EDD appeal decision delay - Judge said ruling favorable but nothing in UI Online after 2 weeks
Has anyone else experienced this frustrating situation with an EDD appeal? On April 2, 2025 I had my phone hearing with an administrative law judge about my disqualification. At the end of the hearing, the judge actually told me 'I'm ruling in your favor and will be submitting my decision within the hour.' That was over 2 weeks ago! My UI Online account STILL shows my claim status as 'Appeal' with no updates, and my retroactive payments are still on hold. I've called the Fresno Appeals Office 3 times this week and each time they tell me the judge hasn't submitted ANY decision and it could take 8-10 WEEKS! Why would a judge explicitly tell me she was ruling in my favor and then seemingly not submit anything? Has anyone dealt with this kind of delay after being told you won your appeal? How long did it actually take to get the decision letter and for your back benefits to start processing?

Unfortunately this happens A LOT with EDD appeals. The judges have the authority to make the decision during the hearing, but the actual processing takes much longer. When I had my appeal hearing last year, the judge also told me I won but it took about 3 weeks for it to show up in the system. The decision letter came about a week after that, and then another 2 weeks for the back payments to process. The timeline the appeals office gave you is the worst-case scenario. Most decisions are processed within 2-4 weeks, but they quote 8-10 weeks to cover themselves. Just keep checking your UI Online account daily - the status will change from 'Appeal' to 'Paid' once the decision is officially in the system.

OMG they did the EXACT same thing to me!!! Judge said I won and then NOTHING for like 6 weeks!!! I called everyday and they kept saying they didnt have the decision on file yet. SO FRUSTRATING!!!! The system is broken and they dont care at all about us. All that stress for nothing becuz even when u win they make u wait forever. I almost lost my apartment waiting. Did u try contacting ur assembly member?? Thats what finally worked for me.

I work for a nonprofit that helps people with EDD issues, and I can tell you this delay is actually normal (though still frustrating). What's happening is that after the judge makes their decision, it goes through several administrative steps: 1. The judge writes up the formal decision (can take 1-2 weeks) 2. Administrative staff processes the decision into the system (another 1-2 weeks) 3. The payment system has to recalculate your eligible benefits (1 week) 4. Finally, payment processing begins (1-2 weeks) So even though the judge has made their decision in your favor, the system takes time to catch up. I'd recommend calling the EDD main line directly to speak with a claims specialist rather than the appeals office - they sometimes have more updated information about where your claim stands in the process.

If you're having trouble reaching someone at EDD who can give you a real update, I'd recommend trying Claimyr (claimyr.com). I was in a similar situation with my appeal decision taking forever and couldn't get through on the regular lines. This is going to sound weird but check your mail carefully - they sometimes send the decision letter without updating the online system first. I had a similar situation in January where UI Online still showed 'Appeal' status for weeks after my hearing, but the decision letter had actually been delivered to my mailbox. Two days after I received the letter, the online system finally updated and my payments started processing. Don't lose hope!

same thing happpened to my roomate last month. judge said he won but took like 5 weeks to see any $$$. EDD is always slow AF no matter what they tell u

•EXACTLY!!!! They tell you one thing and do another its sooooo frustrating! Even after i won my appeal i had to keep certifying every week even tho i wasnt getting paid yet. did ur roommate have to do that too???

Just an additional tip while you're waiting - make sure you continue certifying for benefits every two weeks, even though they're not paying you yet. Once the appeal decision is processed, they'll only retroactively pay for weeks that you properly certified for. I've seen people win their appeals but miss out on thousands in back payments because they stopped certifying during the appeal process.

•Oh that's a really good point! Yes, I've continued to certify every two weeks even though my account still shows disqualified for each certification. So hopefully once this is resolved, all those weeks will switch to paid status. Fingers crossed!

Update on what I said earlier - I just spoke with a colleague who works at the appeals board, and they mentioned they've been experiencing a significant backlog due to a new computer system integration that started in March 2025. This is likely contributing to your delay. If it's been more than 3 weeks since your hearing, I definitely recommend either calling the main EDD line and requesting to speak with a Tier 2 specialist who can check the appeals database, or contacting your state representative's office as someone else suggested.

After you won your appeal, did they tell you if you'd have to serve any penalty weeks? I also won my appeal recently but even after that I had to serve 5 penalty weeks because of how I originally answered a question on my application. Just wondering if that might be causing additional delay for you.

•The judge didn't mention anything about penalty weeks during my hearing. My disqualification was because my employer claimed I quit voluntarily, but I was able to prove it was a layoff due to lack of work. From what I understand, penalty weeks are usually for different types of issues, right?

I've been through 3 appeals with EDD (lucky me!) and each time the timeline was different. First one took 4 weeks from hearing to payment, second one was about 6 weeks, and the third one somehow processed in just 10 days. It seems to really depend on which office is handling your appeal and their current workload. The most important thing is that you won - the money will come eventually, even if it takes longer than it should.

•10 DAYS?!?! Thats crazy fast! Mine took 6 weeks and I called literally everyday. The system is so random and unfair. Some people get lucky and others have to fight for everything!
