EDD appeal nightmare - sent in 5 weeks ago but status not updated

I'm so frustrated with the appeals process and getting contradictory information. I mailed my appeal for a disqualification on June 23rd, and tracking shows it was delivered June 28th. It's been 5 weeks and my UI Online account still shows 'Disqualified' with no indication they received my appeal. I've called EDD four times in the last two weeks and gotten completely different answers each time: Rep #1: "We received it but don't have staff to update the system - could take months before your hearing" Rep #2: "We have no record of your appeal - you need to submit a new one with a letter explaining why it's late" Rep #3: "We're still processing appeals from 2024 - just be patient" Rep #4: "Your appeal might be lost - submit again through UI Online instead" I'm at my wit's end! Has anyone dealt with this appeal limbo? Should I submit another appeal or just keep waiting? I'm worried about missing my hearing date if they have it but never tell me!

I went through a similar situation last month. In my experience, you should absolutely send another appeal letter with a brief explanation that you submitted previously but were told by an EDD rep to resubmit. Also include proof of the first delivery (tracking info). EDD appeals are completely overwhelmed right now, and their systems don't communicate well with each other. Make sure to send it certified mail again and keep detailed records of all communications including rep names, dates/times, and what was said. You don't want to end up missing your appeal window because of their internal issues.

omg same!!! my appeal has been "in process" for like 2 months and every time i call they tell me something different. one lady said they got it another guy said theres nothing in the system. so annoying like how do they not know whats going on with our claims??

I had the EXACT same issue in April. Mailed my appeal and it disappeared into a black hole. Called 36 times over two weeks and couldn't get through to anyone who could actually check on my appeal status. They found my original appeal, but it hadn't been scanned into their system yet. The tier 2 rep made notes on my account that I had called about the appeal so there was a record. My hearing was scheduled about 7 weeks after I sent in the appeal, but I only got the notice 1 week before the actual hearing date. So definitely keep checking your mail!

i think you should wait at least 8 weeks before worrying. my cousin had same problem and his appeal just showed up in the system after like 2 months without any letters or notifications. the whole system is just backed up rn

No way should they wait 8 more weeks! Appeals have deadlines and if EDD "loses" their appeal they could be permanently disqualified. Always document EVERYTHING with these people - they will use any excuse to deny benefits.

When I appealed my disqualification last year the exact same thing happened!!!! I sent it certified mail and they STILL claimed they never got it! I had to send THREE appeals before they finally admitted they had it. AND THEN they scheduled my hearing for when I was out of town even though I listed dates I wasn't available!!! The whole system is designed to make you give up. DON'T GIVE UP. Keep sending appeals every 2 weeks until they acknowledge it!!!!

Yes I won because my employer didn't even show up to the hearing! After all that! Make sure you prepare all your evidence and submit it before the hearing. And if you send multiple appeals just label them clearly as DUPLICATE - ORIGINAL SENT ON XX/XX/2025 so they know.

Update to my earlier comment: I just checked the CUIAB website, and they state that the current average processing time for appeals is 61 days from receipt to hearing. So while 5 weeks feels long, it's actually still within their normal timeframe. Here's what I recommend: 1. Send a duplicate appeal via certified mail 2. Include a cover letter stating this is a duplicate 3. Attach proof of your original submission (tracking number) 4. Call CUIAB directly at (800) 400-7166 instead of regular EDD 5. Continue checking your UI Online account daily The CUIAB phone line is separate from EDD and specifically for appeals status.

btw when i finally got my appeal hearing they only gave me like 5 days notice!! so make sure ur checking ur mail every single day or you might miss it. good luck!!

same happened to my friend! notice came super late and he almost missed his hearing. they should email or text but nope just regular mail like its 1995 lol
