EDD Appeal Center Address Needed - Disqualified for Wrongful Termination Claim

I'm so frustrated right now. I got fired last month from my retail management job for supposedly 'violating company policy' when all I did was approve an emergency schedule change without going through 3 levels of bureaucracy first. My former employer is claiming misconduct, but it was literally an emergency situation! I filed for unemployment right away since I know wrongful termination should qualify me for benefits. Just checked my UI Online account yesterday and saw that dreaded DISQUALIFIED status. The determination letter says I need to file an appeal within 30 days, but it doesn't clearly state WHERE to send the appeal documents. There's a PO Box mentioned but I want to make sure it's the correct address before I mail anything important. Has anyone gone through the appeal process recently? What's the current address for the EDD Appeals Office? I'm in Los Angeles county if that matters. This is my first time dealing with an appeal and I'm worried about missing the deadline.

The Appeals Office address depends on which EDD office handled your claim. Check the top of your disqualification notice - there should be an Appeal Board or Office address listed there, usually with a specific PO Box number. If you're in LA County, it's likely the LA/Orange County Appeals Office, but don't just assume! Each determination letter should have the specific appeals info for your case.

Thanks for responding! I just double-checked my disqualification notice and found a PO Box in Sacramento (PO Box 826880). Is that right for LA County claims too? It seemed weird that I'd mail something to Northern California when I live down south.

6 weeks?? That's so long to wait when bills are piling up. Did you end up winning your appeal? I'm nervous about the hearing process too.

I went through this nightmare last year! The Sacramento PO Box (826880) is correct - ALL appeals go there first for processing, then they assign it to your local office. But here's what nobody tells you: SEND IT CERTIFIED MAIL WITH TRACKING!!! I mailed my appeal regular mail and EDD claimed they never got it. Had to start the whole process over and almost missed my deadline completely. Don't trust regular mail for something this important.

That's really good advice about the certified mail. I would have just used regular mail! I'll definitely pay extra for the tracking and delivery confirmation. Did you win your appeal eventually?

Yes, I won! But it took almost 3 months total from disqualification to getting benefits. The most important thing is to gather EVIDENCE. I submitted text messages from my supervisor proving they knew about my situation. The judge really focused on whether my employer had reasonable policies and if I knowingly violated them. Also, request all your employment records NOW from your HR department before they 'lose' them.

Thank you so much for this info. I actually have emails documenting the emergency situation and showing that what I did was reasonable under the circumstances. I'll definitely request my employment records tomorrow. Did you have to wait until the hearing to start receiving benefits, or did they start after you won?

I tried calling EDD 8 times yesterday and never got through - just the automated message saying they're experiencing high call volume and to try again later. Super frustrating!

If you're having trouble reaching EDD by phone (and who isn't these days), I'd recommend trying Claimyr. It's a service that helps connect you with an actual EDD agent instead of dealing with the constant busy signals. I was in the same situation with my appeal last month and was going crazy trying to get clarification. Used Claimyr and got through to a real person in about 20 minutes who confirmed exactly where I needed to send my appeal paperwork. You can see how it works at claimyr.com or check out their demo video: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km For your appeal, make sure you specifically address why your termination wasn't misconduct under UI law. That's different from wrongful termination in employment law - they're looking for whether your actions were deliberately against your employer's interests.

does that actually work? seems like paying for something that should be free

To address your actual appeal question - you need to focus on the legal definition of misconduct for UI purposes. Under UI law, misconduct requires a deliberate disregard of your employer's interests. If you made a good faith error or used poor judgment but weren't malicious, that's NOT misconduct! Make this very clear in your appeal letter. Explain the emergency situation and why your action was reasonable under the circumstances. The fact that you were trying to help in an emergency actually works in your favor here.

This is incredibly helpful, thank you! I didn't realize there was a specific definition of misconduct for UI purposes. I'll definitely focus on explaining the emergency circumstances and that I was acting in good faith. I just want a fair hearing.

Everyone here is giving you bad advice!!!!! Appeals don't go to Sacramento anymore since 2023!!!! They changed it to regional offices!!! You need to send it to the Southern California CUIAB office at PO Box 10133, Van Nuys CA 91410-0133!!! My cousin works for EDD and told me this! The address on your letter might be wrong if it's an old form they sent out!

That's not accurate. While there are regional CUIAB offices that will eventually handle the appeal hearing, the initial appeal paperwork must still be submitted to the central Sacramento address listed on the determination notice. After processing in Sacramento, it gets assigned to a regional office. Sending it directly to a regional office could delay processing or potentially cause the appeal to be missed entirely.

i got fired 4 being late (only 3 times!!) and was denied benefits too, the system is rigged against workers!! my appeal hearing was a joke, the judge basically took my ex-bosses side on everything. prepare to be treated like a criminal during your hearing

Sorry you had a bad experience, but not all judges are the same. I found mine to be very fair and she actually pushed back on my employer several times when they couldn't provide documentation. It really depends on the specific judge and how well you prepare your case. Tardiness can be trickier than what the OP is dealing with, since it's more clearly documented.

Since you're dealing with a misconduct disqualification, make sure your appeal letter specifically addresses these key points: 1. The emergency nature of the situation 2. Any policies or precedents that support your decision 3. Your history of following proper procedures in non-emergency situations 4. Any communication with supervisors about the incident 5. How your actions were in the company's best interest despite not following protocol The legal standard for misconduct requires that your actions showed a "substantial disregard of your employer's interests" - emergency situations often create exceptions to normal rules. You should also request a copy of your claim file using an EDD Request for Records form (DE 8330). This will let you see exactly what your employer told EDD.

Thank you for laying this out so clearly! I definitely have proof that I've followed the proper channels before in normal situations, and I can show that I was acting in the company's best interest during the emergency. I'll request my claim file right away.

One more tip that really helped me: after you mail your appeal, call the CUIAB office directly (not regular EDD) to confirm they received it. Their number is 916-263-6777. They're usually much easier to reach than regular EDD. Ask for your appeal case number and write it down somewhere safe. You'll need it for all future communications. And when you eventually get your hearing notice, call and request all documents your employer has submitted for the hearing - you have a legal right to see them before the hearing date.

Thank you! I would never have known to call CUIAB directly or that I could request the employer's documents. This community has been so helpful - I feel much more prepared to handle this appeal now.
