Can I reapply for benefits after EDD termination for missing RESEA appointment?

So I'm really stressed right now. I was receiving unemployment for about 8 weeks after my company downsized our department. Everything was going fine - I was certifying regularly, doing my work search activities, the whole deal. Then I got this notice about a mandatory RESEA appointment (Reemployment Services and Eligibility Assessment) scheduled for last Wednesday at 2pm. The problem is, I never saw the notification until YESTERDAY because it went to my spam folder! Now my UI Online account shows my claim as 'disqualified' and my last payment is on hold. I tried calling EDD about 50 times today but couldn't get through to anyone. Has anyone dealt with missing a RESEA appointment before? Can I appeal this disqualification or do I need to file a completely new claim? I'm freaking out because rent is due in two weeks and I have absolutely no income right now. Any advice would be seriously appreciated!

OMG the EXACT same thing happened to me last year!!! The EDD is so unfair about these appointments. I missed mine because I was in the hospital with my kid who broke his arm (like what was I supposed to do???) and they cut me off without even listening to my explanation. I think the whole system is designed to kick people off benefits. So frustrating!!

That's awful! Did you ever get your benefits reinstated? I'm trying to figure out if I should file an appeal or just start a whole new claim.

This happened to my cousin. He had to file an appeal and write a letter explaining why he missed it. took him like 2 months to get his $ back tho

You definitely need to file an appeal right away, not a new claim. This is considered a disqualification, not a termination of your benefit year. You have 30 days from the date of the disqualification notice to file your appeal. Go to your UI Online account and look for the Appeal option. You'll need to explain that you never received proper notification because it went to your spam folder. Make sure to check "Yes" where it asks if you want a hearing. The appeal form will also ask if you want a phone hearing or in-person hearing - I recommend phone as it's faster. In the meantime, continue to certify for benefits every two weeks even though you won't get paid until the appeal is resolved. This is critical because if you win your appeal, they'll pay all those weeks retroactively, but only if you certified for them.

Thank you so much for this detailed explanation! I'll submit my appeal today. How long does the appeal process typically take? And should I keep doing my work search activities during this time?

To answer your follow-up questions: appeals can take anywhere from 3-8 weeks to be scheduled for a hearing. And yes, absolutely continue your work search activities and document everything. The Administrative Law Judge will likely ask about your job search efforts during the hearing. One thing I should mention - the EDD technically sends RESEA notifications through multiple channels (UI Online inbox, email, and sometimes mail), so they may argue you should have seen at least one of these. Be prepared to explain why you missed all notifications. Your best argument is good faith - that you've been complying with all requirements and would have attended had you known about it.

That's really helpful info. You're right, they did send it by mail too but I moved a month ago and forgot to update my address with EDD (totally my fault). I'm going to be completely honest in my appeal and hope they understand it was an honest mistake.

Have you tried calling? I know the phone lines are terrible, but I had a similar issue (missed eligibility interview) and I was able to get it straightened out by phone faster than the appeal process. Good luck!

I tried calling about 50 times today but kept getting the "we're experiencing high call volume" message and then it hangs up. So frustrating!

If you're having trouble getting through to EDD on the phone, I'd recommend trying Claimyr. I was in a similar situation (missed interview, benefits stopped) and couldn't get through after days of calling. Claimyr got me connected to an EDD rep in about 20 minutes. Saved me weeks of waiting for an appeal hearing. Their service basically calls EDD for you and then connects you when they get through to a representative. You can check out how it works here: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km Their website is claimyr.com if you want to look into it. Definitely less stressful than calling hundreds of times.

Is this legit?? I've never heard of this before but omg I need this in my life. The EDD phone system is LITERAL TORTURE.

Yes, it's legitimate. I was skeptical at first too but it worked for me. Just make sure you're prepared with your claim information when they connect you to EDD.

Just to add to what others have said, RESEA is one of those programs that EDD takes very seriously because it's federally mandated. While they might be understanding about a missed appointment if you call and explain, they're required to disqualify you initially when you miss it. The appeal should work if it was truly a mistake and you've been complying with other requirements. My advice: 1) File the appeal online today 2) Try to reach someone by phone to see if they can expedite things 3) Keep certifying every two weeks 4) Update your contact info in UI Online right away to avoid future issues

This is all so helpful. I've filed my appeal online, updated my contact info, and I'm going to try the phone option tomorrow morning. I'll update this thread once I know more in case it helps someone else in the future.

anyone know if you have to do these RESEA things if you get a part time job? i got one but still get some benefits and im scared of getting cut off

Yes, you still need to attend RESEA appointments even if you're partially employed. As long as you're receiving any UI benefits, you're subject to all the same requirements including RESEA attendance, work search, and certifications. Make sure to report your part-time income when you certify.

UPDATE: I was able to get through to EDD this morning! The rep said that since it was my first missed appointment, they can actually reschedule it rather than making me go through the whole appeal process. I have a new RESEA appointment next Tuesday, and she said my benefits should resume after I attend that appointment. What a relief! Thanks everyone for your help and advice.

That's great news! Thanks for updating us. This is actually a good reminder that sometimes the fastest solution is getting through to a live person who can help, rather than waiting for the formal appeal process. Make sure you attend the new appointment and keep all documentation just in case.
