Washington ESD eligibility requirements - who qualifies for unemployment benefits?

I'm trying to figure out if I'm eligible for unemployment benefits in Washington state. I was laid off from my retail job last month after working there for about 8 months. I've never filed for unemployment before and I'm confused about all the requirements. Does anyone know what the basic eligibility criteria are for Washington ESD? I've been looking at their website but it's kind of overwhelming with all the different rules and conditions.

To be eligible for Washington state unemployment benefits, you need to meet several basic requirements. First, you must have worked and earned wages in Washington during your base period (usually the first 4 of the last 5 completed calendar quarters). You also need to be unemployed through no fault of your own - so layoffs, business closures, or being fired for non-misconduct reasons usually qualify. You have to be able and available to work, actively seeking employment, and register with WorkSource WA.

Thanks! What counts as 'actively seeking employment'? Do I need to apply to a certain number of jobs each week?

Yes, you need to make at least 3 job search contacts per week and keep a log of your activities. This can include applying for jobs, attending job fairs, or networking activities.

The wage requirement can be tricky too. You need to have earned at least $4,000 during your base period AND have worked in at least two quarters of your base period. If you don't meet the standard base period requirements, they might use an alternate base period which looks at more recent quarters.

How do I know what my base period is? Is there a way to check this online?

0 coins

You can check your wage history through your SecureAccess Washington account once you create one. Washington ESD will also tell you your base period when you file your initial claim.

Don't forget you also have to be a US citizen or have work authorization, and you can't be receiving certain other benefits like workers compensation at the same time. Also if you quit your job voluntarily, you generally won't qualify unless it was for 'good cause' like unsafe working conditions or harassment.

What if you were fired? Does that automatically disqualify you?

•

Not necessarily. If you were fired for misconduct (like stealing or repeatedly violating company policy), then yes you'd be disqualified. But if you were fired for poor performance or not being a good fit, you might still qualify.

I had trouble getting through to Washington ESD when I needed to check my eligibility status. Spent hours on hold and kept getting disconnected. Finally used this service called Claimyr (claimyr.com) that helped me get through to an actual person. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ. Made the whole process so much easier than trying to call on my own.

That sounds helpful! Did it cost anything to use?

There is a fee but it was worth it to actually talk to someone instead of wasting days trying to get through. Much less stressful than the endless busy signals.

also make sure you file your claim as soon as possible after becoming unemployed. there's a waiting week before you can receive benefits, and you need to file weekly claims to continue getting paid. the longer you wait to file your initial claim, the more money you might lose

Good point, I should probably file soon then. How long does it usually take to get approved?

If everything goes smoothly, about 2-3 weeks. But if there are any issues with your claim, it can take much longer due to adjudication.

The adjudication process is where they investigate any potential issues with your claim - like if your former employer contests it or if there are questions about why you became unemployed. This can add weeks or even months to the process, which is super frustrating when you need the money.

That sounds scary. Is there anything I can do to avoid adjudication?

Be completely honest on your application and provide all requested documentation promptly. Most adjudication happens when there are inconsistencies or missing information.

If you do end up in adjudication, that's another time when Claimyr can be really helpful for getting updates from Washington ESD. The phone lines are even more backed up when you're trying to check on adjudication status.

Don't forget about the job search requirements! You need to register with WorkSource WA and actively look for work. They can audit your job search activities, so keep good records of everything you do.

What happens if I can't find suitable work in my field? Do I have to take any job?

0 coins

Initially you can be somewhat selective, but as time goes on you're expected to expand your search and potentially accept jobs that pay less than your previous position.

One thing that trips people up is the able and available requirement. You have to be physically and mentally able to work, and available for full-time work during normal business hours. If you're taking classes or have other restrictions, it can affect your eligibility.

What if you're taking night classes? Would that disqualify you?

0 coins

Not necessarily, as long as the classes don't interfere with your availability for work during normal business hours. You need to report any education or training when you file your weekly claims.

The system is honestly pretty confusing and Washington ESD's website doesn't always make things clear. I've been through this process twice and still had questions both times. The phone support is hit or miss - sometimes helpful, sometimes you can't even get through.

Yeah, I tried calling yesterday and was on hold for 2 hours before giving up. It's ridiculous.

This is exactly why services like Claimyr exist. When the state system is this hard to navigate, sometimes you need help just to get basic information about your own claim.

Something else to consider is that if you have any part-time work while receiving unemployment, you need to report it on your weekly claims. You can still receive partial benefits in many cases, but failing to report work can get you in trouble for overpayment.

How much can you earn and still get benefits?

0 coins

It depends on your weekly benefit amount, but generally you can earn up to a certain amount before your benefits start getting reduced. Washington ESD has a formula they use to calculate partial benefits.

Just want to add that even if you think you might not qualify, it's often worth applying anyway. The worst they can do is deny your claim, and sometimes people are surprised to find out they do qualify. The eligibility rules can be complex and there are exceptions for various situations.

That's encouraging. I guess I'll go ahead and file since I was laid off through no fault of my own.

Definitely file soon! And make sure you have all your employment information ready - dates of employment, employer contact info, and reason for separation for all jobs in the past 18 months.

Good luck with your claim! The process can be stressful but most people who are legitimately eligible do eventually get their benefits. Just be patient and persistent, especially if you run into any delays or issues.

Thanks everyone! This has been really helpful. I feel much more confident about filing now.

You're welcome! Feel free to ask if you have more questions as you go through the process. We've all been there and know how confusing it can be.
