Wooooow 5 months is criminal! I'm going on 6 weeks and already panicking. Is there anything specific she did that finally got things moving? I've uploaded every document they asked for but still nothing.
Getting through to the right person made all the difference. We wasted so much time with the frontline agents who couldn't really do anything. You need to specifically ask for a claims specialist or supervisor.
Stories like this both give me hope and make me angry. Glad your daughter got paid but it's ridiculous we have to jump through so many hoops for benefits we've earned. The nysdol treats everyone like they're trying to commit fraud instead of just helping people who need it.
Theres a whole underground economy of scammers who specialize in unemployment fraud. They buy peoples personal info on the dark web, file claims, then route the $ to money mule accounts. Im a fraud investigator (not for NY) and these cases take MONTHS to resolve. Sorry ur going thru this.
Not exactly the same but my friend had a similar issue with her 1099-G showing more than she received. Turns out unemployment had been sending payments to her old closed bank account for 3 months. When she finally got through to someone, they reissued all her payments. Definitely call and escalate!!
You said you contacted your assemblyman, but did you also try your STATE SENATOR? They often have more pull with DOL. Also, were you very specific in your request? You need to give them your full name, DOB, last 4 of SSN, claim ID, and exactly when the issue started + what you've done to resolve it.
Write a formal hardship letter. Send it certified mail to NYSDOL Commissioner's Office. Include documentation of financial hardship (eviction notice, utility shutoff, bank statements showing $0, etc). By law they have to prioritize hardship cases. My cousin works at DOL and told me this is what actually gets claims expedited internally.

Make sure to check if your eligible for the Earned Income Tax Credit! it might help offset some of the taxes you owe on unemployment. The income thresholds and credit amounts increased for 2021.
I called the ny unemployment office and after waiting 2.5 hours they confirmed all unemployment income is fully taxable now. The exemption was only for 2020. I hate it here 😤
How did you manage to get through? I've been calling for days and can't get past the automated system.
I used claimyr.com - they call and wait on hold for you then connect you when they get a human. Saved me hours of frustration.

yeah their systems don't talk to each other. the right hand doesnt know what the left is doing. you got emails saying you were eligible but then their audit system flagged you. classic NY unemployment mess.

Email your state senator AND assembly member. I did both and the assembly member's office got back to me in 2 days and had my issue resolved in a week. They have special contacts at unemployment.
