Can I get Washington ESD unemployment if I get terminated from my job?
I might be getting fired from my job next week and I'm really stressed about money. I've been having performance issues and my manager has been documenting everything. If they terminate me, can I still file for unemployment benefits through Washington ESD? I've heard conflicting things about whether you can get UI if you're fired vs if you quit. I've been working there for about 8 months and this would be my first time ever filing for unemployment. What should I expect?

Yes, you can typically get unemployment if you're terminated, but it depends on the reason. Washington ESD will look at whether you were fired for misconduct or just performance issues. If it's performance-related and not willful misconduct, you should be eligible for UI benefits.

•What counts as misconduct vs performance issues? I'm not sure which category my situation falls into.

•Misconduct is usually things like stealing, violence, repeatedly violating company policy after warnings. Poor performance, not being a good fit for the role, or even attendance issues that aren't willful usually don't disqualify you from UI.

File as soon as you're terminated, don't wait! The sooner you apply with Washington ESD the sooner your claim starts processing. Even if they challenge it, you want to get the process started immediately.

•How long does it usually take to get approved and start receiving payments?

•If there's no issues, usually 2-3 weeks. But if your employer contests it, it could go to adjudication which takes longer.

I got fired last year for attendance and still got my UI benefits. Washington ESD approved me after about 3 weeks. Your employer can contest it but they have to prove misconduct, not just poor performance.

•That's reassuring. Did your employer try to fight it?

•They did contest it initially but I guess they didn't provide enough evidence because Washington ESD ruled in my favor.

Just went through this whole process myself. The key thing is being honest on your application about why you were terminated. Don't try to hide it or lie about it because Washington ESD will contact your employer anyway. If you're having trouble getting through to them on the phone to check your claim status, I recently discovered this service called Claimyr (claimyr.com) that helps you actually reach a human at Washington ESD. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me hours of calling and getting hung up on.

•Thanks for the tip about being honest. I'll definitely be upfront about the performance issues.

•Never heard of Claimyr before but that sounds useful. The Washington ESD phone lines are impossible to get through on.

ugh the washington esd system is so confusing, i got fired 2 months ago and still dont fully understand if i did everything right on my weekly claims

•What part of the weekly claims is confusing you? The job search requirements or something else?

Nia Thompson
•mostly the job search stuff, like how many jobs do i need to apply to each week? and do i need to keep records of everything?

For weekly claims you need to apply to at least 3 jobs per week and keep records in your job search log. Washington ESD can audit this so make sure you're documenting everything - company name, position, date applied, method of contact.

•Good to know about the 3 jobs per week requirement. I should start preparing for that now.

•oh crap i think ive been doing it wrong then, i only applied to like 1-2 jobs some weeks

The whole system is designed to make it as hard as possible for working people to get help. They'll find any excuse to deny your claim and then make you jump through hoops to appeal it. It's ridiculous!

•I understand the frustration but in most legitimate cases Washington ESD does approve benefits. The key is following the rules and being persistent.

•Easy for you to say but I've been fighting them for months over an overpayment that makes no sense

Update: I got terminated today. My manager said it was due to not meeting performance standards. I'm planning to file for unemployment tomorrow morning. Feeling pretty anxious about the whole process but this thread has been really helpful.

•Sorry to hear about the job loss but it sounds like you have a good case for UI benefits. Performance standards not being met is usually not considered misconduct.

•You'll be fine, that sounds exactly like my situation. File online at secure.esd.wa.gov as early as possible tomorrow.

I was in a similar boat last year - got let go for 'not being a good fit' which was really just performance stuff. Washington ESD approved my claim without any issues. The weekly filing process is pretty straightforward once you get used to it.

•How much did you end up getting per week if you don't mind me asking?

Aisha Abdullah
•It depends on your previous wages but I was getting around $580 per week. The Washington ESD website has a calculator to estimate your weekly benefit amount.

Make sure you keep all the documentation from your termination - any writeups, the termination letter, etc. If your employer contests your claim you'll need that stuff for the adjudication process.

•Good point, I'll make copies of everything they gave me today.

•Also keep records of your job search activities from day one. Washington ESD can ask for those records at any time.

Just remember you have to be actively looking for work while collecting UI. Can't just sit at home doing nothing or they'll cut off your benefits.

•Yeah I understand I need to be applying to jobs. Planning to start that right away.

•Good. And document everything in case they audit your job search log later.

Been there! Got fired from my retail job for missing too many shifts (I had transportation issues) and Washington ESD still approved my benefits. Took about 4 weeks total but I did get back pay for the waiting period.

Diego Rojas
•That's encouraging to hear. Did you have to go through adjudication?
0 coins
Yuki Tanaka
•Yep, it went to adjudication because my employer contested it. But the adjudicator ruled that transportation issues weren't willful misconduct.

If you do run into issues with your claim or need to speak to someone at Washington ESD, definitely check out that Claimyr service I mentioned earlier. I used it again last week when I had questions about my ongoing claim and got connected to an agent in like 15 minutes instead of spending hours calling.

•How much does something like that cost? Seems too good to be true.

•It's worth it just for the time savings. Much better than calling 50+ times and never getting through.

honestly the worst part about getting fired is dealing with all this bureaucratic BS afterward. like im already stressed about money and now i have to navigate this confusing system

•I know it's overwhelming but the UI system is there to help you. Take it one step at a time and don't hesitate to ask questions here.

Pro tip: file your weekly claims on the same day each week to avoid missing the deadline. I almost lost a week of benefits because I forgot to file on time.

•When is the deadline for weekly claims?

Emily Jackson
•You have to file your weekly claim between Sunday and Saturday of each week. I set a reminder on my phone for every Sunday morning.

The job search requirement is 3 jobs per week but make sure you're applying to suitable work. Can't just apply to random jobs that have nothing to do with your skills or experience.

Diego Rojas
•What defines 'suitable work'? Is there a specific criteria?
0 coins
Liam Mendez
•Generally work that matches your skills, experience, and previous wage level. Washington ESD has guidelines on their website about what qualifies.

Got fired for performance issues 6 months ago and my claim was approved no problem. The key is Washington ESD looks at whether it was misconduct or not. Performance issues usually don't count as misconduct.

Diego Rojas
•That's what I'm hoping for. My situation sounds very similar to yours.

•You should be fine. Just be honest on the application and don't stress too much about it.

remember to also look into other benefits you might qualify for while unemployed - food assistance, healthcare subsidies, etc. unemployment benefits alone might not cover all your expenses

•Good point, I hadn't thought about other assistance programs. I'll look into that.

I tried that Claimyr thing mentioned earlier and it actually worked! Got through to Washington ESD in under 20 minutes when I'd been trying to call for days. Definitely recommend it if you need to talk to someone about your claim.

•Same here, used Claimyr last month when my claim got stuck in adjudication. Way better than the regular phone system.

One thing to watch out for - if you get any severance pay that might affect when your benefits start. Washington ESD considers severance as wages which could delay your first payment.
0 coins
Diego Rojas
•I didn't get any severance so that shouldn't be an issue for me.

Aiden Rodríguez
•Good, that makes it simpler. Your benefits should start right away then assuming no other issues.
