EDD accusing me of overpayment during SDI to PFL transition - might have to repay everything!

Hey everyone, I'm in a bit of a pickle. I've been accused of overpayment during the transition between short-term disability and paid family leave. Now they're saying I might have to pay back the entire thing! Has anyone dealt with this before? What should I do?

I found a way to solve EDD overpayment accusation issues, watch this: https://www.youtube.com/watch?v=KHirVAO-BkY

Ugh, that sucks! I've been through something similar. First thing you need to do is gather all your paperwork - pay stubs, approval letters, everything. Then call EDD and ask for a detailed explanation of the overpayment. Sometimes its just a clerical error.

This! Documentation is key. Make sure you have dates for when you applied for each benefit too.

Good luck getting ahold of EDD tho 🙄 I've been trying for weeks!

True, calling EDD can be a nightmare. But keep trying, its worth it to get this sorted out.

I found a way to actually get someone on the phone at EDD. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/1X-mEsLtbmQ

Sounds too good to be true. Has anyone else tried this?

20 bucks? Idk man, seems kinda steep just to make a phone call.

I get the skepticism, but it seriously saved me hours of frustration. Worth every penny imo.

Can confirm, I used it last week and got through in like 30 mins. Game changer!

Listen up, because I've been down this road before and I know how to navigate it. Here's what you need to do: • First, DON'T PANIC. Overpayment notices are common and often resolved. • Gather all your documents: approval letters, pay stubs, bank statements showing deposits. • Write a detailed timeline of your disability and family leave periods. • Request a written explanation of the overpayment from EDD. They're required to provide this. • If you disagree with their assessment, file an appeal immediately. You usually have 30 days. • Consider seeking legal aid if the amount is substantial. • DO NOT ignore this. It won't go away and can lead to wage garnishment. Remember, the system is confusing and mistakes happen. Stay calm, be persistent, and document everything. You got this! 💪

Wow, thank you so much for this detailed response! I'll definitely follow these steps. Quick question - how long did your appeal process take?

My appeal took about 3 months from filing to resolution. But I've heard it can take anywhere from 1-6 months depending on their backlog. Hang in there!

lmao welcome to the club 🤡 EDD is a mess rn

Have you considered reaching out to your local state representative? Sometimes they can help expedite these issues or provide additional resources.

This is actually great advice. My cousin did this and got her issue resolved in like 2 weeks!

I'm curious, did you receive any warnings or notices before the overpayment accusation? I'm on SDI now and worried about transitioning to PFL.

0 coins

Nope, no warnings at all. It came out of the blue which is part of why I'm so stressed about it.

0 coins

Oof, that's rough. Guess I'll start saving just in case. Thanks for the heads up!

Hey OP, what was the time gap between your SDI ending and PFL starting? I've heard there can be issues if there's an overlap or gap.

0 coins

Not to be that guy, but make sure you're actually eligible for both SDI and PFL. The rules can be tricky and sometimes people think they qualify when they don't.

0 coins

👆 This. I thought I was eligible for both but turns out I wasn't. Cost me a fortune.

Ugh, the EDD is the worst! I swear they make these "mistakes" on purpose to discourage people from claiming benefits. Stay strong and fight it!

Tin foil hat much? 🙄 It's more likely just incompetence than malice.

Maybe, but after dealing with them for months, I wouldn't put anything past them 😤

I went through something similar last year and it was absolutely terrifying at first! Here's what helped me: 1. **Get everything in writing** - Call EDD and ask them to mail you a detailed breakdown of exactly what they think you were overpaid and why. Don't just take their word over the phone. 2. **Check your work history** - Sometimes they miscalculate your base period wages or don't account for overlapping eligibility periods correctly. 3. **Look into hardship waivers** - If you do end up owing money, EDD has programs to waive repayment if it would cause financial hardship. Most people don't know about this! 4. **Keep detailed records** - Screenshot everything, save all emails, and keep a log of every phone call with dates and representative names. The good news is that a lot of these "overpayments" get overturned once you provide the right documentation. Don't let them intimidate you - you have rights in this process! Feel free to DM me if you need help navigating the appeal paperwork.
