EDD claims they never received my appeal despite certified mail proof - what's my next step?

I'm at my wit's end with EDD right now. I filed an appeal over two months ago after they disqualified me claiming I provided false information (which I absolutely didn't). I sent the appeal via certified mail and have the return receipt WITH SIGNATURE proving they received it. But now when I call, every rep I talk to claims they have no record of my appeal in their system! Just today I spoke with two different reps who both said the same thing - no appeal on file. Last week I talked to someone who had me text photos of my appeal paperwork and the certified mail receipt to some EDD number. They assured me it would be processed. Called back 3 days later and a different rep said everything looked good and my case was cleared. Now suddenly they're telling me again that I provided false information and that they never received my appeal despite me having LITERAL PROOF they signed for it. I'm so frustrated and don't know what to do next. Has anyone dealt with something like this? What options do I have when EDD keeps contradicting themselves and ignoring documented proof?

omg this happened to me too!!! EDD is seriously the WORST. i appealed a decision last year and even though i had delivery confirmation they kept saying they never got it. i had to resubmit my appeal THREE TIMES before someone finally acknowledged it. its like they purposely "lose" appeals hoping people will just give up!!!

i had a similar issue w/ edd last yr... they kept sayin they didnt have my docs even tho i sent them. wat finally worked was faxing everything. sounds old school but they cant claim they didnt get it if u have the fax confirmation. also take pics of EVERYTHING before u send it

I've never heard of Claimyr before. Does it actually work? I've spent HOURS trying to get through on the regular EDD line only to get disconnected or speak to someone who can't help. At this point I'm willing to try anything if it means getting this resolved.

Do it both ways - in writing (certified mail again) AND by phone. You don't need an attorney for an ALJ hearing, though you can bring one if you want. Many people successfully represent themselves. Just be organized, bring multiple copies of all your evidence, and stick to the facts. Something similar happened to me last year, and what finally worked was sending my appeal paperwork AGAIN, but this time I sent it to THREE different EDD addresses simultaneously - the appeals office, the main EDD office, AND the compliance department. I also included a cover letter explaining the situation and attached copies of my original certified mail receipt. Also - and this was key - I faxed the SAME packet to their appeals fax number AND emailed scanned copies to my local EDD office. It was overkill, but within 10 days I got a call from someone saying they found my original appeal and were processing it. Don't give up! The system is designed to wear you down, but persistence pays off.

This is actually really smart. My uncle works for a different state agency and says they call this the "shotgun approach" - hit every possible entry point with the same information so at least one has to get through. Makes it harder for them to claim they never received anything.

wait im confused... if u have proof they got ur appeal (the certified mail receipt) cant u just show them that? shouldnt that be enough to prove u sent it on time? the whole point of certified mail is to prove delivery right?

The person who signs for mail in their mailroom is not the same person who processes appeals, and items can get lost in their internal routing. DONT WASTE YOUR TIME with regular EDD reps!!! You need to talk to a MANAGER or SUPERVISOR!!! When you call, immediately say "I need to speak to a supervisor about an appeal that was received but not processed." If they try to help you themselves, firmly repeat your request. Regular reps CANNOT see or fix appeals issues!!!

I'll definitely try this. Every time I've called so far, I just get bounced around between reps who all tell me different things. Do supervisors actually have more system access? I'm starting to think nobody at EDD knows what's going on.

Just want to add that I was in a similar situation where EDD claimed they never received my identity verification documents even though I had proof of delivery. After months of frustration, I finally attended an in-person appointment at an EDD office rather than trying to resolve it by phone. The in-person staff actually took the time to search through different systems and found my documents had been received but filed under the wrong SSN (someone had transposed two digits). Might be worth seeing if you can schedule an in-person appointment if phone calls aren't working.

That's a really good suggestion! I didn't even realize in-person appointments were an option. I'll look into that right away. It makes sense that someone might be able to do a more thorough search if we're face-to-face rather than over the phone.
