Had my TWC appeal hearing today - employer no-show but can still appeal? How soon will system update?

Just had my first TWC appeal hearing this morning after waiting since OCTOBER (almost 5 months!!). The employer didn't even bother to show up, but the hearing officer told me they could still appeal whatever decision gets made? How is that fair?! I've been struggling financially this whole time while they just ignore the process and then get another chance? The officer said I'd get a determination letter in the mail, but does anyone know how quickly the TWC online portal updates after these hearings? I'm checking my account obsessively and nothing has changed yet. Will it update before I get the physical letter or should I just keep watching my mailbox? This waiting game is driving me crazy, especially since I've already been waiting since October!

The TWC system typically updates within 5-7 business days after your hearing. However, the actual determination letter might arrive in your mailbox before the online status changes - it's weird how their system works sometimes. And yes, unfortunately, the employer has 14 days to appeal the decision even if they didn't attend the original hearing. The good news is that their no-show generally works in your favor since they didn't present any evidence against your claim.

Thanks for this info! 5-7 more days of waiting feels like torture after all this time. Do you know if there's any way to check if they file another appeal? Or will I just get surprised with another hearing notice?

UGH the TWC appeal system is such a JOKE!!! My employer didn't show up either and I thought I was in the clear, then they appealed at the last possible day and I had to go through the whole process AGAIN. The system is totally rigged against us regular folks. I had to wait almost THREE WEEKS for my portal to update after my hearing. Meanwhile bills piling up and no income!!

same happend to me. employer no showed then filed appeal on day 13 smh

When my appeal happened last month, my online account was updated exactly 6 days after the hearing. But I've heard it can take anywhere from 3 days to 2 weeks depending on how backed up they are. Have you tried calling to check the status? I know getting through to TWC is practically impossible these days.

I tried calling but just got the busy signal over and over. Gave up after about 20 attempts. The automated system doesn't have any info either when I check by phone.

I went thru 2 appeals with TWC last year & just wanted to say hang in there! For what its worth my employer didnt show up either time & the judge ruled in my favor both times. They didnt file a 2nd appeal after losing the first one. Most companies dont bother with the 2nd appeal unless they have really strong evidence. Fingers crossed for u!

That makes me feel better, thank you! Did you get back pay for all the weeks you were waiting during the appeal process?

Yep got backpay for everything! Took about 10 days after decision letter for the money to hit my account. Felt like christmas morning lol

If you need to get through to TWC to check on your appeal status, I'd recommend trying Claimyr (claimyr.com). They helped me get through to an actual agent within 30 minutes after I'd been trying for days on my own. They have a video demo of how it works at https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh. It was worth it to get an update on my appeal rather than anxiously checking my mailbox every day for weeks. The agent was able to tell me exactly where my case stood and when to expect the determination.

It worked for me and saved me a ton of frustration. My neighbor used it too when she was having ID.me verification issues. Way better than hitting redial all day!

Just to add a bit more detail since I went through this recently - the online portal usually updates with a "Decision mailed on [date]" status first. Then a few days later it might show "Appeal: Claimant Eligible" or something similar. The actual payment release usually happens 2-3 days after that. So there are several stages to watch for in the portal.

This is super helpful - gives me specific things to look for in my account! Thanks for breaking down the stages.

my appeal took 4ever but i won. best advice is keep requesting payments every 2 weeks even while u wait. if u win they pay everything at once

I've been doing my payment requests religiously every two weeks even though they've all been denied pending the appeal decision. Hopefully it pays off (literally)!

One more thing to be aware of - even after you win the appeal and the determination is in your favor, it can take 10-14 business days for the payment to be processed. They have to manually review and release the back payments. If it goes longer than two weeks after you receive the favorable determination letter, that's when you should start calling to follow up.

Thank you for this additional info. This whole process takes so much longer than they lead you to believe!

MY THEORY is they deliberately make everything confusing and slow hoping people will just give up. I had to appeal THREE TIMES because of TWC's own errors! They kept saying my employer filed an appeal when they NEVER DID - it was a system glitch! Finally got someone on the phone who fixed it after MONTHS of waiting. The whole system needs an overhaul!!

omg that's horrible! glad u finally got it fixed tho. sometimes i think half their computer systems are from the 1990s lol

I'm going through a similar situation right now - had my appeal hearing last week and also dealing with the anxiety of waiting for updates! From what I've learned lurking in this community, it sounds like you're in a pretty good position since your employer was a no-show. That usually means they don't have much evidence to present against your claim. The fact that you've been diligently doing your payment requests every two weeks during this whole ordeal should work in your favor too when the backpay gets processed. I know the waiting is brutal (especially after 5 months already!) but it sounds like you handled the hearing well and did everything right. Fingers crossed your portal updates soon with good news!

Thank you so much for the encouragement! It really helps to hear from someone going through the same thing right now. You're right about staying on top of the payment requests - I'm glad I kept doing them even when it felt pointless. How long has it been since your hearing? Are you seeing any updates in your portal yet? This whole experience has been such a roller coaster of emotions, but at least we're not going through it alone with communities like this one!

