Major identity theft: Fake unemployment claim filed in my name AND suspicious IRS transcript with multiple unauthorized tax refunds and amended return

Something really strange just happened. I logged into my account to check on an old claim from last year and noticed there's a NEW active unemployment claim that I never filed! I'm currently employed full-time and have been at the same company since October. The claim was apparently filed two weeks ago. There's even a payment issued for $418 that I never received. I checked my bank accounts and nothing was deposited. What's even more concerning is this isn't the first identity issue I've had. I just checked my IRS account transcript and noticed some strange activity there too. Looking at my transcript dated Apr. 16, 2021 (my return was received Mar. 09, 2021), I can see multiple transactions that I don't recognize: TRANSACTIONS CODE EXPLANATION OF TRANSACTION CYCLE DATE AMOUNT 150 Tax return filed 20210705 03-09-2021 $0.00 16211-445-45073-1 806 W-2 or 1099 withholding 04-16-2021 -$3,235.00 766 Tax relief credit 04-28-2020 -$3,400.00 766 Credit to your account 04-28-2020 -$2,000.00 846 Refund issued 04-16-2020 $4,400.00 290 Additional tax assessed 20201505 04-28-2020 $0.00 16254-999-05099-0 971 Notice issued 04-28-2020 $0.00 766 Tax relief credit 01-19-2021 -$2,200.00 766 Credit to your account 01-19-2021 -$2,200.00 846 Refund issued 01-05-2021 $3,400.00 290 Additional tax assessed 20205302 01-19-2021 $0.00 16254-999-05055-0 766 Credit to your account 04-16-2021 -$2,687.00 766 Credit to your account 04-16-2021 -$2,100.00 846 Refund issued 02-25-2021 $6,022.00 971 Amended tax return or claim 04-30-2021 $0.00 forwarded for processing 977 Amended return filed 04-30-2021 $0.00 43277-521-68513-1 766 Credit to your account 04-16-2021 -$2,074.00 290 Additional tax assessed 20212905 08-10-2021 $0.00 17254-602-05044-1 971 Notice issued 08-10-2021 $0.00 846 Refund issued 07-29-2021 $2,082.69 776 Interest credited to your account 08-10-2021 -$9.69 I'm freaking out because it seems like someone has stolen my identity to not only file an unemployment claim but possibly tampered with my tax information. I don't recognize some of these refunds being issued! For example, there's a refund issued on 07-29-2021 for $2,082.69 with interest credited of $9.69 that I have no recollection of receiving. There are also multiple tax relief credits and credits to my account that I'm not sure about, including credits on 04-28-2020, 01-19-2021, and 04-16-2021. I see an amended return was filed on 04-30-2021, but I don't remember filing an amendment. I immediately changed my password for my unemployment account and called the fraud department but can't get through to anyone. I'm also planning to contact the IRS about these suspicious transactions. Has this happened to anyone else? What steps should I take to protect myself and report this? I'm worried about tax implications and how this might affect me if I ever actually need unemployment in the future. Should I be filing a police report? Contacting credit bureaus? This whole situation is giving me massive anxiety.

Oh man, this happened to me last month! Someone filed a claim in my name while I was working two jobs. Crazy thing is that the DOL actually flagged my legitimate tax return as suspicious because of the fraudulent claim. I ended up having to submit a police report, contact all three credit bureaus and put a freeze on my credit. make sure u do that asap! you should also notify your employer because they might get paperwork about the claim.

Thanks for the reply. Did you eventually get it sorted out? How long did the whole process take?

It took almost 6 weeks to get completely resolved. Had to keep calling and following up. The credit freeze was the most important part tho, stopped them from doing anything else with my info.

Ugh this happened to my brother too! The scammers are getting really bold these days 😡

I was in this exact situation back in February. The most important thing is to get someone on the phone ASAP. I kept trying for days with no luck until I found this service called Claimyr (claimyr.com) that got me connected with a live agent. Best money I've ever spent because talking to a real person got the fraudulent claim marked immediately and they started the investigation process. Without that, I was just stuck in limbo. They also have this helpful video explaining how it works: https://youtu.be/Rdqa1gKtxuE

does this actually work? sounds too good to be true ngl

It definitely worked for me! I was skeptical too, but after trying to call for literally 3 days straight with no luck, I was desperate. The service connected me with an agent in about 40 minutes.

another company promising to solve the unemployment nightmare... what makes this one different from all the other scams out there? 🤔

The difference is that they don't claim to get your benefits faster or anything sketchy - they literally just help you get past the impossible phone system. They call repeatedly using their system and then connect you when a real person answers. For identity theft issues like this, talking to someone is the only way to resolve it.

I used Claimyr too after waiting on hold for like 6 hours across 3 days. Got connected within an hour. Whatever they charge is worth it when ur dealing with identity theft tbh

You need to file a police report RIGHT NOW. This is identity theft and you want documentation that you reported it immediately. Also document everything - take screenshots of the claim, any emails, etc. I went through this last year and having all the documentation helped me prove I wasn't committing fraud.

