EDD refusing to repay me after winning my CUIAB appeal - 6 weeks of excuses

So frustrating!! I managed to win my appeal with CUIAB back on November 3rd (after fighting for MONTHS to prove I was laid off, not fired). The judge ruled in my favor, and the overpayment status updated in my UI Online account last week. According to my calculations, EDD owes me around $4,200 that they had previously taken back from me. But now they're playing these ridiculous waiting games! First, the rep I spoke with said "wait a week" for processing. I waited patiently. Called back, and suddenly it's "oh these take 3 weeks to process." Called AGAIN today and now they're claiming it takes "at least 4-6 weeks" to reissue payments after a successful appeal?! Has anyone else dealt with this? I've been waiting over a month already for money that's rightfully mine. My bills are stacking up, and every time I call I get a different timeline. Is there anything I can do to speed this up, or is EDD just hoping I'll give up?

same thing happen to me last year!! i won my appeal and it took them 8 WEEKS to pay me back what they owed. the whole system is designed to make u give up. the worst part was every rep told me something different. one said 2 weeks another said 2 months like wtf???

8 WEEKS?? I can't wait that long. That's insane. Did you do anything that helped move things along, or did you just have to wait it out?

Unfortunately, this is fairly typical of EDD's repayment timeline after a successful appeal. When the judge rules in your favor, it doesn't automatically trigger repayment. The CUIAB decision has to be processed by EDD's special processing unit, which handles appeal reversals and payment adjustments. A few things that might help: 1. Request to speak with a Tier 2 specialist when you call (they have more authority) 2. Ask specifically about the status of your "appeal reversal payment processing" 3. Check if they've issued a "Notice of Adjustment" yet - this is the document that officially confirms the amounts owed to you 4. Contact your state assembly member's office - they can sometimes expedite these matters In my experience helping claimants, 4-6 weeks is unfortunately accurate, though I've seen some resolved in as little as 3 weeks.

Thank you for the detailed response! I haven't received any Notice of Adjustment yet, so maybe that's what I'm waiting on. I'll definitely ask about that specifically next time I call. Do you know if contacting my assembly member really works? I've heard mixed things about that approach.

SEPTEMBER?? That's ridiculous! Have you called them? What reason are they giving you for the delay?

I had almost the exact same experience but finally got my money back about 5 weeks after winning my appeal. The key was getting through to a supervisor who could actually see what was happening with my case. Regular reps just read scripts and have no real power. If you're struggling to get through to EDD on the phone, I recently discovered a service called Claimyr (claimyr.com) that helped me FINALLY get past the constant busy signals. You pay them and they connect you directly to an EDD rep without the hours of redialing. They have a demo video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km Once I got through to a supervisor, they explained that my payment was stuck in a "pending review" status that needed manual approval. They pushed it through that same day, and I had my money 2 days later. Definitely ask to speak to a supervisor specifically about your appeal reversal payment status.

It worked for me! I was skeptical too, but after spending 3 days trying to get through myself, I was desperate. Got connected to an actual person in about 25 minutes.

If you won your appeal on November 3rd, it's completely reasonable that your repayment is still being processed. The timeline is typically 4-6 weeks, and in some cases longer, depending on the complexity of your case and the current workload at EDD. The process involves several steps: 1. CUIAB transmits the decision to EDD (can take 5-7 business days) 2. EDD's Appeals Division processes the decision (another 5-10 business days) 3. The Overpayment department recalculates and reverses charges (7-14 business days) 4. Payment processing department issues repayment (3-5 business days) You should receive a Notice of Adjustment before any payment is processed. This will show the recalculated benefit amount and confirm what you'll be paid. In the meantime, continue to monitor your UI Online account for updates. The status should change from "Appeal Filed" to "Appeal Approved" and then to "Payment Processing."

Thanks for breaking down the process! My status did change from "Appeal Filed" to "Appeal Approved" about 2 weeks ago, but hasn't moved since then. I guess I'm somewhere in step 3 of your timeline. I'll keep watching for the Notice of Adjustment.

you can try calling your assembly person. they got my claim fixed when edd was ignoring me for 2 months.

This is actually very good advice. Your state representatives have dedicated EDD liaisons who can escalate issues. You'll need to fill out a privacy release form, but they can often get answers and action when regular channels fail.

I understand your frustration! The waiting game with EDD is absolutely maddening, especially when you've already gone through the stress of an appeal. In my case, I won my appeal in July, and initially they told me 2-3 weeks. It ended up taking exactly 5 weeks from the date my UI Online account updated to show the appeal was successful. What helped me was sending a secure message through UI Online specifically asking about the "appeal payment processing timeline" and requesting an estimated date for resolution. Interestingly, I received my Notice of Adjustment about 3 days before the money actually appeared in my account. So once you get that notice, you're very close to getting paid! I'd recommend documenting everything - dates of calls, names of representatives, and what they told you. This can be helpful if you need to escalate the issue later. Hang in there! The money will come eventually, it's just a matter of navigating their bureaucracy.

Thanks for sharing your experience. I've been sending messages through UI Online but they just reply with generic responses. I'll try specifically mentioning the "appeal payment processing timeline" like you suggested. And I'll definitely watch for that Notice of Adjustment - at least that would give me some hope that the end is in sight!

The system definitely has flaws, but it's also processing millions of claims. The appeals process actually has statutory timelines they must follow. The biggest issue is usually staff training and consistency in communication with claimants.

UPDATE: I finally got through to someone helpful! After calling about 20 times this morning, I reached a Tier 2 specialist who looked into my case. Apparently, my appeal reversal was sitting in a queue waiting for manual review. The specialist said she would escalate it and marked it as "urgent" since it's been over 30 days since the judge's decision. She said I should see movement within 5-7 business days and to call back if nothing changes by next Friday. She also confirmed I should receive a Notice of Adjustment before any payment is processed, so I'll be watching for that. At least now I have a somewhat definite timeline and someone who actually looked at my specific case instead of giving me generic information. Thanks everyone for your advice and support! I'll post another update when (hopefully) I get my money.

That's great news! Getting to a Tier 2 specialist makes all the difference. They have the authority to actually move things along rather than just read scripts. Fingers crossed you'll see that money soon!
