Do I get Washington ESD unemployment benefits if I get fired from my job?
My boss has been making threats about letting me go and I'm really worried about what happens next. If I end up getting fired from my job, will I still be able to collect unemployment benefits through Washington ESD? I've been working at this company for almost 2 years and paying into the system. I hear different things from coworkers about whether you can get UI if you're terminated vs if you quit. Can someone explain how this works in Washington state?

It depends on why you're fired. If it's for misconduct or violating company policy, Washington ESD will likely deny your claim. But if it's due to performance issues, downsizing, or other reasons that aren't your fault, you should qualify for unemployment benefits.

•What counts as misconduct exactly? I'm worried they might try to pin something on me to avoid paying unemployment.

•Misconduct has to be willful or negligent behavior that violates company rules. Things like stealing, being drunk at work, or repeatedly ignoring direct orders. Poor performance alone usually isn't misconduct.

I got fired last year for attendance issues and Washington ESD approved my claim after an investigation. They look at whether the employer had clear policies and if you had warnings. Document everything just in case.

•That's helpful to know. Did you have to go through adjudication or did they approve it right away?

•Yeah it went into adjudication for about 3 weeks while they contacted my employer and reviewed the details. Was stressful but worked out fine.

I had the hardest time getting through to Washington ESD when I needed to check on my claim status after being terminated. Spent hours calling that 833 number and kept getting disconnected. Finally found this service called Claimyr that actually got me connected to an agent in like 10 minutes. You can check it out at claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

•How much does that cost? I'm already stressed about money.

•It's way cheaper than missing work to sit on hold all day. Plus they actually get you through to someone who can help with your specific situation.

Washington ESD is gonna deny it no matter what!! They denied mine even though I was laid off through no fault of my own. Had to appeal and everything. The whole system is rigged against workers.

•Did you win your appeal? Sometimes the initial determination is wrong but gets overturned.

•Yeah eventually but it took MONTHS and I almost lost my apartment waiting for benefits.

This is all really helpful information. I'm hoping it doesn't come to that but at least I know what to expect now.

•Start documenting everything now - save emails, write down conversations with your boss, keep copies of your performance reviews. You'll need all that if Washington ESD investigates.

File your claim immediately if you do get fired. Don't wait thinking you'll find another job quick. The waiting period starts from when you file, not when you became unemployed.

•Good point. How long does the whole process usually take to get your first payment?

Sydney Torres
•If there's no issues, about 2-3 weeks. But if it goes to adjudication like mine did, could be 4-6 weeks or longer.

Make sure you understand the job search requirements too. You'll need to log job contacts and be available for work. Washington ESD is pretty strict about that stuff.

•How many job contacts do you need per week?

Gianna Scott
•Three per week minimum, and they have to be legitimate job opportunities in your field or related work.

•Every case is different. Washington ESD looks at the specific circumstances and company policies.

If you do end up needing to contact Washington ESD about your claim, seriously consider using Claimyr. I wasted so much time trying to get through on my own before I found them. Game changer for actually talking to someone.

•Is this like a phone service or what exactly?

•Yeah they basically handle the calling for you and get you connected to an actual Washington ESD agent. Way better than sitting on hold for hours.

The key thing is whether the termination was for cause or not. If your employer can prove you did something that violated their policies and you knew it was wrong, that's misconduct. But if it's performance-related or they're just letting you go, you should qualify.

•What if they say it's performance but I think they're really just trying to get rid of me?

•Washington ESD will investigate and look at the documentation from both sides. That's why it's important to keep records.

I've been through this whole process twice now. First time I got denied because I didn't understand how to explain my situation properly. Second time I prepared better and got approved. It really depends on how you present your case.

Dylan Fisher
•What did you do differently the second time?

•I gathered all my documentation first and was very specific about dates and incidents when I talked to the adjudicator.

Don't forget you have to register with WorkSource too. That's part of the requirements for getting benefits.

•Is that separate from filing the unemployment claim?

Sydney Torres
•Yeah it's a separate system but they're connected. You'll need to do both to stay eligible for benefits.

The worst part is waiting for a decision when your claim goes into adjudication. They don't give you any timeline and you just have to wait and hope.

•That's when having a way to actually reach someone at Washington ESD becomes really important. I used that Claimyr service someone mentioned earlier and finally got answers about my adjudication status.

Remember that even if you get denied initially, you can appeal. Lots of people give up after the first denial but the appeals process exists for a reason.

•How long do you have to file an appeal?

Natalia Stone
•30 days from the date of the determination. Don't wait - file it right away if you disagree.

My advice is to be completely honest on your application. Don't try to hide anything or make yourself look better. Washington ESD will find out the truth anyway and lying just makes it worse.

•That makes sense. Better to be upfront from the beginning.

also make sure you keep filing your weekly claims even if your main claim is still pending or in adjudication. if you stop filing weekly claims you can lose benefits

•Good reminder. I'll make sure to do that if it comes to it.

The whole system is confusing but once you figure it out it's not too bad. Just follow the rules and keep good records of everything.

•Thanks everyone for all the advice. This has been really helpful in understanding what to expect.

One last thing - if you do get approved, make sure you understand how much you'll get per week. It's based on your earnings from the past year, not your most recent job.
0 coins
Dylan Fisher
•Is there a minimum or maximum amount?
0 coins
Ellie Perry
•Yeah there's both. The maximum changes each year but it's currently around $1000 per week for Washington state.

Hope you don't end up needing this info but at least you'll be prepared if it happens. Good luck with your job situation.

Been following this thread and wanted to add that timing matters too. File your claim as soon as possible after termination, don't wait around hoping things will work out.

Dylan Fisher
•Definitely noted. File immediately, got it.

Last thought - consider consulting with an employment attorney if the termination seems sketchy or if Washington ESD denies your claim unfairly. Sometimes having professional help makes all the difference.

•That's a good point. Hopefully it won't come to that but good to know it's an option.
