EDD calling outside scheduled interview windows - missed my chance to fight disqualification?
I'm at my wits' end with these EDD phone interviews! In the past 6 weeks, I've been scheduled for TWO eligibility interviews and both times EDD completely ignored their own scheduled time windows. First interview: They mailed me a notice with a specific 2-hour window. I took time off work and sat by my phone the ENTIRE time. No call. Then 3 hours AFTER the window closed, they called when I was in a meeting. Missed it. A week later I got a disqualification notice saying I "failed to participate" in the interview. I immediately filed an appeal, but who knows when that'll be processed. Second interview: Scheduled for today between 10-12. Never received ANY notification letter this time. At 1:45pm my phone rings from a Sacramento number, I answer it saying "Hello?" and they immediately disconnect! Checked my UI Online and there's now a notice saying another interview is "complete" - what the heck? I'm seriously confused about my rights here. Am I supposed to just sit by my phone all day every day just in case EDD decides to call 3+ hours late? Does anyone know if they're allowed to make determinations based on interviews they never actually conducted? Should I file another appeal? I'm really worried they're going to cut off my benefits because they keep calling outside their own scheduled windows.

This happened to me too!!!! EDD is absolutely terrible with their interview scheduling. They called me 2 days AFTER my scheduled interview and then disqualified me for "not being available." I appealed and won though, so definitely appeal this second one too if they disqualify you. The judge at my hearing was actually pretty understanding about the whole thing.

•That's good to know someone won their appeal! How long did it take for your appeal to get scheduled? I filed my first appeal 3 weeks ago and haven't heard anything back yet.

•Calling them 50 times is literally impossible tho. I tried calling 9 times yesterday and every time got the "we're experiencing high call volume" message and they hung up on me. System is rigged.

EDD eligibility interviewer here. Let me clarify a few things: 1. You should ALWAYS receive a DE 4800 notice before your interview with the date and time window. If you didn't receive one for your second interview, that's a procedural error you can cite in your appeal. 2. The time windows are guidelines, but unfortunately due to high volume, interviewers sometimes fall behind schedule. However, they should still attempt to conduct a proper interview, not just call and hang up. 3. You have the right to appeal any determination made without proper interview procedures being followed. Document everything - the exact times they called, that you answered, that they hung up, and that you were available during the scheduled window. 4. Check your UI Online inbox for any messages about why they scheduled these interviews in the first place. Understanding the underlying eligibility question will help with your appeal. 5. While waiting for appeal, continue to certify for benefits if your claim is still active.

•Thank you - this is really helpful. I checked my UI Online inbox and the issue is about "availability for work" because I had a week where I was sick but still looking for jobs online. Should I mention all this in my appeal letter? Also, do you know if there's any way to request that future interviews actually happen during the scheduled window?

Absolutely include all these details in your appeal. For "availability for work" issues, be sure to explain that even while sick, you were still able and available to accept suitable work and were actively job searching online. Provide specific examples of jobs you applied for during that period if possible. Regarding scheduled windows, there's unfortunately no formal system to guarantee they'll call within the window. However, you can request an accommodation in your UI Online account if you have specific time constraints due to work, medical appointments, etc. This doesn't guarantee they'll honor it, but it creates a record of your availability constraints. In your appeal, I recommend explicitly stating that you were available during the scheduled window, were not properly interviewed, and that the determination was made without allowing you to present your side of the issue. Good luck!

•Really appreciate the detailed advice. I'll definitely include all of this in my appeal. Just hoping they don't disqualify me for the second "interview" that never actually happened.

Try using Claimyr to get through to an EDD rep directly - it helped me resolve a similar situation last month. Instead of waiting for another appeal process, I used their service at claimyr.com and got connected to an EDD specialist within 20 minutes who fixed my interview issue on the spot. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km The rep I spoke with explained that sometimes interview notes don't get properly recorded in their system, and they were able to reschedule me for a proper interview that actually happened when it was supposed to. Worth a try rather than waiting months for an appeal hearing.

•I hadn't heard of this before. Did they actually help you get a new interview scheduled? My biggest concern is that they'll just disqualify me again without ever talking to me.

Yes, they helped me get connected to an EDD rep who had the authority to see what happened with my interview and schedule a new one. The rep noticed that my interviewer had recorded "claimant not available" even though they called outside the window. They fixed it in the system and set up a new interview with notes about the previous error. The new interview happened on time and my issue was resolved. Make sure when you talk to them that you emphasize you were available during the scheduled window and have documentation (screenshots of your phone showing when they actually called, etc). The more evidence you have, the better.

•Does this actually work? Seems sketchy to use a third party service when dealing with EDD stuff

I'm an administrative law judge who handles EDD appeals (not speaking in official capacity). Here's the official take: EDD is required to make a reasonable attempt to contact you during your scheduled window. Calling hours later and calling/hanging up do NOT constitute reasonable attempts. These are very strong grounds for appeal. You should: 1. File an appeal immediately for the second determination 2. Request a copy of your case file for both appeals (this will show their call records) 3. Continue certifying while appealing 4. Submit any evidence of the calls (phone records showing EXACTLY when they called) While waiting, contact your state assembly member's office. They can often get EDD to respond much faster than you can on your own. In my experience, cases like yours are often reversed on appeal.

•This!!! Contacting my assembly member was what finally got my case looked at. They have special EDD liaisons who can cut through red tape way faster than regular people can.

UPDATE: I called EDD this morning (took 27 attempts to get through) and finally spoke to someone who confirmed they have me down as "no contact made" for yesterday's interview. She said the interviewer's notes claim they "couldn't complete the call due to connection issues" but admitted it was done outside the scheduled window. She's escalated it to a supervisor to see if they can reschedule rather than making a determination without talking to me. I'm still going to file an appeal for this second interview just to be safe, but at least I have some documentation that I did answer and they acknowledged calling outside the window. Will update again if anything changes!

•This is good progress. Be sure to get the name of the representative you spoke with and the date/time of your call. Request a confirmation number for the escalation if possible. Document EVERYTHING - it will help tremendously with your appeal.