The ny unemployment system is completely broken right now. My cousin had the same thing happen and it took her 3 months to get it resolved. Apparently there's a huge backlog of fraud cases because so many scammers are targeting the system. Contact the FTC at identitytheft.gov too - they have a whole process for unemployment identity theft specifically.

Thanks. I was hoping it wouldn't take that long, but I guess I need to be prepared for a battle. I'll check out the FTC site right now.

Yeah sorry to be the bearer of bad news. But the sooner you start documenting everything the better. Also dont forget to check your credit reports! The scammers might try other stuff with your info.

CHECK YOUR MAIL EVERYDAY! When this happened to me, the DOL sent a physical letter asking to verify the claim. If I hadn't caught that letter, the scammer might have called in and verified the claim pretending to be me. They also might have a different address on file for payments, which is why you didn't receive the money.

Good call. I'll keep an eye out. Though weirdly I haven't received anything in the mail about this yet.

Here's what you need to do immediately (I work in fraud prevention): 1. File a police report - this is critical for establishing you're the victim not the perpetrator 2. Contact all three credit bureaus (Experian, Equifax, TransUnion) and place a fraud alert 3. Freeze your credit at all three bureaus 4. Report the fraud to NYSDOL via their online portal AND by phone (I know getting through is hard - try using claimyr.com to get a callback from an agent) 5. File a report at identitytheft.gov 6. Inform your employer's HR department 7. Monitor your credit reports closely for the next year minimum 8. Check if any of your other accounts have been compromised 9. Consider changing passwords on all important accounts 10. Keep detailed records of all communications about this issue The sooner you act, the better chance you have of minimizing damage. Identity theft involving unemployment is especially tricky because it has tax implications too. You'll need to be proactive about protecting yourself during tax time next year.

Thank you so much for this thorough response. I've already done #1 and #9, and I'm working on the rest today.

THIS!! 👆 so important to be proactive and not wait for the government to figure it out

just wanna say DOCUMENTATION IS EVERYTHING. keep copies of everything. my bf went thru this and the unemployment office tried to make HIM pay back money he never got 🤬 he would've been screwed if he didn't have proof he reported it right away

Not to freak you out but did u check ur social security earnings statement? If they have enough of ur info to file unemployment, they might be working under ur SSN too. That happened to me and it was a whole other mess to deal with.

Oscar Murphy

•

Omg I didn't even think about that. I'll check right now. This is getting more stressful by the minute.

Sorry I know its stressful but better to find out everything now. The social security website lets you create an account and check ur work history. If u see jobs you never worked at, thats another red flag.

I'm an accountant and see this ALL THE TIME lately. Make sure to file your taxes early next year. The fraudsters sometimes file fake tax returns too using the same stolen info. Also expect to get a 1099-G form from unemployment that you'll need to dispute.

this happened to my uncle and he actually got in legal trouble because he didnt notice for months!!! apparently if u dont report it fast enough they can accuse YOU of fraud even tho ur the victim. the whole system is messed up.

That's terrifying. I'm trying to be proactive but it's hard when I can't get anyone on the phone.

Try calling right when they open. I got through after only 15 mins on hold by calling at 7:58am (they open at 8).

Or just use Claimyr and save yourself the headache. claimyr.com connected me to an agent in less than an hour when I was dealing with this same fraud issue.

CALL FIRST THING IN THE MORNING!!! the ny unemployment phone lines are less busy right when they open. also try the fraud hotline specifically, not the regular unemployment number

get in touch with ur state representative too! i couldnt get anyone at unemployment to help until i contacted my assembly person. their office has special contacts at DOL and got my case expedited.

This is actually great advice that most people don't know about. My state senator's office fixed an unemployment issue for me in 2 days after I spent weeks trying on my own.

i literally just resolved this exact situation last week! what worked for me was first getting thru to someone using claimyr.com (only way i could actually talk to a human), then filing police report, then sending in id verification docs they requested. took about 3 weeks total but now its marked as fraud in their system and they gave me a case number to use for my taxes.

•

That's really helpful to know. Did they tell you how the fraudster was able to access your information? I'm trying to figure out how this happened.

Sophia Long

In my case they said it was probably from one of the big data breaches. I was part of the Equifax breach a few years ago. They use that stolen info to file claims in bulk. The agent told me they're seeing hundreds of these cases every day.

Pro tip: when you finally get someone on the phone, ask them to put notes in your file that you're a victim of identity theft AND ask them to flag your account to require additional verification for any future claims. Otherwise this could happen again!

0 coins

The worst part about this whole thing is it's IMPOSSIBLE to get anyone on the phone at ny unemployment 😤 I spent literal days trying before I found a workaround. Use claimyr.com - they'll get you a callback from an actual agent instead of waiting on hold forever. Saved me so much stress when I was dealing with fraud on my account.

0 coins

does that service actually work? ive tried everything to get through

0 coins

100% works. They basically call repeatedly using their system until they get through, then connect you with the agent. When I was dealing with identity theft, I got connected in about 45 minutes instead of waiting days.

•

hmm i've been burned by these 'services' before... what makes this different?

0 coins

The difference is they don't claim to do anything with your claim - they just get you past the phone system nightmare. For identity theft you HAVE to talk to someone, there's no way around it. And trying to get through yourself is basically impossible right now.
