Does Washington ESD unemployment back pay from last day worked - confused about benefit start date
I'm really confused about when my unemployment benefits actually start. I got laid off on December 15th but didn't file my claim until January 8th because I thought I might get called back. Now Washington ESD is saying my benefit year started January 8th when I filed, not December 15th when I lost my job. Does unemployment back pay from your last day worked or only from when you file? I feel like I'm missing out on almost a month of benefits. Has anyone dealt with this before?

Unfortunately, Washington ESD benefits only start from the Sunday of the week you file your initial claim, not from your last day of work. There's no automatic back pay to your separation date. You can only get benefits for weeks you actually file for, so those weeks between December 15th and January 8th are lost unless there were specific circumstances that prevented you from filing.

•That's so frustrating! I had no idea I needed to file immediately. I thought it was better to wait and see if my employer would call me back first.

•Yeah this caught me off guard too when I got laid off. The system doesn't really explain this clearly anywhere.

There are some exceptions though. If you had what's called 'good cause' for the delay in filing, you might be able to get those weeks back. Things like being hospitalized, not knowing you were eligible, or your employer telling you not to file yet. You'd need to contact Washington ESD directly to request backdating.

•My employer did tell me they might call me back within a few weeks. Would that count as good cause?

•It might! You should definitely call and explain the situation. They'll make a determination based on your specific circumstances.

Ugh, I've been trying to call Washington ESD for weeks about a similar issue and can never get through. The phone lines are always busy or I get disconnected after waiting for hours. Has anyone found a better way to reach them?

•I was having the same problem until I found this service called Claimyr at claimyr.com. They basically call Washington ESD for you and get you connected to an actual person. I watched their demo video at https://youtu.be/7DieNd3C7zQ and decided to try it. Got through to an agent in like 20 minutes when I'd been trying for weeks on my own.

Wait, I'm confused about something else. If you file late, does it affect your benefit amount or just the start date? I'm in a similar situation where I waited to file.

•It only affects the start date, not your weekly benefit amount. Your benefit amount is calculated based on your earnings in your base period, which is set regardless of when you file.

•Ok good, that's a relief. I was worried I'd get less money per week too.

This is exactly why the unemployment system is so screwed up. They don't tell you any of this stuff when you get laid off, then penalize you for not knowing their arbitrary rules. I lost 6 weeks of benefits because nobody explained I had to file immediately.

•I feel you on this. The whole system seems designed to deny benefits rather than help people who need them.

•I understand the frustration, but the rules are actually available on the Washington ESD website. The problem is most people don't think to look them up until after they've already made mistakes.

For anyone reading this thread, file your claim THE SAME WEEK you lose your job. Don't wait, don't think about it, just do it. You can always withdraw it later if you get called back, but you can't get those weeks back if you wait.

•Wish I had known this earlier. This should be the first thing they tell you when you get laid off.

•Absolutely. I tell everyone I know to file immediately now. Even if you're not sure you'll need it, file anyway.

OP, definitely try to get those weeks backdated. The worst they can say is no, but you might have a case since your employer told you not to file right away. Document everything about that conversation if you can remember details.

•I do have some text messages from my supervisor about potentially being called back. Would those help my case?

Connor Gallagher
•Yes! Save those messages and mention them when you call. Any documentation showing your employer advised you to wait could support your backdating request.

Can someone explain what exactly backdating means? I see people mention it but I'm not sure what the process actually involves.

•Backdating means requesting that Washington ESD move your claim start date to an earlier week than when you actually filed. If approved, you can then file weekly claims for those earlier weeks and potentially receive benefits for them.

Yara Sayegh
•Oh ok, so you're basically asking them to pretend you filed earlier than you actually did?

Giovanni Colombo
•Exactly, but only if you have good cause for the delay. They don't just give backdating for convenience.

I had success with backdating last year when I was in the hospital and couldn't file. Took about 3 weeks for them to approve it, but I got all my missed weeks paid out. The key is having solid documentation of why you couldn't file on time.

•That gives me hope! How did you contact them to request the backdating?

•I had to call and speak to an adjudicator. They walked me through the process and told me what documents I needed to submit.

Just want to add that even if you can't get backdating, make sure you're filing your weekly claims every week going forward. Missing weekly claims can cause even more problems down the line.

•Yeah I'm definitely staying on top of the weekly claims now. I've learned my lesson about procrastinating with this stuff.

Another option if you can't get through by phone is to try messaging them through your SecureAccess Washington account. Sometimes they respond faster to written messages than phone calls.

•I've tried that but never get responses to my messages. Phone seems to be the only way to actually talk to someone.

•That's why I ended up using Claimyr - the messaging system is basically useless for urgent issues.

Does anyone know if there's a specific form you need to fill out for backdating requests, or do you just explain your situation when you call?

StarStrider
•There's no specific form. You just explain your situation to the agent and they'll determine if you qualify. They might ask you to submit supporting documents depending on your reason for the delay.

•Good to know. I was worried there was some special paperwork I needed to track down.

Word of advice - if you do get your backdating approved, don't spend the money right away. Sometimes there are delays or issues with the payments, and you don't want to count on money that might not show up when expected.

•That's smart advice. I'm trying not to get my hopes up too much in case the backdating doesn't work out.

This thread has been really helpful. I'm in almost the exact same situation as OP and didn't realize I might be able to get those missed weeks back. Definitely going to try calling Washington ESD tomorrow.

•Good luck! If you can't get through, remember that Claimyr option I mentioned earlier. Made a huge difference for me.

UPDATE: OP, any luck reaching Washington ESD about your backdating request? I'm curious how it worked out.

I went through something similar last year when I got furloughed. The key thing that helped me get backdating approved was having documentation from my HR department showing they advised employees to wait before filing because they expected to bring people back within 2-3 weeks. Washington ESD considered that "good cause" for the delay. Make sure to gather any emails, texts, or written communication from your employer about the potential callback - that's going to be your strongest evidence. Also, be persistent with calling. I had to try for about a week straight before I finally got through to someone who could help with the backdating request.
