NY unemployment owes me federal supplements from March & August but claims they can't pay separately

I've been fighting with ny unemployment for almost 8 months now trying to get my missing federal supplements. I had 2 weekly payments reissued - one from March 12th and another from August 15th. They sent me the base state benefit amounts but didn't include the $300 federal supplements that should've been attached. I've called at least 12 times over the past 5 months and spoken with different agents who all claim they've "submitted a request for the federal portion" but nothing ever happens. Yesterday I finally got through again and the agent told me something completely different - that the system supposedly doesn't have any way to send the federal supplements separately from the weekly payments! This seems like total BS since they managed to send me the state portion separately. Has anyone experienced this or know what I should do? That's $600 they're withholding from me and I'm getting nowhere with these endless phone calls.

I went thru this exact same nonsense back in April. The only thing that finally worked was using claimyr.com to get directly connected to an actual supervisor (not the frontline reps who just say whatever to get you off the phone). Talking to the supervisor got my $ unlocked so fast after 4 months of the runaround. Check out their video explaining how it works: https://youtu.be/Rdqa1gKtxuE

is this actually worth it? ive heard so many horror stories about these type of services...

100% worth it. I was super hesitant too but it's literally just a service that waits on hold FOR you then calls you when a real person picks up. No sketchy stuff. They don't need any of your personal info or claim details.

how long did it take to get connected? I've been on hold for like 4+ hours multiple times and just end up hanging up 😩

For me it took about 45 mins. Way better than the 3+ hours I was spending on hold before. The beauty is you don't have to stay glued to your phone the whole time.

The system absolutely CAN pay federal supplements separately. They're lying to you. I had the exact same thing happen with a payment from July and after I threatened to contact my state rep they magically found a way to issue just the federal portion. Don't let them gaslight you!

which state rep did you contact? I'm in Brooklyn and willing to try this approach

I'm in Albany area so different rep than you'd have. Just Google your district rep and call their office. They usually have staff dedicated to unemployment issues.

this is the way. state reps get shit DONE. my cousin works in a state office and says UI cases are like half their constituent work these days

Same boat here 🚣‍♀️ Owed 3 weeks of federal supplements from different months. Been calling since September with zero progress. The agents just read from scripts and have no actual authority to fix anything complicated. The whole system is designed to make people give up.

OMFG this makes me so mad. They are ABSOLUTELY capable of paying federal separately!!! I used to work for NYSDOL (quit last year thank god) and there's a specific payment code for retrospective federal payments. The tier 1 agents you're talking to probably don't know how to do it, and the ones who do know are just being lazy. Ask specifically to speak with a MONETARY DETERMINATION SPECIALIST.

This is super helpful info! Will definitely ask for a Monetary Determination Specialist next time. Did you have to use any specific language to get your case escalated when you worked there?

Luca Esposito

Just be polite but FIRM. Say "I understand this is complicated but I need this escalated to a Monetary Determination Specialist who can handle separate federal payment issues. Please note in my file that multiple agents have given contradictory information."

If you worked there, can you explain why they make this process so damn difficult? Is it intentionally designed to make people give up? 🤔

Honestly? It's a combo of outdated systems, undertrained staff, and yes - making it hard enough that some people give up. The system runs on COBOL ffs... like 60 year old programming language.

Try calling right when they open. I found I get the more experienced agents that way instead of the newer ones who don't know what they're doing. The key is getting someone who actually knows how to code the payment correctly.

I had this EXACT issue and I'm gonna tell you exactly what I did to fix it. First, document EVERYTHING. Every call, rep name, ID number, what they told you. Then, file a formal complaint through the NYSDOL website. THEN, and this is the important part, contact your state assembly member AND state senator (not federal). Send them all your documentation. I had my federal supplements within 10 days after 6 months of getting nowhere. Also, I've heard good things about using claimyr.com to skip the hold times and get through to higher level agents. The hold times are designed to wear you down so you'll give up on money that's rightfully yours.

Thank you so much for this detailed plan! I've been documenting everything but didn't think about filing a formal complaint or contacting state reps. Going to try this approach.

The state rep approach is hit or miss depending on your district tbh. My assemblyman's office was useless but my state senator's office fixed my UI issues in like 48 hours.

lmao they're playing you. "we can't pay federal supplements separately" is complete BS. my cousin works for DOL (different state but same federal programs) and says they absolutely have mechanisms to issue manual federal supplement payments. keep calling until you get someone competent.

dude i literally just got my missing federal payments last week after fighting since April! what worked for me was filing a complaint with the ny labor department ombudsman office and cc'ing my state senator. suddenly they "found" a way to pay me. funny how that works 🙄

do you have contact info for the ombudsman office? I can't find it anywhere on their website

labor.ny.gov/agencyinfo/ODI.shtm - there's a form there. Make sure to include all your documentation and be super specific about dates and who you talked to.

