If I get fired can I apply for unemployment - Washington ESD eligibility question

My boss has been making comments about my performance lately and I'm worried I might get terminated soon. If that happens, would I be able to file for unemployment benefits through Washington ESD? I've been working at this company for 2 years full-time. I'm not sure what the rules are about getting fired vs quitting when it comes to UI eligibility. Anyone know how this works?

Yes, you can generally apply for unemployment if you're fired, but it depends on WHY you were fired. Washington ESD will look at whether it was for misconduct or not. If it's just poor performance or layoffs, you should be eligible. If it's for something like stealing or violating company policy, that's different.

It's just performance issues, nothing serious like theft or anything. So that should be okay then?

0 coins

Performance issues usually don't disqualify you from benefits. The key is whether it rises to the level of 'misconduct' which has a specific legal definition.

I got fired last year for attendance problems and still got my unemployment approved. It took about 3 weeks though because they had to do an adjudication to review the circumstances.

0 coins

Good to know it worked out for you. Did your employer fight it at all?

0 coins

They responded to Washington ESD's inquiry but didn't contest it. I think they knew it wasn't misconduct level stuff.

The whole process can be frustrating when you're trying to reach Washington ESD to check on your claim status. I spent weeks trying to get through on the phone after I was let go. Finally found out about Claimyr (claimyr.com) which actually got me connected to an agent. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Made the whole experience way less stressful.

Never heard of that service before. Is it legit? I hate the idea of being on hold for hours.

0 coins

Yeah it's legitimate. They basically handle the calling and waiting for you, then connect you when they get an agent on the line. Saved me so much time and frustration.

0 coins

Interesting, I might need to look into this if my claim gets complicated.

Make sure you file your claim as soon as possible after you're terminated. Don't wait around thinking about it. The sooner you get the process started, the better. And be completely honest on your application about the circumstances.

0 coins

How soon is 'as soon as possible'? Like the same day or within a week?

0 coins

I'd say within a few days at most. You can file online through the Washington ESD website 24/7 which makes it easier.

0 coins

been there done that, got fired for being late too many times but still got unemployment. the adjudication process is annoying but just be patient

0 coins

What exactly happens during adjudication? Do they interview you?

0 coins

they might call you and they'll definitely contact your employer to get both sides of the story

0 coins

One thing to keep in mind is that even if you're initially denied, you can appeal the decision. Washington ESD has to prove that your termination was due to misconduct, not just that you were a less-than-perfect employee. There's a big legal difference there.

0 coins

That's reassuring. I've never been written up or anything, just verbal warnings about productivity.

0 coins

Verbal warnings for productivity usually won't rise to misconduct level. You should be fine, but document everything just in case.

THE SYSTEM IS SO BROKEN!!! I was fired for a bogus reason and it took MONTHS to get my benefits sorted out. Washington ESD is impossible to reach and they don't care about working people at all!!!

0 coins

Sorry you had such a hard time. Did it eventually get resolved?

0 coins

Yes but only after I got a lawyer involved. The whole thing was a nightmare.

0 coins

Most cases don't need a lawyer though. That sounds like it was an extreme situation.

same boat here, worried about getting canned. this thread is helpful to know what to expect

0 coins

Yeah, at least we know we'll have some options if the worst happens.

0 coins

Just remember that when you do file, you'll need to do your weekly claims every week and meet the job search requirements. Don't let those slide or you could lose your benefits even if you were eligible initially.

0 coins

What are the job search requirements exactly?

0 coins

You need to apply for at least 3 jobs per week and keep a log of your search activities. It's all explained on the Washington ESD website.

0 coins

I had a friend who got fired and was worried about the same thing. Turned out to be no big deal - she got approved and received benefits for the full 26 weeks while she looked for a new job. The key is being honest about everything.

0 coins

That's encouraging to hear. I'm definitely going to be completely truthful if I have to file.

0 coins

Also worth noting that your weekly benefit amount will be based on your earnings over the past year, so if you've been working steadily you should get a decent amount. The maximum weekly benefit in Washington is currently around $950 per week.

0 coins

Wow, I had no idea it could be that much. That would actually help a lot while job hunting.

0 coins

That's the maximum though. Your actual amount depends on your previous wages. But it's designed to replace about 50% of your previous income.

0 coins

Don't stress too much about it. Most people who get fired for performance reasons end up getting approved. The employers usually don't fight it unless it was really serious misconduct.

0 coins

Thanks, that does make me feel better about the whole situation.

0 coins

Pro tip: if you do get fired, ask for documentation of the reason. Sometimes employers are vague about it but having it in writing can help your case with Washington ESD if there are any issues.

0 coins

Good advice. I'll definitely ask for that if it happens.

0 coins

Just went through this whole process myself. The waiting period for adjudication was nerve-wracking but it all worked out. Having that Claimyr service would have been helpful - I spent so many hours on hold trying to get updates on my claim status.

0 coins

Yeah, several people have mentioned that service now. Might be worth checking out if I need to contact them.

0 coins

whatever you do dont quit before they fire you, that makes it way harder to get benefits

0 coins

Good point. I'll stick it out even if things get uncomfortable.

0 coins

The whole thing reminds me of when I got laid off from my previous job three years ago. Different situation but the uncertainty is similar. At least unemployment benefits exist to help people through transitions like this.

0 coins

True, it's good to know there's some safety net there.

0 coins

One last thing - if you do get terminated, make sure to file your claim within the first week if possible. There's no waiting period to file, and the sooner you get in the system, the sooner your benefits can start if you're approved.

0 coins

Got it. I'll bookmark the Washington ESD website just in case I need it.

0 coins

thanks for asking this question, I was wondering the same thing but was afraid to post about it

0 coins

No problem! This community is really helpful for these kinds of questions.

0 coins

Hope everything works out with your job situation. But if not, at least you're prepared now and know what steps to take. The unemployment system isn't perfect but it does help people get through tough times.

0 coins

Thanks everyone for all the helpful advice. I feel much more prepared now for whatever happens.

0 coins

Been following this thread and learned a lot. Saved it for reference since you never know what might happen in today's job market.

0 coins

Smart thinking. Better to be prepared and not need it than the other way around.
