Washington ESD denied my unemployment claim - what reasons can you be denied unemployment?
My Washington ESD claim was just denied and I'm trying to understand why. The letter says something about 'voluntary quit' but I had to leave my job because my boss was making the workplace hostile. I thought you could get unemployment if you quit for good cause? What are all the different reasons Washington ESD can deny your claim? I need to know if I should appeal this decision.

There are several main reasons Washington ESD denies UI claims. The most common ones are: 1) Voluntary quit without good cause 2) Fired for misconduct 3) Not actively seeking work 4) Not able and available for work 5) Refusing suitable work offers. For hostile workplace, you might have good cause depending on the specifics. Did you document the hostile behavior?

•I have some emails saved but not much else. The harassment was mostly verbal. How do I prove good cause for quitting?

•You'll need evidence like emails, witness statements, or documentation you filed complaints with HR. Good cause includes unsafe working conditions, harassment, significant changes to job duties, or discrimination.

got denied too last month for 'misconduct' even though i was just late a few times. washington esd is really strict about attendance issues. did they give you a specific reason code on your denial letter?

•Yeah it says something like 'RCW 50.20.050' - not sure what that means exactly.

•That's the voluntary quit statute. You definitely should appeal if you had good cause. The appeal deadline is usually 30 days from the denial date.

I've been trying to call Washington ESD for weeks about my denied claim but can never get through! The phone system is impossible. Has anyone found a way to actually talk to someone there? I'm running out of time to appeal.

•I had the same problem until I found Claimyr. It's a service that calls Washington ESD for you and gets you connected to an actual agent. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•That sounds too good to be true. Does it actually work for getting through to Washington ESD?

•Yeah it worked for me. Saved me hours of calling and getting busy signals. Within like 20 minutes I was talking to an ESD rep about my adjudication issue.

The Washington ESD denial reasons also include not meeting the base period wage requirements. You need to have earned at least $3,000 in your base period and meet specific quarterly thresholds. Sometimes people think they qualify but don't have enough covered wages.

•wait what's a base period? i thought if you worked you automatically qualify for unemployment

•Base period is typically the first 4 of the last 5 completed calendar quarters before you file. Washington ESD uses this to calculate your benefit amount and determine if you worked enough to qualify.

Other denial reasons include being fired for criminal conduct, not registering with WorkSource within the required timeframe, or being unavailable for work due to restrictions. Also if you're receiving certain other benefits like workers comp, that can disqualify you.

•I registered with WorkSource right away so that's not an issue. It's really just the hostile workplace situation.

•For hostile workplace, gather any documentation you have - emails, text messages, witness contacts. Even a timeline of incidents can help your appeal case.

THE WASHINGTON ESD SYSTEM IS A JOKE!!! They deny people left and right for BS reasons and then make it impossible to appeal. I got denied for 'job abandonment' when I was in the hospital! Had to fight for months to get it overturned.

•that's terrible! did you eventually win your appeal?

•YES but it took forever and I almost lost my apartment waiting for the backpay. The whole system needs an overhaul.

Don't forget about the work search requirements denial. Even if you qualify initially, Washington ESD can deny ongoing benefits if you're not doing enough job search activities. You need 3 work search activities per week unless you're in an approved training program.

•What counts as a work search activity? I've been applying online but not sure if I'm doing enough.

•Applications, networking contacts, job interviews, attending job fairs, using WorkSource services all count. Keep detailed records in case they audit your job search.

also if you turn down a job offer that washington esd considers 'suitable work' they'll deny your benefits. suitable work gets broader the longer you're unemployed too

•How do they define suitable work? Can they make you take any job?

Jamal Brown
•Generally work is considered suitable if it matches your skills/experience and pays at least 70% of your previous wage. But after several weeks, the standards can be lowered.

Another reason for denial is if Washington ESD determines you're not 'able and available' for work. This includes being too sick to work, having transportation issues, or childcare problems that prevent you from accepting full-time work.

•I got questioned about this because I could only work certain hours due to my kids' school schedule. Thankfully they accepted my explanation.

•Yeah they're pretty strict about availability requirements. You have to be ready to start work immediately when offered suitable employment.

Immigration status can also be a denial reason. You need to be authorized to work in the US to receive Washington ESD benefits. They verify this through E-Verify and other systems.

•Do you need to be a citizen or just have work authorization?

Aisha Patel
•Just work authorization. Green card holders, work visa holders, etc. can qualify as long as they have valid work authorization.

Been there with the hostile workplace quit! I actually won my appeal by showing the pattern of harassment and that I tried to resolve it internally first. The key is proving you had no reasonable alternative but to quit.

Zoe Papadopoulos
•That gives me hope! What kind of evidence did you present at your hearing?
0 coins
Dmitri Volkov
•Email chains, a written complaint I filed with HR, and testimony from a coworker who witnessed the harassment. Document everything you can remember with dates.

washington esd also denies if you're receiving pension benefits or if there's fraud suspected in your application. they cross-check with other databases to verify your info

•What happens if there's an error in their system and they think you committed fraud when you didn't?
0 coins
Gabrielle Dubois
•you have to appeal and provide documentation to prove the error. it's a pain but usually gets resolved if you have the right paperwork

For anyone dealing with Washington ESD phone issues, I second the Claimyr recommendation. Used it twice now when I couldn't get through on my own. Much better than wasting entire days redialing.

•How much does something like that cost though?

•It's worth it when you're facing a denial and running out of time to appeal. Way cheaper than losing your benefits entirely.

School attendance can also disqualify you from Washington ESD benefits. If you're in school full-time, they usually consider you not available for work unless you're in an approved training program.

•What about part-time evening classes? I'm taking some courses to improve my skills.

•Part-time is usually okay as long as it doesn't interfere with your availability for work. Just be upfront about your schedule when filing weekly claims.

Don't forget about the earnings reporting requirements. If you work part-time while on unemployment and don't report it correctly, that's grounds for denial and possible overpayment issues.
0 coins
Zoe Papadopoulos
•Good point. I'll make sure to report everything accurately if I win my appeal.
0 coins
Jamal Brown
•Exactly. Even small amounts of earnings need to be reported on your weekly claims. Better to over-report than under-report.

The appeal process isn't that bad if you're organized. I appealed a misconduct denial and won by showing the employer's allegations were exaggerated. Just make sure you meet the 30-day deadline!

•Thanks everyone for the advice. I'm definitely going to appeal and try to gather more documentation about the hostile workplace.

•Good luck! And seriously consider using Claimyr if you need to talk to Washington ESD about your appeal status. The regular phone lines are basically useless.
