NY unemployment tax refund still missing after waiting 120+ days

Anyone still waiting on their NY unemployment tax refund? I filed back in April and got a letter in September saying to wait 60 days for processing. It's now been over 120 days total and still nothing. I've tried calling every number I can find but can't get through to anyone. I'm beyond frustrated at this point. This money would really help with rent right now - I've been counting on it since spring. Is there any way to actually talk to someone about tax refund status or am I just supposed to keep waiting forever?

Sofia Gomez

same boat friend. filed my taxes in March and got that stupid letter in July about the 60 day wait. here we are in december and still nothing. tried calling a bazillion times and all i get is that annoying automated system. so fed up with this whole process.

How many times have you tried calling? I've probably called 30+ times and never get through to a human.

lost count honestly. probably like 50+ times at this point. its ridiculous that they expect us to just wait indefinitely with no updates.

Try calling at exactly 8:00am when they open. Thats how I finally got through after weeks of trying.

I was in the same situation but finally managed to talk to an actual human after using claimyr.com - they called and stayed on hold for me, then connected me with an agent when one was available. Got my refund status updated and the money showed up in my account two weeks later. Talking to an agent got my $ unlocked so fast, it was the only way I could talk to a live agent. Check out this video about it: https://youtu.be/Rdqa1gKtxuE

hmm I've been burned by so many of these 'services' before... what makes this different? sounds too good to be true tbh

I was skeptical too but it actually works. They just automate the calling and holding process so you don't have to waste hours on the phone. When an agent picks up, you get connected. Saved me days of frustration.

I used it last month when my claim was stuck. It actually worked 🤷‍♀️ Got my backpay 3 days after talking to the agent they connected me with.

Have you tried contacting your local state representative? Thats what finally worked for me after waiting 5 months for my refund. They have direct contacts at the dept and can escalate your case. Just google your district rep and send them an email explaining the situation.

The whole tax refund process for unemployment is such a disaster this year. My friend filed in February and just got hers last week. NINE MONTHS OF WAITING. The letter they send out about the 60 days is basically just to shut people up. Keep calling and try different times of day. Eventually you'll get through.

Nine months?! That's insane! Did she do anything specific to finally get it resolved or just keep waiting?

She contacted her state assembly person and they pushed it through. Took about 2 weeks after that.

I FINALLY got my refund last week after filing in March. The key is to call repeatedly until you get a human on the line - which is nearly impossible with how overwhelmed their system is. I ended up using claimyr.com after someone on here recommended it. They got me through to an agent in about 45 mins. The agent told me my refund was stuck in a "review queue" and they manually pushed it through. Money was in my account 10 days later.

They basically call for you and wait on hold, then alert you when they get a human agent. Saved me from hours of listening to that terrible hold music.

Is there any other way to get through? I've been trying for weeks without success

Honestly, not that I found. I tried calling at different times, different numbers, etc. The system is completely overwhelmed.

I'm an accountant and have several clients dealing with this exact issue. The NYS tax department and unemployment office are severely backlogged due to staffing issues. The 60-day letter is automatically generated but essentially meaningless at this point. Your best options are: 1. Persistently call early in the morning (7:55am) when lines first open 2. Contact your local assembly member or state senator's office 3. Use a service like claimyr.com which many of my clients have had success with - they handle the calling/waiting process 4. File a formal complaint through the NYS Department of Taxation and Finance website DO NOT file a second return or amended return as this will only further delay the process. The money will eventually come, but unfortunately, the state's systems are overwhelmed right now. For those in dire financial situations, I recommend working with local assistance programs while waiting for your refund.

Thank you for this detailed information! Really helpful to have advice from someone who understands the system. I'll try contacting my assembly member tomorrow.

is the backlog getting any better or worse lately? trying to figure out if i should expect a 3 month or 9 month wait 😩

It's slightly improving, but still significant. I'd estimate 4-5 months currently unless you proactively reach out through one of the methods I mentioned.

Did you file electronically or paper? Paper filings are taking FOREVER this year. My electronic filing took 3 months but my moms paper filing has been pending for 7+ months now.

I filed electronically through TurboTax. Can't imagine how much worse it would be if I filed paper!

Check if you have an online account with the NY tax department. Sometimes they post notices there but don't mail them. I found out my refund was on hold because they needed additional verification, but they never contacted me directly about it! 🤦‍♂️

Bruh the system is so broken. I had to hire a tax advocate after waiting 8 months. Cost me $250 but I finally got my refund. Not ideal but sometimes u gotta pay to get what's already yours 🙄

Wait times are INSANE right now. I'm still waiting on my refund from LAST year (filed Feb 2022). Keep calling and document everything. I finally got through after using claimyr.com - the hold times were like 3+ hours but they handled all that and just connected me when an agent was available.

Thats absolutely ridiculous. Have you tried reaching out to your representatives?

Yep, contacted my assembly member twice. They "escalated" it but nothing happened. Only got movement when I finally talked to an actual tax department person.

Have you checked the "Where's my refund" tool on the NY tax website? Sometimes it actually has useful info. Mine was stuck because they flagged it for "identity verification" but never bothered to tell me 🙃

I feel you. NY unemployment and tax system is BROKEN. Im pretty sure they intentionally make it difficult to actually get your money. Keep pushin and dont give up - thats what they want you to do.

^^^THIS!!! They literally count on people giving up. Don't let them win!

just fyi - if you're getting desperate and need the money now, I found a workaround. Apply for the NY Taxpayer Assistance Program. They can sometimes issue a hardship payment while you wait for your refund to process. You'll need to prove financial hardship though.

Thank you for this tip! I hadn't heard about this program. Definitely going to look into it.

This happened to me too. Called for weeks and couldn't get through. Finally paid for claimyr.com and got connected to someone in about an hour. Found out my refund was on hold for "income verification" but they never sent me any notice about it! The agent released it right away and I got my money 2 weeks later. It's ridiculous we have to jump through these hoops but at least I finally got my money.

wait hold up - does this actually work or is it just the usual BS? I've spent literal days on hold with these people

Yeah it actually works. They just do the calling and holding for you, then connect you when they get a human. Saved me so much frustration.
