Been stuck in pending for 9 months with NY unemployment - can't get through to anyone

Filed for unemployment back in October 2022 and my claim is still stuck in pending status. Had an identity verification issue which I resolved in January but nothing has changed since then. I've been calling at least twice a week for MONTHS and can never get through to an actual person. This is beyond frustrating - we're talking almost 9 months of waiting with no income. Anyone know what I should do at this point? The online system shows no updates and I can't get any answers.

Dmitry Volkov

I hear ya. Dealing with NY unemployment is like talking to a brick wall. Have you tried contacting your local state representative? Thats what finally worked for me after 4 months in pending hell.

No I haven't tried that yet. How do I find my local rep and what should I say to them exactly?

Just google "NYS Assembly member" or "NYS Senator" with your zip code. Email AND call them. Tell them exactly how long you've been waiting and that you can't get basic help. They have direct contacts at NYSDOL that regular people don't have access to.

This is the way. I was stuck for 6 months until I contacted my assembly person. They called me back in 2 days and my claim was fixed in a week.

After weeks of failed attempts to reach NY unemployment, I found this service called claimyr.com that got me through to a live agent! Literally saved my sanity. They call for you, wait on hold, then connect you when a real person answers. Talking to an agent got my $ unlocked so fast after months of nothing but automated messages. Here's a video about how it works: https://youtu.be/Rdqa1gKtxuE

sounds fishy... these 'miracle solutions' never work. what's the catch? 🙄

Ava Martinez

No catch - it's just a service that calls and waits on hold so you don't have to. I was skeptical too but I was desperate after being on hold for literal HOURS multiple times. It worked for me when nothing else did.

It did for me! I was shocked when my phone rang and it was actually a live person from unemployment. First human I'd talked to in months lol. Check out their site claimyr.com

not falling for another unemployment 'hack'... these never work and usually just waste more of your time

Actually I tried this too after seeing it mentioned on twitter. Got through to someone in like 2 hours when I'd been trying for weeks. My backpay is finally processing now.

i have the EXACT same issue. been stuck since november!!! they fixed my id verification in february but its still just sitting there. ny unemployment system is broken beyond repair at this point 😤

Have you tried calling right when they open? That's what worked for me after 7 months in limbo. Started calling at 7:58am and kept redialing until I got in queue.

-

Sofia Ramirez

Yeah I've tried all times of day including early morning. Either get a busy signal or the automated system hangs up on me saying too many calls.

Dang that sucks. System is completely overwhelmed still. Have you tried the callback feature on their website?

Sofia Ramirez

What callback feature? I don't see anything like that on their site?

Oh shoot maybe they removed it. It was there briefly a few months ago. Sorry for the confusion.

Look. Here's what you ACTUALLY need to do to get this resolved. I went through this exact nightmare for 5 months and finally got it fixed: First, document EVERYTHING. Every time you call, every message you get. Take screenshots of your account status. Second, contact your state assembly member AND state senator simultaneously. Don't just email - call their offices directly. Explain that you've been waiting for 9 months with no resolution after already resolving the identity verification issue. Third, file a complaint with the NYS Department of Labor Ombudsman office. They're supposed to investigate cases that have gone unresolved for too long. Fourth, if you're desperate to speak with someone right now and can't wait for the political channels to work, honestly claimyr.com is the only reliable way I found to get through the phone system. They have some tech that keeps dialing and gets you past the endless hold times. Lastly, when you DO get through to someone, be super detailed but polite. Ask for a supervisor immediately if the first person can't help. Get badge numbers or employee IDs for everyone you speak with. The system is absolutely broken but these steps will maximize your chances of getting through. Good luck - I know how soul-crushing this wait can be.

Thank you so much for this detailed advice. I'll start with my state reps tomorrow. How long did it take for them to help once you contacted them?

My assemblyman's office called me back in 2 days, and then it took about 10 days for them to get NYSDOL to take action. Way faster than the months I wasted trying on my own.

