27 weeks with ZERO movement on EDD appeal - class action lawsuit material?
Just hit the 27-week mark waiting for my appeal to be processed. TWENTY-SEVEN WEEKS! That's more than half a year of absolute silence from EDD. And this doesn't even include the 5 weeks I waited after submitting my initial claim before I got the disqualification notice that I'm now appealing. I check my UI Online account daily - no updates, no status changes, nothing. I've called literally hundreds of times and either can't get through or get transferred to someone who can't help. My rent is 3 months behind, my credit is destroyed, and I'm living off family loans at this point. How is this even legal? Has anyone successfully moved their appeal forward after this long? At what point do we organize a class action lawsuit against EDD for this ridiculous negligence? I'm genuinely curious if anyone has heard of legal action being taken because this feels criminal at this point.

I'm so sorry you're dealing with this. Appeals are severely backlogged, but 27 weeks is definitely on the extreme end. Have you tried contacting your state assembly member? They can often get movement on stalled appeals. Send them an email with your claim ID, contact info, and a brief explanation. Many people here have reported appeals suddenly moving forward within 1-2 weeks after assembly member involvement.

•I contacted my assembly member about 15 weeks ago. Their office sent me a form to fill out, which I completed and returned the same day. They said they'd "look into it" but I haven't heard anything substantial since then other than a generic "we're still working on your case" email they sent after I followed up twice. Should I try a different assembly member or maybe even my state senator?

I was in a similar position last year (waited 19 weeks) and finally got movement by using Claimyr to get through to a tier 2 specialist. They can't speed up the appeal process directly, but they helped me get my case flagged for priority review which moved things along. It got me connected to an actual person who could see what was happening with my appeal. Turns out my paperwork had been improperly scanned and was sitting in digital limbo. LOL CLASS ACTION LAWSUIT😂😂 good luck with that!! the goverment dosnt care about us regular ppl. ive been fighting with EDD for 8 months about an overpayment they say i owe from 2021 but i have proof i reported everthing correctly. the systems completely broken but nobody with power cares enough to fix it

The California Unemployment Insurance Code actually specifies reasonable timeframes for appeals that they're completely ignoring. That's why I'm wondering if anyone has actually pursued legal action. There actually WAS a class action lawsuit against EDD back in 2021 regarding appeal delays during the pandemic. It was called Botts v. California Employment Development Department. The court ordered EDD to resolve certain types of claims more quickly. I'm not sure if there's anything similar happening now for current delays, but it does set a precedent. You might want to contact legal aid organizations like Legal Aid at Work or the Center for Workers' Rights to see if they know of any current litigation or if your case might qualify for legal assistance.

Your assembly member's office might be overwhelmed - try calling instead of emailing, be persistent, and specifically request they escalate your case to a supervisor at EDD Appeals Division. When I had my appeal last year the judge told me they were processing appeals from 9 months ago!!! It's completely insane. My appeal took 22 weeks from filing to hearing, then another 3 weeks to get the decision. And I won but guess what? EDD STILL didn't process my payments for another month after that! The whole system is a disaster.

my cousin works for edd (not in appeals tho) and she says theyre still understaffed by like 40% since covid and theres litterally thousands of appeals backed up. its not right but thats why its taking so long

While you're waiting, make sure you're documenting everything - keep a log of all your call attempts, save screenshots of your UI Online account showing no updates, and maintain copies of all correspondence. This documentation could be important both for your individual appeal and if a class action does materialize. Also, have you requested an expedited hearing based on financial hardship? If you're facing eviction or have other severe financial distress, you can submit an expedite request with documentation of your hardship. It doesn't always work, but I've seen cases move much faster when severe hardship is proven.

I can definitely provide documentation of hardship - eviction notice, utility shutoff warnings, medical bills I can't pay, etc. Where exactly do I submit the expedite request? Is there a specific form or do I just write a letter to the Appeals Board?

For an expedited hearing request, you need to send a written request directly to the Office of Appeals where your case is assigned. Include your appeal case number, your name, the last 4 of your SSN, and detailed explanation of your hardship with supporting documentation. If you're not sure which office has your appeal, call the main Appeals Board number at 1-800-300-5616 and ask them to confirm where your case is assigned. Regarding getting through to EDD - I've had success calling exactly at 8:01am when they open and using the 1-2-4 prompt sequence. You'll still wait on hold, but at least you'll be in the queue. Keep trying the Claimyr service mentioned above too - having a tier 2 rep flag your case can make a difference. Don't give up - the system is frustrating by design, but persistence pays off. I waited 18 weeks for my appeal last year, but eventually won and received full backpay.

hey just fyi when i won my appeal i had to call constantly for a month to get them to actually process my payments, the decision doesnt automatically trigger payment. so once you get thru all this bs be ready for more bs lol
