Finally won misconduct appeal - how long for ESD backpay to arrive?

After fighting ESD for what felt like forever (8 months!) and going through 2 appeals, I FINALLY got approved for my backpay! They originally denied me claiming 'misconduct' at my manufacturing job, which was complete BS. I was able to prove with documentation and witness statements that I was actually following safety protocols when they claimed I wasn't. The relief is huge, but now I'm wondering - does anyone know how long it typically takes for ESD to actually release backpay after a successful appeal? My online account shows 'payment pending' but no actual date. I'm owed around $12,800 and really need it after burning through my savings during this fight.

Congrats on winning! thats awesome

Thanks! Still feels unreal after all this time fighting them.

In my experience, ESD usually processes backpay within 7-10 business days after a successful appeal decision. Since your claim involves misconduct reversal, they might need to manually review the weeks you're eligible for, which could add a few days. Check your eServices account daily - it should update to show a payment issue date before the money actually hits your bank account or debit card. If you don't see any movement after 2 weeks, that's when I'd start getting concerned.

That's super helpful, thank you! I'll keep an eye on my account. Really hoping it doesn't take the full 2 weeks but at least now I have a timeframe to expect.

I won my appeal in february but had to wait almost a MONTH before i got my money!!! The esd website kept saying "processing" and then one day it just showed up. Make sure they have ur correct direct deposit info. And congrats on winning! misconduct cases are hard to win.

a MONTH??? thats insane, they already make us wait so long for the appeal process and then they make us wait AGAIN for money we shouldve had all along

This happened to me last year, took exactly 13 days from decision to money in my account. When I got nervous after a week, I tried calling but couldn't get through to anyone. If your backpay is still not there after 2 weeks I recommend trying Claimyr (claimyr.com) to get through to an actual ESD person. They have a video showing how it works at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. It got me connected to an agent who could actually see my payment status in their system and give me the exact date it would arrive. Worth it for the peace of mind especially with such a large backpay amount.

I've never heard of Claimyr before. Does it actually work? The ESD phone system has been absolute hell to deal with during this whole process.

Yeah it definitely worked for me. Basically skips the hold time nightmare. I was skeptical too but got through to an actual person in about 20 minutes instead of spending days redialing.

Anyone saying they know exactly how long it'll take is LYING. ESD is completely inconsistent. I know someone who got their backpay in 3 days after winning their appeal and I know someone else who had to wait SIX WEEKS!!!! It depends what adjudicator gets assigned to process your payment and how backed up the system is. The whole system is designed to make people give up. They hope you'll just go away after they wrongfully deny you. KEEP CALLING THEM EVERY DAY until you get your money!!!

While I understand your frustration, calling every day actually isn't the best approach. ESD tracks call frequency and it doesn't prioritize your case - it just ties up the phone lines. It's better to call once a week if no movement, or use the secure message system through your eServices account. The payment processing timeframe I mentioned (7-10 business days) is the current average based on recent cases, but you're right that there can be variations.

Congratulations on your successful appeal! For backpay after misconduct reversals specifically, the timeframe is typically 5-15 business days. Here's why the variation exists: 1. Your backpay amount ($12,800) is significant, which means it may require additional verification before release 2. The payment system runs nightly batches, so which day your payment gets included matters 3. Once scheduled for payment, direct deposit takes 2-3 business days, debit cards 3-5 days One important thing to check: make sure your eServices account shows all the eligible weeks correctly. Sometimes after appeals, they miss including certain weeks in the backpay calculation. Review each week's status to confirm they all show as payable. If you don't see movement within 10 business days, you should contact ESD directly as there might be another verification step needed on your claim.

Thank you for that detailed breakdown! I checked my weeks and they all show as payable now, which is a big relief. I have direct deposit set up so hopefully that speeds things up a bit. The whole experience has been so stressful - being accused of misconduct when I was actually following the rules, then having to fight through two appeals while my finances fell apart. Just ready for this chapter to be over.

I got a decision letter through both mail and my eServices message center. The online one came first (about 3 days before the physical mail). Then a few days later my account status updated to show all the weeks changing from "denied" to "payable" - that's when the "payment pending" message appeared.

my cousin had this happen and she said they sent all her backpay on a prepaid card even tho she had direct deposit set up for her regular payments... might want to watch your mail for that too just in case

Oh wow, really? That's good to know. I'll keep an eye on the mail too then. The last thing I need is to miss a card with that much money on it!

Just to follow up on this thread - any update on your payment? Did it arrive within the timeframe most of us suggested?

Yes! The money hit my account this morning - exactly 9 business days after the appeal decision. Thanks everyone for your help and advice through this. Such a relief to finally have this resolved after 8 months of fighting.
