When to file NY unemployment claim with severance and last work day?

My spouse just got laid off, with their last day set for next week. They're getting severance pay. I'm confused about when to start the unemployment claim. The DOL form asked about hours worked this week, but the week isn't over yet. Plus, they'll be paid through next week even though they won't be working. Anyone know the right time to file? Thanks for any help!

File ASAP! The sooner you submit the claim, the quicker you'll get benefits. Don't wait for the last day or for severance to kick in. NY unemployment has a waiting week anyway, so getting the ball rolling now is your best bet.

Thanks for the quick reply! So it's okay to file even if he's technically still employed until next week?

Yep, totally fine. Just be honest about the last day of work and any severance on the application. The system will sort it out. Better to have it in the queue!

This is solid advice. I waited to file and regretted it. The backlog can be a real pain 😫

Hey guys, I found a method to get someone on the phone at ny unemployment. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Check out this video for more info: https://youtu.be/Rdqa1gKtxuE

Sounds too good to be true. How does it actually work? Is it legit?

It's 100% legit. They use an automated system to navigate the phone tree and wait on hold. When a real person answers, it connects to your phone. Saved me hours of frustration!

Idk man, paying to talk to unemployment? Seems sketchy af šŸ¤”

I get the skepticism, but after spending days trying to get through, $20 was worth it to me. It's not a scam, just a time-saving service.

Ugh, the severance thing always complicates stuff. When I got laid off, I waited until after my severance period to file. BIG MISTAKE. Ended up losing weeks of benefits. Don't be like me, file now!

Here's the deal with NY unemployment and severance: • File your claim immediately after the last day of work • Report any severance pay when you file • Be prepared to provide documentation about the severance • NY will calculate your benefits based on when the severance ends • Keep certifying weekly, even if you're receiving severance Remember, severance doesn't disqualify you from benefits, it just might delay when you start receiving them. And if you need help reaching someone, try claimyr.com. It helped me get through when the lines were jammed. Hope this helps! Good luck with everything!

Wow, thank you so much for this detailed breakdown! This really clarifies things. I'll make sure we file right after the last day and report everything accurately.

This is gold šŸ‘Œ Wish I had this info when I was laid off last year!

Quick tip: screenshot EVERYTHING during the application process. NY unemployment website can be glitchy af and you don't wanna lose all that info if it crashes.

OMG YES! šŸ‘šŸ‘šŸ‘ The site crashed on me twice and I had to start over. Screenshots are a lifesaver!

Anyone else feel like filing for unemployment is harder than actually having a job? The hoops we gotta jump through... 🤔

For real tho! It's like they're testing our endurance or something šŸ˜‚

Seriously! I spent more time trying to file than I did at my last job lmao

Hey OP, don't forget to factor in any accrued vacation time payout. That can affect your claim too. Learned that one the hard way...

Pro tip: Set a reminder on your phone for the weekly certification. Miss one week and you're in for a world of hurt trying to backdate claims. Trust me on this one!

Just went through this exact situation a few months ago! File the claim on your spouse's actual last day of work, not when severance ends. NY DOL will ask about the severance and any other payments - be completely transparent about it all. The system is designed to handle this stuff, so don't stress too much about the timing. Also, keep all your severance paperwork handy because they might ask for it later. The hardest part is just getting started, so don't overthink it! You got this! šŸ’Ŗ

Thanks so much for sharing your experience! It's really reassuring to hear from someone who just went through this. Quick question - did they hold up your benefits at all while you were receiving severance, or did they start right away after the waiting week?
