Washington ESD unemployment if I get fired - what are my options?
I'm really worried about my job situation right now. My supervisor has been giving me write-ups for things that seem minor and I'm afraid I might get terminated soon. If I do get fired from my job, can I still file for Washington ESD unemployment benefits? I've heard conflicting information about whether you can get UI if you're fired versus if you quit. I've been working at this company for about 2 years and haven't had any major issues before this new manager started. Just want to know what my rights are if the worst happens.

Yes, you can potentially get unemployment if you're fired, but it depends on the reason. Washington ESD will look at whether you were terminated for 'misconduct' or just general performance issues. If it's misconduct (like theft, violence, repeatedly violating company policy after warnings), you'll likely be disqualified. But if it's performance-related or layoffs, you should be eligible.

•That's helpful, thank you. The write-ups are mostly for being a few minutes late or not following some new procedures perfectly. Nothing like theft or anything serious.

•Those sound like performance issues rather than misconduct. Keep documentation of everything just in case you need it for your claim.

I got fired last year and had no problems getting approved for UI benefits. The key is being honest when you file your claim about the reason for separation. Washington ESD will contact your employer to verify, so don't try to hide anything.

•Good to know. Did the process take long? I'm worried about the time between filing and getting approved.

•Mine took about 3 weeks but that was pretty normal. Some people wait longer if there are complications.

If you do get terminated, file your claim immediately. Don't wait thinking about it. Even if there's an issue with your separation reason, you want to get the process started. I had trouble getting through to Washington ESD when I needed to check on my claim status - ended up using claimyr.com to help me get connected to an actual agent. Their system automatically calls and gets you through the phone queue, saved me hours of trying to call myself.

•Never heard of that service before. Does it actually work? I've been trying to call Washington ESD for weeks about my pending claim.

•Yeah it works great. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Way better than sitting on hold for hours or getting disconnected.

•I'll keep that in mind if I need to call them. Hopefully it doesn't come to that but good to know the option exists.

ugh the whole system is so stressful. i got fired 6 months ago and it was a nightmare dealing with everything. make sure you start looking for work right away because they have job search requirements you have to meet every week

•What are the job search requirements? I haven't looked into that part yet.

•You need to make at least 3 job search contacts per week and keep a log. Washington ESD can audit your job search activities so keep good records.

The most important thing is the reason for termination. 'Misconduct' has a specific legal definition in Washington state unemployment law. Simple poor performance, inability to do the job, or personality conflicts usually don't qualify as misconduct. However, willful violations of company policy after proper warnings can be considered misconduct.

•That's really detailed, thank you. It sounds like my situation would probably not be considered misconduct based on what you're saying.

•yeah but employers try to fight unemployment claims all the time even when they shouldn't. be prepared for that possibility

I'm dealing with something similar right now. Been trying to get answers from Washington ESD about my claim for weeks. The phone system is impossible - either busy signal or you wait for hours then get disconnected. So frustrating when you need answers about your benefits.

•That's exactly why I started using Claimyr. The service handles all the calling and waiting for you. You just get a callback when they have an agent on the line.

•Might have to try that. This is ridiculous how hard it is to reach them.

Keep all your documentation! Write-ups, emails, anything related to your performance issues. If Washington ESD needs to do an investigation, having that paperwork will help your case.

•Good advice. I've been keeping copies of everything just in case.

Quick question - do you get benefits immediately when you file or is there a waiting period?
0 coins
Ella Thompson
•There's a one-week waiting period for all new claims. Your first payable week is actually your second week of unemployment.

•Thanks, good to know about that delay.

The unemployment office will investigate any firing to determine if it was for misconduct. They'll interview both you and your employer. Be completely honest about what happened - they can usually tell if someone is lying and it'll hurt your case.

•That makes sense. I plan to be completely truthful about everything.

I got fired for attendance issues and still got approved for unemployment. The key was showing that I had legitimate reasons for the absences and that the company didn't follow their own progressive discipline policy properly.

•That's encouraging. My situation might be similar - the new manager seems to be applying policies inconsistently.

•Document everything! Dates, times, what was said. You never know what might be important later.

Don't quit! If you think you're going to be fired anyway, make them fire you. If you quit, it's much harder to get unemployment benefits. Even if the workplace is terrible, getting fired gives you better chances for UI.

•Yeah I definitely wasn't planning to quit. If anything happens, it won't be my choice.

Washington ESD takes forever to process claims nowadays. I filed 2 months ago and still haven't heard back about my eligibility determination. The whole system is backed up.

•That's when services like Claimyr become really valuable. When you can't get through normal channels, having a way to actually reach an agent makes all the difference.

•I might have to look into that. This waiting is killing me financially.

Also remember that if you do get denied initially, you can appeal the decision. A lot of people don't know that or don't follow through with the appeal process.

•Good to know there's an appeal option if needed. Hopefully it won't come to that.

Make sure your resume is updated and start networking now, even before anything happens. The job market is competitive and you want to be ready to hit the ground running if you do lose your job.

•Smart advice. I should probably start putting feelers out there just in case.

THE SYSTEM IS BROKEN! I've been waiting 6 weeks for my determination and can't get anyone on the phone to help. How are people supposed to survive like this???

•I feel your frustration. That's exactly the situation where Claimyr helped me - when the regular system just wasn't working. Sometimes you need an alternative way to get through.

•Hang in there. The wait is awful but most people do eventually get their claims processed.

If you get fired, file online immediately at esd.wa.gov. Don't delay thinking about whether you qualify - let Washington ESD make that determination. The sooner you file, the sooner you can start the process.

•Will do. Thanks for all the advice everyone. This has been really helpful.
