that's helpful. If you haven't already, make sure that documentation is uploaded to your eServices account. Continue filing weekly claims, and remember that if approved, you'll receive payment for all eligible weeks you've claimed.

Thank you so much for confirming. I did upload the documentation, including the layoff notice that mentioned the restructuring and emails from HR about the layoff affecting multiple people in my department. I'll keep filing and hope for the best!

Glad to see you got some good information here. One last thing I'll add - if you end up waiting more than 6 weeks total, you might want to contact your state representative or senator. They often have staff dedicated to helping constituents with ESD issues, and they can sometimes speed things up. But for now, it sounds like your claim is following the normal (though frustratingly slow) process for a contested separation reason.

That's a great tip about contacting my state representative - I hadn't thought of that! I'll give it another couple weeks and then try that route if there's still no movement. Thank you all for the helpful advice and reassurance!