I can totally relate to the anxiety of waiting for updates after an appeal hearing! I went through this same process about 6 months ago and the uncertainty is absolutely maddening. In my case, the online portal updated exactly 8 days after my hearing with a "Decision Mailed" status, then showed the actual decision about 3 days later. The physical letter arrived the same day the decision showed up online. Since your employer was a no-show, that's actually a really positive sign - they basically forfeited their chance to present evidence against you. Just keep checking that portal daily (I know, easier said than done!) and make sure you continue filing your weekly payment requests. The backpay when it finally comes through will include everything from when you first filed. Hang in there - you've made it this far through an incredibly frustrating process!

This is really reassuring to hear from someone who's been through the exact same situation! 8 days for the portal update sounds about right based on what others have shared here. I'm definitely going to keep obsessively checking (can't help myself at this point lol) but at least now I have a realistic timeline to expect. The fact that you got your backpay for everything gives me so much hope - I've been scraping by for months now and that lump sum is going to be life-changing. Thanks for taking the time to share your experience, it really means a lot to know there's light at the end of this tunnel!

I'm in a very similar boat right now - had my TWC appeal hearing two weeks ago after waiting since November, and my employer also didn't show up! The hearing officer explained the same thing about them still being able to appeal within 14 days, which honestly feels so unfair when they couldn't even be bothered to participate in the first hearing. I've been checking my portal multiple times a day and it's driving me absolutely nuts! Based on what I'm reading here, it sounds like 5-7 business days is pretty typical for updates, so you should hopefully see something soon. The waiting game after already waiting 5 months is pure torture, but at least their no-show works in your favor since they didn't present any counter-evidence. Keep doing those payment requests every two weeks - from what everyone's saying, that backpay is going to be so worth it when it finally comes through!

Wow, November to now is such a long wait too! It's frustrating how similar our situations are - the no-show employers who still get to appeal just feels like the system is designed to drag this out as long as possible. Two weeks since your hearing means you should be getting an update any day now based on everyone's timeline here. I'm only a few days out from mine so I'm going to try to be patient (yeah right lol). At least we can commiserate together while we wait for these updates! Definitely going to keep doing those payment requests religiously.

I just went through this exact scenario last month! My employer was also a no-show at the hearing after I waited 4+ months for the appeal. The good news is that their absence typically works strongly in your favor since they forfeit their chance to present counter-evidence. In my case, the TWC portal updated with "Decision Mailed" status exactly 6 days after the hearing, and I received the favorable determination letter 2 days later. The backpay hit my account about a week after that - it was such a relief after months of financial stress! Even though they technically have 14 days to file another appeal, most employers who can't be bothered to show up the first time rarely follow through with a second appeal unless they have really compelling evidence. Keep checking that portal obsessively (I totally get it!) and definitely continue your weekly payment requests. You've already made it through the hardest part - hang in there!

This gives me so much hope! The timeline you described (6 days for portal update, then letter 2 days later, then payment a week after that) is exactly what I needed to hear. It's reassuring that most no-show employers don't bother with a second appeal - makes sense since they clearly didn't care enough to show up the first time. I'm definitely going to keep obsessively checking my portal and doing those payment requests. After 5 months of this stress, knowing there's an actual end in sight with real timelines from someone who just went through it is incredibly helpful. Thanks for sharing your experience!

I'm in almost the exact same situation as you right now! Had my TWC appeal hearing yesterday after waiting since late October, and my employer also didn't show up. The hearing officer told me the same thing about them still being able to appeal within 14 days, which just seems so backwards when they couldn't even be bothered to participate in the first hearing. I've already checked my portal like 10 times today even though I know it's too early for any updates lol. Reading through all these responses is actually really comforting though - sounds like most no-show employers don't follow through with a second appeal, and the 5-7 day timeline for portal updates seems pretty consistent. I've been doing my payment requests religiously every two weeks this whole time, so hopefully that backpay will be worth all this waiting and stress! This whole process has been such an emotional rollercoaster but at least we're not alone in dealing with TWC's broken system.

It's crazy how many of us are going through almost identical situations with TWC right now! Yesterday's hearing means you're just one day behind me, so we'll probably be getting updates around the same time. I'm trying not to refresh my portal every hour but it's so hard when you've been waiting this long already. The fact that so many people here have had positive outcomes with no-show employers really gives me hope that we're both going to come out of this okay. Keep me posted on when your portal updates - it'll be interesting to see if we follow similar timelines!

Just wanted to add my experience to help with your timeline expectations! I had my TWC appeal hearing about 3 months ago (also a no-show employer situation) and my portal updated exactly 5 business days later with the "Decision Mailed" status. Got the actual determination letter 3 days after that, and it was favorable! The backpay took another 8 days to hit my account after receiving the letter. What really helped my sanity during the waiting period was setting specific times to check the portal (like once in the morning and once at night) instead of refreshing it constantly throughout the day. Your employer not showing up is actually a huge advantage since they basically forfeited their chance to present any evidence against you. Most employers who can't be bothered to attend the first hearing don't follow through with appeals either. You've already survived the hardest part - just a few more days of waiting and you should start seeing some movement in your account!
