Can you get maternity leave and unemployment benefits in Washington?

I'm 7 months pregnant and trying to figure out my options for when the baby comes. My employer offers some maternity leave but it's unpaid after the first 2 weeks. I've been working full-time for 3 years and paying into unemployment. Can I collect Washington ESD unemployment benefits while on maternity leave, or do I need to choose between the two? I'm really confused about how this all works together.

You can't collect regular unemployment while on maternity leave because you have to be able and available for work to qualify for UI benefits. However, Washington has Paid Family and Medical Leave (PFML) which is separate from unemployment and designed exactly for situations like yours.

Oh I didn't know about PFML! Is that through Washington ESD too or a different agency?

0 coins

PFML is administered by ESD but it's a completely different program. You apply through their website and it pays up to 12 weeks for bonding with a new baby.

0 coins

definitely look into PFML instead of unemployment. I used it when my daughter was born last year and it was a lifesaver. You get about 90% of your wages up to the cap

0 coins

That sounds amazing! Did you have any issues with the application process?

0 coins

It was pretty straightforward but I had trouble getting through to ESD when I had questions. Ended up using claimyr.com to actually reach someone - they have a phone service that gets you through to agents. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

Important distinction here - unemployment requires you to be actively seeking work and available for work immediately. Maternity leave means you're not available for work, so you wouldn't qualify for regular UI benefits. PFML is specifically designed for family leave situations and doesn't have the work search requirement.

0 coins

This is exactly right. A lot of people get confused about this but they're totally different programs with different eligibility rules.

0 coins

That makes sense. I was thinking unemployment was just for when you're not working, but the work search requirement changes everything.

0 coins

Wait, I thought you could get unemployment after maternity leave ends if you don't go back to work? Like if you decide to stay home with the baby?

0 coins

That's a different situation. If you voluntarily quit your job after maternity leave to stay home, you typically wouldn't qualify for unemployment because you quit voluntarily. But if your employer eliminates your position while you're on leave, that could be different.

0 coins

Oh wow, I didn't realize voluntary quitting disqualified you. Good to know!

Been through this twice now. PFML is definitely the way to go for maternity leave. You need to apply 30 days before your leave starts and there's a waiting period. Don't wait until the last minute like I did with my first kid.

0 coins

30 days before? I better get on this soon then. Do you know if there are any other requirements?

0 coins

You need to have worked enough hours and earned enough wages in the past year, similar to unemployment requirements. Check the ESD website for the exact numbers.

0 coins

this is so confusing... why do they make it so complicated? can't they just have one program that covers everything?

0 coins

I know it seems complicated but they serve different purposes. Unemployment is for people who lose their jobs through no fault of their own, while PFML is for people who need time off for family or medical reasons but plan to return to work.

0 coins

One thing to keep in mind - if you're planning to return to work after maternity leave, make sure you understand your employer's policies. Some employers require you to use any available paid leave before PFML kicks in.

0 coins

I'll need to check with HR about that. I think we have to use our sick leave first.

0 coins

Exactly. And if you have any issues with your employer during this process, document everything. Sometimes employers don't understand PFML requirements either.

0 coins

Also worth mentioning - if something goes wrong with your PFML claim or you need to talk to ESD about it, their phone lines are brutal. I spent weeks trying to get through when I had an issue.

0 coins

That's exactly why I mentioned Claimyr earlier. They specialize in getting people through to ESD agents when the regular lines are jammed.

0 coins

Wish I had known about that service when I was dealing with my claim issues!

0 coins

The system is definitely confusing but here's the bottom line - you cannot collect unemployment while on maternity leave because you're not available for work. PFML is your option for income during maternity leave.

0 coins

Thank you, that's really clear. I'm going to start the PFML application process this week.

0 coins

Just went through this myself. One more tip - keep copies of all your paperwork and submit everything early. The ESD processes a lot of these claims and sometimes things get delayed.

0 coins

Good advice. I'm definitely going to be super organized about this.

0 coins

Smart move. And congratulations on your upcoming arrival!

0 coins

wait what if your employer doesn't hold your job while you're on PFML? can you get unemployment then?

0 coins

If your employer illegally terminates you while you're on protected PFML leave, that could potentially qualify you for unemployment benefits since it wouldn't be a voluntary quit. But that's a complex situation that might require legal advice.

0 coins

That's scary to think about. I hope most employers follow the law on this stuff.

0 coins

Another thing to consider - PFML has a weekly benefit cap, so if you make really good money, you might not get your full salary replaced. It's still way better than nothing though.

0 coins

Do you know what the cap is for 2025?

0 coins

I think it's around $1,500 per week but you should check the ESD website for the current numbers since they adjust it annually.

0 coins

I'm a little worried about applying for PFML because I've heard horror stories about ESD messing up claims. Has anyone had problems with their PFML applications?

0 coins

My applications went through fine both times, but I was very careful to submit everything correctly and on time. The key is following their instructions exactly.

0 coins

If you do run into issues, don't hesitate to use a service like Claimyr to get through to someone who can help. It's worth it for peace of mind when you're dealing with something this important.

0 coins

Does anyone know if you can work part-time while on PFML? Like if I wanted to do some freelance work from home?

0 coins

You can work part-time while on PFML but you need to report any earnings and it may reduce your benefit amount. There are specific rules about how much you can earn before it affects your benefits.

0 coins

Thanks, I'll look into those rules. Good to know it's possible though.

This thread has been so helpful! I'm bookmarking it for when I need to apply for PFML next year.

0 coins

Same here! So glad I asked this question because I was totally confused about the difference between unemployment and PFML.

0 coins

One last thing - if you're planning to take the full 12 weeks, make sure you budget for the waiting period at the beginning. I think there's a 1-week waiting period before benefits start.

0 coins

Good point. I'll need to make sure I have some savings to cover that first week.

0 coins

Exactly. And if you have any paid leave from your employer, you might want to use that for the waiting period.

0 coins

has anyone used both PFML and unemployment at different times? like PFML for maternity leave and then unemployment later if you lose your job?

0 coins

Yes, you can use both programs but at different times for different reasons. They're both insurance programs you pay into while working, so you're entitled to benefits from both if you meet the eligibility requirements.

0 coins

This is all really good information. I think the key takeaway is that unemployment and PFML serve different purposes and you can't use them at the same time.

0 coins

Exactly! I feel much more confident about my options now. Thanks everyone for all the helpful advice!

0 coins

Glad this got sorted out! PFML is definitely the right choice for maternity leave. Just make sure you apply on time and keep good records of everything.

0 coins

Will do! I'm going to start gathering all my paperwork this weekend.
