New York Unemployment: Do I file weekly claim when receiving severance pay?

My spouse got their first unemployment payment yesterday. Today they got their severance check. Not sure if they should file their weekly claim since they got the severance. The weekly questions don't mention anything about severance payments. Need help figuring this out.

You definitely need to report the severance. Even if it doesnt ask directly, you have to report it as income for that week. If you dont, they might hit you with an overpayment later and thats a whole mess to deal with 😫

when it asks if you earned any income, just put yes and the amount. better safe than sorry!

Hey if you need to talk to someone at unemployment about this, use claimyr.com - they'll wait on hold and get you through to an agent. Costs $20 but worth it instead of calling for hours. Here's a video about how it works: https://youtu.be/Rdqa1gKtxuE

THIS IS IMPORTANT: Severance pay counts as income during the week you receive it. You must report ANY income received, even if its not specifically asked about. The unemployment office will find out eventually and you'll have to repay benefits plus possibly face penalties.

Here's the official guide: When receiving severance, you should still certify weekly but report the severance as income for the week you receive it. After that week, if you receive no other income, continue certifying normally. Remember that severance might affect your initial eligibility period. If you're unsure about anything, best to speak with an agent directly. You can either keep calling the regular number or use claimyr.com to get through faster. Document everything and keep copies of your severance agreement handy.

Just went through this exact situation last week! Yes, you absolutely need to report the severance when you file your weekly claim. Even though the questions don't specifically mention severance, it counts as "earnings" or "income" for that week. When it asks if you worked or earned any money, select yes and enter the severance amount. Your benefits will likely be reduced or stopped for that week depending on the amount, but that's normal and expected. Don't skip filing the claim though - you still need to certify to keep your claim active. Better to report it now than deal with overpayment issues later!
