TWC rep was rude during separation verification call - will this affect my claim?

Just had the most infuriating call from TWC about my unemployment claim. The representative called to verify my reason for separation from my last job, and she was EXTREMELY rude! She kept interrupting me, making sarcastic comments, and clearly seemed like she was taking my former employer's side. I explained that I was let go because they eliminated my position (after 3 years of good performance reviews), but she kept pressing me like I was lying or something. When I tried to elaborate, she cut me off and said 'that's not what your employer is stating.' Now I'm freaking out that she's going to deny my claim because she didn't like me or something. Has anyone experienced this kind of treatment during a fact-finding interview? Should I be worried? Do I need to contact TWC again with additional documentation? This is my first time filing for unemployment and I genuinely need these benefits while I search for a new job.

Did your claim end up getting approved though? That's what I'm worried about. I don't want to be denied just because this rep had a bad attitude.

Those fact-finding interviews can be stressful, but try not to read too much into the representative's tone. They're trained to be skeptical and push back on statements to ensure accuracy. What matters is the documentation and facts of your case, not how the interviewer made you feel. A few important points: 1. The interviewer doesn't make the final determination - they just collect information 2. If your position was eliminated and you have proof (layoff notice, email, etc), make sure TWC has copies 3. If you do receive a denial, you have 14 calendar days to appeal I'd suggest sending any supporting documentation through your TWC online portal with a brief explanation, just to have it on record.

Thank you for explaining this! I do have an email from HR confirming my position was eliminated due to departmental restructuring. I'll upload it to the portal right away. It's just so nerve-wracking when they treat you like you're lying.

They're all on a power trip honestly. The whole system is designed to intimidate people out of claiming benefits they DESERVE. My interviewer last year actually yawned while I was explaining my situation! Just ridiculous.

While some representatives could certainly improve their customer service skills, it's important to remember they're processing hundreds of claims each week. The system isn't designed to deny valid claims - in fact, most claims where the separation was due to position elimination are approved without issue. The key is making sure all your documentation is submitted and the facts are clear.

Don't panic yet. I work in HR and can tell you that position elimination is one of the clearest cases for unemployment approval. The interviewer might have been having a bad day or might just have a poor communication style, but the final decision is based on facts, not attitude. Make sure you've uploaded: - Any termination or layoff documentation - The email confirming position elimination you mentioned - Your recent performance reviews showing good standing If you do get denied (which I doubt based on what you've shared), the appeal process is straightforward and often successful for position eliminations.

Have you tried calling TWC to follow up? I spent 3 weeks trying to get through their phone lines with no luck after a similar situation. Finally used Claimyr (claimyr.com) and got connected to a TWC agent in about 20 minutes. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh The agent I spoke with was actually really helpful and could see notes from my previous call. She explained that the interviewer's notes were just factual and didn't contain any negative recommendations. Might be worth checking if you're anxious about it.

I hadn't heard of this service before. I've been trying to call back for two days with no luck. I'll check this out - anything to get some peace of mind right now.

I wanna add somthing important - sometimes they act tough on purpose to see if ur story changes. my neighbor works for the workforce commission and says they do this as like a tactic. if ur telling the truth just stick to it and dont change ur story even if they sound like they dont believe you.

This is exactly right. Had a similar experience where the rep was practically accusing me of quitting when I was actually laid off. Stuck to my story, got approved a week later. They're testing you.

One thing to keep in mind is that the TWC representative has to follow a script and ask certain questions for legal reasons. Their demeanor shouldn't affect the outcome if your case is legitimate. For position elimination cases, the TWC is primarily checking: 1. That you were indeed laid off and didn't quit 2. That there was no misconduct involved 3. That you're available and actively searching for work Since you mentioned you have documentation confirming the elimination of your position, you're in a strong position. The determination is typically made within 7-10 business days after the fact-finding interview. If you haven't received a determination letter by then, you can check your claim status online or try contacting them again.

Thank you for the reassurance. I uploaded my documentation and have been keeping detailed records of my work search activities. It's been 5 business days since the interview, so hopefully I'll hear something soon.
