Does being terminated affect unemployment benefits in Washington ESD?
I was terminated from my job last week and I'm wondering if this will prevent me from getting unemployment benefits through Washington ESD. My manager said it was due to 'performance issues' but I feel like it was really because I had to take time off for a family emergency. I've never filed for unemployment before and I'm not sure how termination vs quitting affects your eligibility. Can someone explain how this works with Washington ESD? I'm really stressed about this because I need the income while I look for another job.

Being terminated doesn't automatically disqualify you from Washington ESD unemployment benefits. The key factor is whether the termination was for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful or deliberate. You should definitely file your claim - Washington ESD will investigate and make a determination.

•Thank you! That's a relief. Should I mention the family emergency situation when I file?

•Yes, definitely include all relevant details about your situation when you file. Washington ESD needs the full picture to make an accurate determination.

I was terminated for attendance issues last year and still got approved for Washington ESD benefits. The key is being honest about everything when you file your claim. They'll contact your employer to get their side of the story too.

•How long did it take for them to make a decision on your claim?

•It took about 3 weeks for my adjudication to complete. During that time I couldn't get through to anyone at Washington ESD to check on the status.

•Same here - couldn't reach anyone at Washington ESD for weeks! I actually found a service called Claimyr that helped me get through to an agent. They have this system where they call Washington ESD for you and then conference you in when they reach someone. Check out claimyr.com - there's even a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

What exactly counts as 'misconduct' for Washington ESD purposes? I'm worried my situation might fall into that category even though I don't think I did anything wrong.

•Misconduct for Washington ESD usually means willful violation of company rules, insubordination, theft, or other deliberate acts. Poor performance or honest mistakes typically don't qualify as misconduct.

•I was terminated for being late too many times due to childcare issues and Washington ESD still approved my benefits. They understood it wasn't willful misconduct.

File immediately! Don't wait. Even if Washington ESD denies your initial claim you can appeal the decision. I've seen people win appeals even after being terminated for cause.

•Good point about filing right away. I was worried about filing if I might get denied anyway.

•The worst thing you can do is not file at all. At least if you file you have a chance, and Washington ESD backpays from your application date if you're approved.

Make sure you document everything about your termination - emails, performance reviews, any communication about the family emergency. This will help if Washington ESD needs to investigate or if you need to appeal.

•I do have emails about requesting the time off. Should I submit those with my application?

•Keep them ready in case Washington ESD asks for additional documentation during the adjudication process. They don't typically ask for documents upfront unless it's a complex case.

The Washington ESD system is so frustrating when you're trying to get answers about your claim status. I was terminated and had to wait 5 weeks to find out I was approved. Couldn't reach anyone by phone the entire time.

•That's exactly why I started using Claimyr! They handle all the calling and waiting on hold for you. Worth every penny when you're stressed about your claim status and can't get through to Washington ESD yourself.

•I wish I had known about that service during my adjudication period. Would have saved me so much anxiety.

Does Washington ESD notify your employer when you file for unemployment after being terminated?

Brandon Parker
•Yes, Washington ESD sends a notice to your employer giving them a chance to respond and provide their side of the story about your termination.

•My employer tried to fight my claim saying I was terminated for cause but Washington ESD still approved me after reviewing all the evidence.

I'm going through this exact situation right now! Filed 2 weeks ago after being terminated and my claim is still pending adjudication. The waiting is killing me.

•How has the process been so far? Any issues with filing?

•Filing was straightforward but I haven't been able to get any updates on my claim status. The Washington ESD website just says 'under review'.

•If you need to talk to someone at Washington ESD about your claim status, try Claimyr. They specialize in getting through to agents when you can't reach them yourself. Saved me weeks of stress during my adjudication.

Be prepared for your employer to potentially contest your claim. They might try to argue it was misconduct to avoid their unemployment insurance rates going up.

Chloe Zhang
•What happens if they contest it? Does that automatically mean I get denied?

Ellie Kim
•No, Washington ESD will investigate both sides and make an independent determination. Employer contests are common but don't always result in denials.

Remember that if you do get approved for Washington ESD benefits, you'll need to actively search for work and report your job search activities weekly. Don't forget about that requirement!

Don't let being terminated discourage you from filing. I know several people who were terminated and still received Washington ESD benefits. The system is designed to help people who lose their jobs through no fault of their own.

If Washington ESD does deny your claim initially, don't give up. The appeals process exists for a reason and many people win on appeal even after being denied at first.

•You have 30 days from the date of the determination letter to file an appeal with Washington ESD.

The whole adjudication process with Washington ESD is nerve-wracking when you're already stressed about losing your job. Just try to be patient and keep filing your weekly claims even while it's pending.

•Should I file weekly claims even before my initial claim is approved?

Miguel Harvey
•Yes! You need to file weekly claims to establish your continued eligibility. If you're approved, you'll get backpay for those weeks.

Make sure you understand the difference between being terminated and being laid off when you file with Washington ESD. Termination for cause is different from termination due to lack of work.

Chloe Zhang
•Mine was definitely termination, not a layoff. They said it was performance-related.
0 coins
Ashley Simian
•That's fine - performance issues usually don't disqualify you unless there was willful misconduct involved.

I was terminated from my last job and Washington ESD approved my benefits without any issues. The key is being upfront about everything and not trying to hide details about your termination.

•Honesty is definitely the best policy with Washington ESD. They'll find out the truth anyway when they contact your employer.
