NY unemployment certification went through but now says 'File New Claim' and hearing required?
Just certified for my weekly benefits on Sunday like normal and it seemed to process fine. Usually get paid Tuesdays but checked today and payment didn't show up. Now when I check the website where it normally shows I can certify, it says "File a New Claim" instead! But at the top of the page it still shows I already certified for this week?? I called ny unemployment and the agent said something about needing to go through a hearing?? This makes no sense because just last week a different representative told me to simply keep claiming every week and I'd get my money no problem. Now suddenly I need a hearing?? Has anyone dealt with this before? The inconsistency is driving me crazy!

Same thing happened to me. The system is completely broken. I certified for 3 weeks in a row, then suddenly got the "File a New Claim" message. Called like 50 times and got different answers every single time. One person said my claim expired, another said there was a flag on my account, third person said I needed to verify identity. Complete disaster.

•Did you ever get it resolved? How long did it take? This is so frustrating!

•Yeah eventually. Took about 5 weeks and THREE hearings (for some reason). The worst part was getting completely different info every time I called.

After fighting with ny unemployment for weeks trying to get someone on the phone, I finally used this service called Claimyr (claimyr.com) that got me a callback with an actual agent. Honestly it was the best money I've ever spent to finally get my benefits paid quickly. They stay on hold so you don't have to and then call you when they get someone. Check out this video that explains how it works: https://youtu.be/Rdqa1gKtxuE

•Is this some kind of scam? How does it actually work?

•Not a scam at all! They just automate the hold process so you don't waste hours listening to that horrible music. Once they get a real person, they connect you. Talking to an agent got my $ unlocked so fast after weeks of nothing.

•sounds like one of those ads that pops up everywhere. anyone ACTUALLY try this? 🤔

•I literally just told you I used it lol. But yeah I was skeptical too before trying. If you've ever spent 4+ hours on hold only to get disconnected, you'd understand why this is worth it.

•hmm I've been burned by so many of these 'services' before... what makes this different?

•They don't handle your claim or anything - literally just get you through to a human at NYSDOL. That's it. I was desperate after two months of getting nowhere.

The "File a New Claim" message usually means your benefit year ended or theres some kind of issue with your current claim. When was your original claim filed? Most claims are good for exactly 1 year from filing date.

I had to do a hearing. It wasn't as scary as it sounds. Basically they just need to verify some information about your case that triggered a flag in there system. Mine was because my employer contested my unemployment eligiblity. The hearing was over the phone and took about 30 min with a judge and my former employer on the line.

•Did you have to prepare anything for the hearing? Did they tell you why they needed one beforehand?

•Yeah I got a letter like 10 days before with the reason and time. My advice is write down all your dates of employment, reason for separation, etc so you don't get flustered when they ask questions. The judge was actually pretty nice.

If the website is showing "File a New Claim" but also saying you certified, that sounds like a glitch in there system. Try logging out completely, clearing your cache/cookies, and logging back in. Sometimes that fixes weird UI issues with the ny unemployment site.

•Tried that already, same issue. I even tried using a different browser and my phone. Same thing everywhere.

•Ugh that sucks. Their website is such garbage. Definitely sounds like you need to talk to someone then. Good luck getting through tho 🙄

Here's what's probably happening: There's likely an eligibility issue that popped up on your account. The system is still letting you certify (which is why it says you certified for the week), but it's not releasing payments until the issue is resolved. The "File a New Claim" message is a glitch that happens when there's a pending issue. Based on the hearing comment, there's probably one of these issues: - Your employer is contesting your unemployment - There's an issue with your work search activities - They think you earned income you didn't report - There's an identity verification problem You should: 1. Check your message inbox on the unemployment portal 2. Look for any mail from NYSDOL (they often send hearing notices by mail, not electronically) 3. Call again and specifically ask what the issue is and if there's a hearing scheduled 4. If you keep getting the runaround, try the claimyr.com service - it's how I finally got through after weeks of trying Don't wait on this - if there's a hearing scheduled and you miss it, you'll likely be denied benefits automatically.

•This ☝️ Exactly right. Happened to me too. The system is designed to be confusing.

the state wants more money for themselves, so they make it impossible 2 get ur benefits. they hope u give up. DONT GIVE UP! keep calling and bugging them everyday!!

i went through a hearing last yr. basicly my boss said i quit and i said i was laid off. i won because i had text messages proving my side. if u need a hearing make sure u have EVIDENCE of whatever ur claiming.

•This is super important advice! Documentation is EVERYTHING in these hearings. Save all emails, texts, letters, etc.

The NYSDOL is such a disaster. Im convinced they deliberately make it confusing so people give up trying to get whats owed to them. Like why tell someone to keep certifying if theres an issue that needs a hearing?? So ridiculous.

•Exactly!!! Then you go through 6 months of hearings only for them to say "oh btw you should've been getting paid this whole time" 🤮

•Bruh for real. And they wonder why people get so frustrated with them 💯

Whatever you do DON'T file a new claim if you already have an active one!!! It will cause even more delays and problems. Keep trying to reach someone on the phone.

•Thank you for the warning! I almost clicked it thinking maybe that's what they wanted me to do.

I was in the same situation back in August. I found that calling right when they open (8am) gave me a better chance of getting through. Also try calling your state rep - mine actually helped expedite my case!

Hey - they might be referring to a telephone interview not a formal hearing. Those are pretty routine if there's a question about your eligibility. Did they give you a specific date?

Tyler Murphy
•No date given... the person on the phone just mentioned a hearing would be needed but didn't explain why or when. So frustrating!

Kiara Greene
•That's typical unfortunately. Keep an eye on your mail and email. They're supposed to give you at least 7 days notice before any hearing.

Pro tip: while ur waiting to resolve this (cuz it'll probly take weeks), apply for emergency assistance programs. There's rent help, utility assistance, food programs etc. Don't wait till ur completely broke.

•That's good advice, thank you. Do you know where I should look for those programs?

•Start with 211 - just google "211 new york" and you'll find the website. They can connect you with all kinds of assistance programs based on your situation.

NY unemployment is the WORST. I've never dealt with a more incompetent organization in my life. I started getting the "file new claim" thing after certifying for 6 weeks straight. Took me forever to get it fixed.