OMG they are so full of crap! I had this same issue with missing federal payments from Jan and April. Took me 11 calls before I got somone who knew what they were doing. Ask specifically for a TIER 3 SPECIALIST - they're the only ones with authorization to issue manual federal supplement payments. Don't let them transfer you to anyone else.

0 coins

-

AstroAce

I didn't know there were different tiers! How do you specifically request a Tier 3? Do you just ask directly?

0 coins

-

23d

Carmen Diaz

Yep just straight up ask. They might try to tell you none are available but just say you'll wait. Most of the time they'll magically find one available 😂

This happened to my mom! She was missing like 5 weeks of federal payments. She finally got through using claimyr.com instead of waiting on hold for hours every time. The rep told her that there's a special code they need to use for manual federal payments and many agents don't know how or don't have the authorization. She got paid within 2 weeks after that call. It was the only way she could talk to a live agent that actually knew what they were doing.

I used them too and it worked. When you've been fighting the unemployment system for months, the service is worth it just to maintain your sanity.

I went through this nightmare last year. Here's what finally worked: 1. Stop accepting the "we can't do it" answer. They absolutely can. 2. Ask specifically for a "specialized claims examiner" - regular agents often don't have access to the right payment codes. 3. If they won't transfer you, hang up and call again (I know it sucks). 4. If you make no progress after 3-4 more calls, contact your state assembly person. 5. Document EVERYTHING - dates, times, names, what was said. 6. Use the phrase "I am experiencing a financial hardship due to the department's error in not properly issuing the federal portion of my benefits." 7. If you're tired of the hold times, try claimyr.com - they'll wait on hold and call you when they get an agent. Talking to an agent got my $ unlocked so fast after I'd wasted weeks on hold. Stay persistent! The system counts on people giving up, but that money is YOURS by law.

This is INCREDIBLY helpful! Thank you for laying it out so clearly. I'm going to try these exact steps.

Can confirm the magic phrase about financial hardship works. Used it when I had a similar issue and suddenly they escalated my case.

have u tried reaching out on twitter? I was shocked but their social media team actually helped me get my missing payments after I tweeted at them publicly. worth a shot 🤷‍♂️

@NYSLabor - make the tweet public and be specific about how long you've been waiting. they hate the bad PR

the problem is probably that those payments are from 2021 and we're now in a different fiscal year. the funds for those federal programs were time-limited. not saying you don't deserve your money, just explaining why it's complicated for them to issue now.

-

Aiden Rodríguez

nah this isn't true. my wife got backpaid federal supplements from 2021 just last month. they definitely still have access to those funds for legitimate claims.

oh good to know! I was just guessing based on other government programs I've dealt with. glad to hear they can still pay it!

I've worked with dozens of NY unemployment cases (I'm a volunteer benefits navigator) and this is unfortunately common. The frontline agents often don't know how to properly code retroactive federal supplement payments. Here's what works: 1) Call using claimyr.com to skip the hold times (seriously, it's a game changer) 2) When you get an agent, IMMEDIATELY ask to speak with a supervisor or claims examiner specialized in monetary recalculations 3) Use these exact words: "I need a manual FPUC payment adjustment for weeks ending [specific dates]" - using their terminology helps tremendously 4) If they say they've submitted a request, ask for a confirmation number and expected timeframe 5) If they claim they can't do it, politely but firmly state: "According to USDOL guidance, states are required to issue supplemental FPUC payments even if delayed or retroactive. I'd like to speak with someone who has authorization to process this type of adjustment." Don't give up - this is money you're legally entitled to!

they tried the same BS with me last year! kept saying they couldn't issue just the federal part. finally i threatened to file a complaint with the US Dept of Labor and suddenly they found a way to do it. don't give up!

Not so fun fact: ny unemployment intentionally makes these processes difficult and gives agents limited training on complex cases. it's literally designed to make people give up on benefits they're entitled to. the worse their numbers look, the better it is for politicians who want to say they're "combating fraud" or "reducing dependency." FIGHT FOR YOUR MONEY!

This is 100% true. My sister works for the state (not NYSDOL but adjacent) and confirms this is deliberate policy. They call it "disincentivizing continued claims" 🤮
