Just make sure you have all your documentation ready when you file. Pay stubs, any written warnings they gave you, dates of incidents they're claiming. If it goes to a hearing you'll need proof of everything.
Unfortunately employers fight unemployment claims all the time because it affects their unemployment tax rate. Even when the termination was legitimate, some companies will contest just to try to save money. It's frustrating but NYS Department of Labor will investigate and make a determination based on the facts. Make sure you respond to any questionnaires they send you and be completely honest about what happened.
ugh this is exactly why I hate the whole unemployment system. Companies can just lie and make your life miserable even after they fire you. My last employer tried to claim I was fired for attendance when I had medical issues they knew about. Fight it hard because they're probably just hoping you'll give up.
Keep in mind that even after your claim is approved, there's usually a one-week waiting period before you start receiving payments. So if your claim gets approved at the 3-week mark, you'd still be waiting another week for your first payment. The waiting period is unpaid but serves as your first week of unemployment.
Keep filing those weekly claims even while you're waiting! Once your initial claim gets approved, you'll get back pay for all the weeks you certified. I made that mistake once and had to appeal to get those weeks back.
5 weeks is definitely longer than usual but not unheard of, especially this time of year when claim volume is higher. The important thing is to stay on top of it and keep trying to make contact. Document every attempt you make to reach them in case you need that information later.

Just be patient, the NYS Department of Labor system moves slowly but it usually works out. I got my first payment exactly 3 weeks after filing. Make sure your bank account info is correct in your profile for direct deposit.
