Will filing a TWC appeal stop my current unemployment payments?
I'm freaking out right now. I was expecting my TWC payment to hit my account today like usual, but when I checked my claim status it says I'm ineligible now! This makes no sense because I've been getting benefits for the past 5 weeks without any problems. I filed an appeal yesterday about a separate issue (they miscalculated my base period wages from my second job). Could filing that appeal have automatically stopped my payments? The determination letter didn't say anything about stopping current payments while the appeal is processed. Has anyone experienced this? Will I still get paid during the appeal process or am I just out of luck until they review my case? I've got rent due next week and really counted on this money.

Filing an appeal by itself shouldn't automatically stop your payments. However, the reason you're now showing as ineligible could be related to whatever issue you're appealing. What exactly does your payment status say online? Does it say 'ineligible' or 'pending'? There's a big difference. Also, check if you have any new correspondence in your inbox - TWC often sends determination letters explaining why your benefits changed.

•It definitely says 'ineligible' not pending. I just checked my correspondence and there IS a new letter from yesterday I hadn't seen! It says something about 'earnings exceed WBA' but I haven't worked or reported any earnings. I'm so confused. Do I need to file another appeal for this new issue?

This happened to me last month!!! The EXACT same thing where I filed an appeal about my wages and then suddenly my payments stopped. I called TWC for THREE DAYS straight and couldn't get through to anyone. The website is so useless it just kept saying I was ineligible with no explanation. The system is COMPLETELY BROKEN and they don't care that people have bills to pay. I ended up having to borrow money from family because it took them 4 weeks to fix the mistake. Good luck even getting someone on the phone to explain what's happening!!!

•That's terrible! I don't even have family I can borrow from. Did you eventually get back pay for the weeks you missed? Did you have to do anything special to get it fixed?

To directly answer your question: Filing an appeal does NOT automatically stop payments for the issue you're appealing. However, it sounds like you may have two separate issues happening at once: 1. Your appeal about base period wages calculation 2. A new determination about your Weekly Benefit Amount (WBA) being exceeded by earnings That "earnings exceed WBA" message usually happens when TWC believes you earned more money than your weekly benefit amount allows. This could be from a former employer reporting wages, a clerical error, or sometimes even confusion between different claims in the system. You need to file a separate appeal for this new issue within 14 calendar days of the determination letter date. Make sure to continue requesting payment every two weeks even while appealing - this protects your right to backpay if you win the appeal.

•this 👆 is exactly right, happened to me too. you got 14 days to appeal the new thing. keep doing payment requests even when its saying ineligible

Did u check ur work search requirements? Sometimes they mark u ineligible if u didn't report enough job contacts or if they did a random work search audit and u didnt respond. Double check that part of ur account.

•I've been doing my 3 work searches every week and logging them in the system. I double-checked and all my work search info is there. The letter specifically mentions earnings, but I haven't worked at all since filing my claim.

I had something similar happen and it turned out my former employer contested my claim by saying I was still working part-time (I wasn't). Took forever to resolve because I couldn't get through to TWC on the phone. After trying for days and just getting busy signals or disconnects, I used a service called Claimyr (claimyr.com) that got me connected to a TWC agent in about 20 minutes. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh When I finally got through, the TWC agent explained that my employer had reported hours for me from BEFORE I was laid off, but the system counted them as current work. They fixed it on the call and my payments resumed the next week (plus backpay). Definitely worth talking to an actual person about this kind of issue instead of trying to figure it out from the website.

•Does this service actually work? I tried calling TWC literally 57 times in one day and never got through.

•It worked for me twice. First time took about 25 mins to get through, second time was quicker. Better than spending days trying to call them myself.

•That's terrifying. I can't go 2 months with no income. I'm going to try calling first thing tomorrow morning.

Based on what you're describing, this sounds like a wage reporting error. When you said "earnings exceed WBA" that's a very specific determination. It means TWC believes you earned more at a job than your weekly benefit amount allows. Here's what to do: 1. File an appeal for this NEW issue right away (separate from your existing appeal) 2. In the appeal, clearly state you have not worked or earned any wages during the claim period in question 3. Try calling the TWC Tele-Serv system at 800-558-8321 to see if there's more information about the specific earnings they think you received 4. Contact your previous employer to make sure they haven't accidentally reported you as still working 5. Keep requesting payments every two weeks even if it says you're ineligible - this preserves your claim If you win your appeal, you'll receive back payments for any weeks you were eligible. The key is to appeal within the 14-day window.

•Thank you SO much for this detailed information. I'm going to start working on the new appeal right now and try calling Tele-Serv. One quick question - should I mention my other pending appeal in this new appeal or keep them completely separate?

•Keep them completely separate. Each appeal needs to focus on the specific determination letter it's addressing. Mixing the issues could confuse the process. Just make sure to include the determination ID number from the letter in your new appeal.

UPDATE: I finally got through to TWC this morning! Turns out my previous employer reported wages for me for last week (even though I haven't worked there since January). The agent said this happens sometimes when employers batch-report or make clerical errors. She put in a request to have the wages removed from my record, and said my payments should resume once that's processed. I also went ahead and filed the appeal just in case it takes them too long to fix it. Thanks everyone for your help!

•This is exactly what I suspected! Good job getting it resolved. One tip: document everything. Write down the date/time of your call, the agent's name if they provided it, and what they told you. This documentation can be helpful if you need to reference this conversation in the future.
