Husband missing 1099G from NY unemployment despite collecting for 4 months

So frustrated with this whole situation! My husband collected benefits for about 14 weeks from February to May this year, but when we tried to get his 1099G for our taxes, the system says he doesn't have one. I was able to get mine no problem (I only collected for 6 weeks back in November), but his just shows "no 1099G available for this tax year" even though he definitely received around $6,800 in benefits. Has anyone else run into this? Should we just file without it and risk getting audited? Or spend hours trying to reach someone on the phone? Our tax appointment is in 2 weeks and I'm stressing out.

I swear the ny unemployment system is designed to be broken on purpose. I had this exact same issue last year - my partner got hers, but mine was 'not available' despite collecting for half the year. Nope, not a scam. I was desperate after 3 weeks of calling. It's basically just a service that waits on hold for you and then calls you when an agent picks up. Saved me like 4 hours of hold music hell.

Same thing happened to me but with my wife's 1099G. Called for THREE DAYS straight and couldnt get through. Finally just filed without it and we got a letter from IRS six months later saying we underreported income. Had to file an amendment and pay a fee. DO NOT FILE WITHOUT IT!!!!!

Have you tried logging into the ny.gov account instead of just the unemployment portal? Sometimes they put tax documents in the main document center instead of the unemployment section. Took me forever to figure that out last year.

We tried both places and it's not showing up anywhere. My husband's account is definitely active because he can see all his payment history from those months.

This exact thing happened to me. Here's what you need to do: First, try requesting it again through the NY.gov account (not just the unemployment portal). Sometimes they're in different places. If that doesn't work, you NEED to talk to a live agent. I know it's nearly impossible to get through on the phone, but it's crucial. When you get an agent, explain the situation and ask them to check if there's a "block" on the 1099G. In my case, they said there was a random identity verification flag that never got cleared properly. Everything SEEMED fine on my end (got all payments), but their system had this flag preventing the tax doc from generating. Annoying but fixable!

If you have his payment history, you could technically calculate the total yourself (weekly benefit amount x weeks paid) and report it. But get ready for a headache later when the IRS computer eventually matches the income. Better to just get the official form.

Just a heads up, ny unemployment is particularly bad about 1099Gs this year. I've seen at least 20 posts about this same issue in various groups. It's a systam-wide problem from what I can tell.

LPT: if you cant get the 1099g, you can at least look at the bank statements to see how much was deposited from NYSDOL. That's what I had to do last year when mine never showed up. Just remeber to subtract any taxes they witheld.

This is terrible advice! The bank statements won't show what was withheld for taxes. You need the actual 1099G.

Thats why I said "subtract any taxes witheld" genius. You can see the net deposit in your bank and then calculate back the gross if you know your withholding percentage.

But you still need the official form for your tax records! The IRS will flag the return as incorrect if the numbers don't match exactly what the state reported.

I bet the problem is that he might have received some payments in the previous calendar year too? The 1099G only shows for the specific tax year - so if the claim started in Dec 2022 for example but continued into 2023, you need both years' 1099G forms.

Nope, his claim was entirely within 2023, from February to May. He didn't receive anything in 2022 so that's not the issue.

Check your spam folder! I know that sounds basic but NY started emailing the 1099G forms this year instead of mailing them, and mine went straight to spam. Just a thought.

You absolutely have to track this down. The unemployment office reports this income to the IRS regardless of whether you get the form. If you don't include it on your taxes, you'll get a notice later and possibly penalties. trust me, been there done that.

Took them like 3 months to sort out but they eventually got it fixed. Had to file a police report and everything. Hopefully thats not your situation but def worth checking out.

Try contacting your state rep's office! Sounds weird but they actually have special contacts at unemployment and can escalate issues. Worked for me when I had a similar problem last year.

Lol did he claim under a different ssn by accident? My cousin did that once - turned out he transposed 2 digits when filing and his benefits were under the wrong number!

I dont think so? He's been logging into the same account the whole time and can see his payment history. Just no 1099G for some reason.

File an extension!!!! That's what I'm doing - my paperwork is all messed up too and I'm not dealing with an audit. You can get a 6 month extension easily and then have time to sort this out.
