EDD back pay delay after winning appeal - should it take 5+ weeks?
I finally won my appeal hearing for my disqualification last month (Feb 10th) and I still haven't received my back pay for the 8 weeks I was wrongfully denied benefits. The judge ruled completely in my favor saying the employer's allegations were unsubstantiated, and I received the official decision letter about 3 weeks ago. My online account still shows the weeks as 'disqualified' even though I won the appeal. I'm expecting around $4,200 in total back payments. Has anyone else won an appeal recently? How long did it take for your account to update and actually get your back pay? I'm getting really anxious because my rent is due and I thought this would be resolved by now. Called EDD like 40 times but just get the 'too many callers' message and hung up on.

Congrats on winning your appeal! I went through something similar in December. After winning, it took exactly 4 weeks from the date on my appeal decision letter for the back payments to hit my account. EDD has to manually process these payments - they don't automatically update in the system when you win. You should see your disqualification weeks change to 'paid' status soon, probably within the next week. Make sure you check both your UI Online account AND your Money Network card balance (if that's how you receive payments). Sometimes the online account takes longer to update even after the money is sent.

I'll do that right now. Did your weeks change from 'disqualified' to 'paid' all at once or did they update one by one?

mine took 9 WEEKS after winning!!!! the system is so broken its unbelievable. nobody at edd seems to talk to each other. i had to call like 100 times to finally get someone who could help. dont get your hopes up for it being fast lol

•yea calling helped but only when i finally got thru to a tier 2 specialist. the regular reps just kept saying 'wait longer' which was BS

What often causes delays is that the Claims Processing department has a separate backlog from the Appeals Division. Your best course of action is to contact EDD directly to check on the status of your payment implementation. If you're having trouble getting through on the phone, try calling right when they open at 8:00 AM.

Try using Claimyr to get through to EDD. I was in the exact same situation last month and was going crazy trying to get through. Someone on here recommended it, and I was connected to a rep in about 25 minutes. Cost some money but was worth it to finally get answers. The rep I spoke with was able to expedite my back pay after I explained I'd already won my appeal. •Yes! Turns out my case was sitting in someone's work queue and they hadn't gotten to it yet. The rep I spoke with was able to prioritize it once I explained I'd already won the appeal weeks ago. Had my money 3 days later.

is the back pay seperate from regular payments? i'm confused because my son just filed appeal but still certifying every 2 weeks waiting for judge decision...if he wins does he get big payment all at once or how does that work?

•Great question. If your son continues to certify while his appeal is pending (which is the correct thing to do), then IF he wins his appeal, all those weeks that were previously disqualified or pending will be paid as a lump sum. This is separate from any new bi-weekly payments for current certifications. He should make sure to keep certifying for all weeks, even while waiting for the appeal decision.

The EDD is THE WORST agency in California, maybe the entire country!!! I won my appeal in September and didn't get paid until JANUARY!!! 17 weeks of waiting after WINNING my case. The judge said I was right, but EDD still made me wait months for MY MONEY. They don't care that people have bills to pay and families to feed. Every time I called, they told me something different - "it's processing" or "we don't see the appeal decision in our system" or "it should be another week" - LIES! The whole system is designed to make people give up. DON'T GIVE UP!

•I had to get my state assembly member involved!!! Called their constituent services office and they contacted EDD on my behalf. Magically got paid 2 weeks later after MONTHS of nothing. Look up your local assembly member and call them!!!!

I know exactly what you're going through. I won my appeal in January after being disqualified for 6 weeks. It took about 5 weeks after receiving the judge's decision for my back pay to appear. What finally helped was speaking with a Tier 2 specialist (not the first-level reps) who could actually see where my case was stuck in the system. One key thing I learned: the Appeals Division and the Payment Processing teams are completely separate departments with different systems. The Payment team won't even see your case until the Appeals team fully processes it on their end and transfers it over. And apparently there's a massive backlog. If you're approaching 6+ weeks with no movement, I'd recommend requesting a call from a Tier 2 specialist specifically - they have more access and authority to push payments through.

•You have to specifically ask to speak with a Tier 2 specialist who handles appeal payment implementation. The first-level rep will usually try to handle it themselves, but be polite and firm that you need someone with access to the payment processing system. If they say no one is available, ask for a callback from a specialist. Be prepared to wait 1-2 days for the callback, but it's worth it.

i just went thru this last month! won my appeal for 5 weeks of payments and got my money exactly 32 days after the judge decision came in mail. what helped me was checking my ui online account message center every day and i actually got a message saying "your appeal was processed and payments are being issued" about 3 days before the money showed up. check ur message center!!!!

Just wanted to follow up here. After you get your back pay, make sure you double-check that ALL your disqualified weeks were properly paid. I had 7 weeks disqualified, but when my account updated after winning my appeal, only 5 weeks were changed to "paid" status. I had to call again to get the other 2 weeks fixed. Apparently, this is a common issue where partial payments are processed. Also, check that the correct benefit amount was paid - mine was initially calculated wrong and I had to get that corrected too. Good luck!

UPDATE: I finally got through to EDD this morning! Used Claimyr and was connected to a rep in about 30 minutes. They told me my appeal was actually still being processed by the Appeals Division and hadn't been sent to Payment Processing yet - even though I got the decision letter 3 weeks ago! The rep submitted an "urgent request" to expedite it and said I should see movement within 7-10 business days. Thanks everyone for your advice and support through this frustrating process. I'll update again when I actually get paid.

•That's great you finally got through! It's unfortunately very common for the Appeals Division to be slow in processing the actual implementation of decisions. The "urgent request" should help, but don't be surprised if you need to follow up again in 10 days if nothing happens. The squeaky wheel definitely gets the grease with EDD. Keep us posted!