THIS!! 👆 Follow every step here. The ombudsman complaint was what finally worked for me.

NYSDOL is completely useless. I filed an appeal in March and still nothing. I'm convinced nobody actually works there 🤡

Have u checked ur spam folder? they sent me crucial emails there and i almost missed them

0 coins

-

Sofia Ramirez

Good suggestion but yeah I've been checking everything including spam. Nothing from them at all since January.

The ONLY thing that worked for me was sending a message through the secure message center on the website every single day for two weeks straight. Eventually someone must have gotten annoyed enough to fix my account lol. Just kept asking for updates and explaining my situation.

Sofia Ramirez

I've been sending messages every week but maybe I need to step it up to daily. What kind of responses were you getting?

0 coins

AstroAdventurer

At first just automated replies. Then after about 8 days got a real response saying they were looking into it. Then radio silence for 5 more days before suddenly my account switched from pending to approved.

Did u already do the ID verification through [ID.me](https://ID.me)? That was my issue - had to verify twice for some reason.

0 coins

-

Sofia Ramirez

Yeah I did that back in January and got the confirmation email saying my identity was verified. Still stuck though.

this exact thing happened to me too!!! finally got thru by using claimyr.com - its this thing where they call for you and then connect you when someone answers. was ready to give up before i found it. got my case resolved in ONE call after months of nothing

hmm I've been burned by so many of these 'services' before... what makes this different?

0 coins

-

it actually works lol. they don't do anything except get you past the phone tree hell. once they get someone on the line, they connect you directly to talk to the agent yourself. saved me hours of hold music 💯

you might have a fraud hold. happened to me too and unless you specifically ASK about it, they wont tell you. when you eventually get through, ask if there's a fraud hold on your account.

0 coins

-

Sofia Ramirez

That's really good to know, thank you. Wonder if that's why it's been stuck for so long even after fixing the ID issue.

0 coins

-

22d

Isabella Santos

yep. took me forever to figure this out. the id verification and fraud hold are actually two separate issues in their system but they dont make that clear AT ALL

why does ny unemployment make everything so complicated?? its almost like they WANT us to give up and go away 😫

0 coins

-

GalacticGuru

because they do lol. fewer claims paid = better numbers for them

-

Exactly. They're hoping we'll just get desperate enough to take any job instead of getting what we're owed.

For real have u tried reaching out to your local news station? Sometimes the bad publicity makes them move faster on cases.

After 3 months of nothing but busy signals, i broke down and paid for claimyr. Got through to an agent who fixed my claim on the spot. Sometimes you gotta spend money to get your money 🤷‍♂️

another day, another company promising to fix the unfixable unemployment system lol

I was skeptical too but I was at my wits end. All they do is call and wait on hold for you, then connect you when a human answers. Simple but effective when you can't get thru otherwise.

I can vouch for this too. Used it last month after trying for weeks to get through. Worth every penny when you're waiting on thousands in benefits.

Try this direct number I found: [redacted]. Its not the main line and sometimes gets you to a different department who can transfer you to claims. Worked for me last week.

-

Sean Doyle

They shut this line down last month... keep getting transferred to the main line when I try it now. They catch on quick when people share these workarounds 😒

I know this sounds crazy but try calling your local unemployment office directly instead of the main number. Each county has their own office and sometimes they can help even tho they're not supposed to take direct calls.

check ur work search requirements!!! even if ur in pending status, if you havent been documenting your work search they can deny you retroactively. make sure ur doing the minimum searches every week and logging them

-

I've definitely been keeping up with all the work search requirements and documenting everything. Good reminder though.

honestly the whole ny unemployment system is a joke. i applied in december, got approved right away, then NOTHING for 8 weeks. finally called using claimyr.com and found out they had some random flag on my account that nobody bothered to tell me about. fixed in 5 minutes once i actually talked to someone.

u try the twitter method? @NYSLabor sometimes responds if u tweet at them enough (make sure ur tweet is public not a DM

I haven't tried that yet but I'll give it a shot. Worth a try at this point!
