ESD claim shows disqualified with adjudication in progress - can't appeal after 4 weeks
I got laid off when my workplace shut down completely last month and immediately filed for unemployment. It's been 4 weeks of filing weekly claims, but every single one shows up as "disqualified" with "adjudication in progress" underneath. What's driving me crazy is there's nothing in my decision status area where I should be able to appeal! The screen is just blank there. I've worked at this company for 3 years, was laid off through absolutely no fault of my own (literally the entire business closed), and had more than enough hours to qualify. My rent is already late and I'm about to miss car payments. Has anyone dealt with this weird limbo situation where you're disqualified but can't even appeal because there's no decision showing? I've tried calling ESD over 30 times but can't get through.

This is actually normal even though it feels totally wrong! The "disqualified" status is the default placeholder until your claim is fully processed through adjudication. It doesn't mean you're actually denied yet. The fact that it says "adjudication in progress" means they're still reviewing your claim. The appeal option won't appear until after adjudication makes a final determination. Unfortunately, adjudication is taking 3-6 weeks for most people right now.

•Wait really?! That's so confusing! Why would they use the word "disqualified" if they haven't actually disqualified me? That's causing me massive anxiety thinking I've been denied already. So I just keep waiting and eventually it should change from disqualified to approved (hopefully)?

yep same thing happened to me in january!! its stupid but thats how the system works. mine said disqualified for 5 weeks then suddenly changed to paid and i got all the backpay at once. just keep filing every week even tho it seems pointless

•That's somewhat reassuring. Did you do anything special to make it change or did it just happen automatically? 5 weeks sounds like forever when bills are due...

The ESD system is deliberately designed to discourage people from collecting benefits they're entitled to. They use confusing terminology like "disqualified" when they really mean "pending review" to make people give up. I've been through this three times and it's always the same frustrating game. They're hoping you'll just go away.

•While I understand your frustration, this isn't accurate. The terminology is confusing but not deliberately so. It's just an outdated system that hasn't been updated to use clearer language. The processing delays are due to staffing shortages, not a conspiracy to deny benefits. The majority of valid claims do eventually get approved.

I had this exact situation last year! Here's what worked for me: I used Claimyr (claimyr.com) to get through to an actual ESD representative. Tried calling myself for weeks with no luck, but their service got me connected in about 30 minutes. The agent explained that my employer hadn't responded to ESD's request for information, which was holding up my claim. The agent was able to expedite it once I explained the business had closed. Worth checking out their video to see how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3

•I'm willing to try anything at this point! Did they actually resolve your issue on that first call or did you still have to wait longer? My employer definitely closed down completely (the building is literally empty now) so I wonder if that's causing similar issues with my claim.

They resolved mine during that call! Once I got through to someone who could actually see my claim details, they saw the issue was just waiting for employer verification. Since the business closed, they had documentation of that and could override the waiting period. Still took about 5 days for the money to arrive after that call, but at least I knew it was coming.

•This is exactly right. When a business closes completely, sometimes the employer verification step gets stuck because nobody is responding from the company side. A good ESD agent can process an override for this specific situation using what's called a "business closure verification" - but you absolutely need to talk to someone with authority to do that override, not just a first-level phone rep.

•It's not adjudacation, it's adjudication. And standby status still requires you to be looking for work since 2023 unless you have a definite return-to-work date confirmed by your employer. The rules changed after the pandemic programs ended.

This happened to my brother except his was stuck for 7 weeks and he almost got evicted!!! The key is documenting everything. Take screenshots of your claim status every week. Make sure you're meeting the 3 job search activities every week and documenting them correctly. Sometimes when businesses close they don't pay their unemployment insurance premiums and that can cause delays even though that's not your fault. So frustrating!!

•I didn't even think about the possibility that my employer hadn't paid their unemployment insurance! That would be so unfair since I had no control over that. I have been carefully doing my 3 job search activities each week and recording them. Did your brother end up getting all his back pay for the weeks he was waiting?

Yeah, he got everything backdated to when he first filed. The system is incredibly slow but usually works correctly in the end. One thing he found helpful was contacting his state representative's office - they have special liaisons who can sometimes get ESD to look at delayed claims. Worth a try if you're going on week 5 with no movement.

I'm a former ESD employee. The "disqualified" status is misleading and we complained about it internally for years. It should say "pending" but the system was coded in the 1990s and updating it has been a nightmare. Here's what's actually happening: when adjudication is reviewing your claim, they're probably verifying the business closure and making sure there weren't any other separation issues. Business closures are actually one of the most straightforward approvals but still go through the same process. Keep filing weekly claims and eventually you'll get backdated payments for all weeks once approved.

•Thank you so much for this insider perspective! That makes so much more sense. Is there anything I can do to speed up the process? Would uploading documentation showing the business closure help (I have the official notice they gave employees)?

Yes! Upload that closure notice through your eServices account under "Upload a Document" - label it "Proof of Business Closure." That can definitely speed things up. Also, when you do reach someone by phone, specifically mention you have documentation of the closure ready. That way they can note your account.
