Can I go on unemployment if I get fired from my job in Washington?
My boss has been making comments about my performance lately and I'm worried I might get fired. If that happens, would I still be able to collect unemployment benefits through Washington ESD? I've been working at this company for about 8 months and paying into the system. I'm not sure how the rules work if you get terminated versus quitting. Anyone know what the requirements are?

Yes, you can usually collect unemployment if you're fired, but it depends on the reason. Washington ESD will approve your claim if you were fired for reasons beyond your control - like layoffs, restructuring, or even poor performance (as long as it wasn't willful misconduct). If you were fired for stealing, violence, or repeatedly violating company policy, that's different.

•That's helpful, thank you. It would just be performance issues if anything, not misconduct. How long does it usually take to find out if they approve the claim?

•Usually 2-3 weeks if there are no complications. Sometimes longer if they need to investigate the circumstances of your termination.

I got fired last year for attendance issues and still got approved for benefits. The key is being honest on your application about what happened. Washington ESD will contact your employer to verify the details anyway.

•Did they make you wait longer because you were fired vs laid off?

•Not really, took about the same time as when I was laid off from my previous job. Maybe an extra week for them to review everything.

If you do get fired and need to file a claim, I'd suggest using Claimyr to help you get through to Washington ESD by phone. I found out about it recently at claimyr.com and they have a video demo at https://youtu.be/7DieNd3C7zQ. The system can be really hard to navigate and you'll probably have questions about your specific situation.

•Never heard of that service before. Is it legit? I'm always nervous about third-party services for government stuff.

•Yeah it's legitimate. They basically help you get through the phone queue to actually talk to a real person at Washington ESD. Much better than spending hours on hold or getting disconnected.

The most important thing is to file your claim IMMEDIATELY after you're terminated. Don't wait around thinking about it or trying to find another job first. You can job search while collecting benefits, and there's a waiting period anyway before payments start.

•Good point. How quickly do I need to file after getting fired?

Sean Fitzgerald
•You should file within the first week if possible. The sooner the better because your benefit year starts when you file, not when you lost your job.

•And make sure you have all your employment info ready - dates, wages, reason for separation. Makes the application process much smoother.

been thru this before and washington esd is pretty fair about firing vs misconduct. as long as you werent doing anything really bad theyll probably approve you. just be honest about what happened

•That's reassuring. I've never been fired before so I wasn't sure what to expect from the process.

•yeah its stressful but the system is designed to help people who lose jobs through no fault of their own

Just to clarify the misconduct thing - Washington ESD defines misconduct pretty narrowly. It has to be willful disregard of the employer's interests, deliberate violation of rules, or illegal acts. Poor performance, personality conflicts, or making mistakes usually don't qualify as misconduct.

•This is really important info. I got fired for not meeting sales targets and was worried I wouldn't qualify.

Omar Farouk
•Sales targets would definitely not be misconduct unless you were deliberately sabotaging sales or something. That's just performance.

•What about if you're fired for being late too many times? Is that misconduct?

•Attendance issues can be tricky. If you had legitimate reasons (transportation problems, childcare issues) it's usually not misconduct. But if you were just being irresponsible, it might be.

The worst part about getting fired is dealing with all the paperwork and phone calls to Washington ESD afterward. I spent weeks trying to get through to them when I had questions about my claim status. Finally used that Claimyr service someone mentioned and got through in like 20 minutes instead of hours.

•How much does something like that cost? I'm already worried about money if I lose my job.

•It's worth it just for the time savings alone. Plus when you're dealing with unemployment benefits, getting accurate information quickly is really important.

One thing to keep in mind is that your employer might contest your unemployment claim if they think you were fired for misconduct. If that happens, you'll need to participate in a hearing to present your side of the story.

PixelPrincess
•Oh wow, I didn't know they could contest it. What happens in a hearing?

Luca Ricci
•It's usually done over the phone. Both you and your employer present evidence and testimony, and an administrative law judge makes the decision. Most people represent themselves but you can have someone help you prepare.

•I had to do a hearing when my employer contested my claim. It was nerve-wracking but not as bad as I thought. Just be honest and stick to the facts.

WASHINGTON ESD SYSTEM IS SO BROKEN! I got fired 6 months ago and it took them 2 months to process my claim because they kept losing my paperwork. And don't even get me started on trying to reach them by phone - it's impossible!

•yeah the phone system is terrible but you can usually get things sorted out if you keep trying

Anastasia Kuznetsov
•This is exactly why I recommend Claimyr for getting through to them. The regular phone system is a nightmare but they can actually get you connected to a real person.

•Maybe I should have tried that. Spent so many hours on hold for nothing.

Also remember that even if you're approved for benefits, you still need to file weekly claims and meet the job search requirements. You can't just sit back and collect money - you have to actively look for work and report your job search activities.

•How many jobs do you have to apply for each week?

Ethan Campbell
•I think it's 3 job contacts per week, but double-check the current requirements when you file. They can change these rules.

•And keep detailed records of your job search! They can audit you and ask for proof of your applications.

got fired from my last job for 'attitude problems' which was basically just me asking questions about policies. still got unemployment approved because asking questions isnt misconduct lol

•That's encouraging. Sounds like they really do try to be fair about what counts as misconduct.

If you do get fired, make sure to ask for a copy of your personnel file and any documentation about the termination. This can be helpful if your employer contests your unemployment claim.

PixelPrincess
•Smart thinking. I wouldn't have thought to ask for that stuff.

Carmen Sanchez
•Yeah, it's your right to have access to your personnel file. Better to get it while you're still thinking clearly rather than trying to get it later when you're stressed.

The good news is that Washington state is generally more worker-friendly than a lot of other places. They really do try to help people who lose their jobs through no fault of their own.

•That's reassuring to hear. I was worried the system would be stacked against workers.

•Don't get me wrong, it can still be frustrating and slow, but the underlying rules are pretty fair.

Just want to echo what others have said about filing immediately. I waited two weeks after getting fired because I was embarrassed and that just delayed everything. File right away even if you think you might find another job quickly.

•I can understand feeling embarrassed. There's still some stigma around unemployment even though it shouldn't be.

•Exactly. It's insurance that you paid into, not charity. You've earned the right to use it if you need it.

One more tip - if you get fired, try to get the reason in writing if possible. It helps when you file your claim if you can be specific about what they told you versus just guessing.

PixelPrincess
•Good advice. I'll keep that in mind if worst comes to worst.

•Yeah, sometimes employers are vague about the reason which can cause problems later during the unemployment investigation.

The bottom line is yes, you can usually get unemployment if you're fired, but be prepared for it to take some time and potentially involve some back-and-forth with Washington ESD. Having help navigating the system definitely makes it easier.

•Thanks everyone for all the helpful responses. I feel much more prepared now if I do end up getting fired.

Been following this thread and wanted to add that Claimyr really is worth trying if you run into problems reaching Washington ESD. I was skeptical at first but it saved me so much time and frustration when I needed to talk to someone about my claim.

•How exactly does it work? Do they just call for you or what?

•They basically handle the waiting and get you connected to an actual Washington ESD representative. Way better than spending your whole day hitting redial.

•I'll definitely keep that in mind. Sounds like dealing with Washington ESD by phone is pretty challenging.
