Is it too late to get unemployment back pay from Washington ESD?
I'm wondering if there's still time to claim unemployment back pay that I think I'm owed. Last year I got laid off in March but didn't file for unemployment until May because I thought I'd find work quickly. When I finally did file, Washington ESD only paid me from the date I applied, not from when I actually became unemployed. I've heard some people mention getting back pay but I'm not sure if there's a time limit or if I missed my chance. Has anyone successfully gotten retroactive payments from Washington ESD after their claim was already processed?

You might still have options depending on your situation. Washington ESD has specific rules about backdating claims, but there are circumstances where they'll approve retroactive payments. You'd need to show good cause for why you didn't file immediately when you became unemployed.

•What counts as good cause? I honestly just thought I'd get a job right away and didn't realize I should file immediately.

•Good cause includes things like illness, family emergencies, or being given incorrect information. Just thinking you'd find work quickly usually isn't considered good cause, but it depends on the specific circumstances.

I went through something similar last year. You can request to backdate your claim, but you need to contact Washington ESD directly and explain your situation. They'll review it case by case.

•How long did it take them to review your request? And did you have to provide any documentation?

•It took about 3 weeks for me to get a decision. I had to provide some medical records because I was dealing with a health issue that prevented me from filing right away.

Getting through to Washington ESD to discuss backdating can be really frustrating with their phone lines. I had success using Claimyr.com to get connected to an actual agent who could help with my backdating request. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•I've been trying to call for weeks without success. Is Claimyr legit?

Mei Lin
•Yeah it's legitimate. They basically handle the phone queue for you so you don't have to sit on hold. Really helpful for complex issues like backdating that need agent assistance.

•How much does something like that cost? I'm already strapped for cash.

The time limit for requesting backdating is usually one year from when you first filed your claim, but there can be exceptions. You should definitely try to contact them about it.

•I filed in May last year, so I'm coming up on that one year mark. Should I be worried?

•I'd act quickly if you're close to the deadline. The sooner you request it, the better your chances.

ugh the whole system is so confusing. why dont they just automatically pay from when you lost your job instead of making us jump through hoops

•I think it's because they need to verify eligibility and prevent fraud. The system assumes you'll file immediately when you become unemployed.

•still seems backwards to me. most people dont know all the rules

I'm in a similar boat. Lost my job in February but didn't file until April. The amount of back pay I'm potentially missing is significant - probably around $4,000.

•That's about what I'm looking at too. It's a lot of money to just lose because of timing.

•Exactly. I'm definitely going to try to get it backdated. Worth a shot even if they say no.

Just to clarify - when you request backdating, you'll need to explain why you didn't file immediately AND you'll need to certify that you were available for work during those weeks you're claiming. Washington ESD will want to see that you were actively job searching.

•I was looking for work but didn't keep detailed records. Is that going to be a problem?

Zoe Papanikolaou
•It might be. They usually want to see evidence of your job search activities for each week you're claiming. Try to reconstruct what you can remember.

•I had to provide my browser history and email records to show I was applying for jobs. They're pretty thorough.

This is all really helpful. I'm going to try to contact Washington ESD about backdating my claim. Sounds like I need to move fast since I'm close to that one year deadline.

•If you can't get through on the phone, definitely consider using Claimyr to get connected to an agent who can help with your backdating request.

Wait, so if I filed 6 months after I lost my job, I could potentially get 6 months of back pay? That would be life changing.

•Potentially, but only if Washington ESD approves your backdating request. It's not guaranteed - they have to determine you had good cause for the delay.

•Worth trying though. I had no idea this was even possible.

The system is set up so you're supposed to file immediately when you become unemployed. Most people don't realize this and think they can file whenever they want.

•exactly my point about the system being confusing. they should make this clearer

•I agree the communication could be better. A lot of people miss out on benefits because they don't understand the timing requirements.

I successfully got my claim backdated last year. The key is being persistent and having a good reason for the delay. Don't give up if they initially say no.

•How many times did you have to contact them before they approved it?

Dylan Cooper
•It took three phone calls and one written appeal. The first two agents I spoke with said no, but the third one was more helpful and understood my situation.

Just remember that even if they approve backdating, you'll still need to file weekly claims for all those past weeks. It's not automatic - you have to go back and certify for each week.
0 coins
Andre Dupont
•That sounds like a lot of work. Do you have to remember exactly what you did each week?
0 coins
Sofia Morales
•Pretty much. You'll need to certify that you were available and actively searching for work for each week. It's tedious but worth it if you get approved.

Another option is to file an appeal if they deny your backdating request. Sometimes the appeal process can result in a different outcome.

Andre Dupont
•How long does the appeal process take?

•Usually 4-6 weeks for a hearing to be scheduled. It's a longer process but can be worth it for significant amounts of back pay.

I tried to get backdating and they denied me because I couldn't prove I was actively looking for work during the weeks I didn't file. Make sure you have documentation of your job search.

Andre Dupont
•What kind of documentation did they want?

Dmitry Ivanov
•They wanted records of job applications, interviews, networking contacts, anything that showed I was actively searching. I didn't keep good records so I got denied.

The whole backdating process is really hit or miss. I've seen people get approved for seemingly minor reasons and others get denied for what seemed like legitimate situations.

•It often depends on which agent you get and how well you can explain your situation. Some are more understanding than others.

•Exactly. It's frustrating how inconsistent the decisions can be.

Pro tip: when you contact Washington ESD about backdating, have all your dates and details ready. They'll want to know exactly when you lost your job, when you filed, and why you waited.

•Good advice. I need to gather all my employment records and timeline before I call.

Don't forget that if you do get approved for backdating, you might owe taxes on a larger lump sum. Just something to keep in mind for tax planning.

Andre Dupont
•Good point. I hadn't thought about the tax implications.

Connor O'Neill
•Yeah, getting several months of back pay all at once can bump you into a higher tax bracket for that year.

The bottom line is that backdating is possible but not guaranteed. If you think you have a legitimate reason for not filing immediately, it's worth pursuing. The worst they can do is say no.

Andre Dupont
•True. I've got nothing to lose by trying. Thanks everyone for all the advice.

One last thing - make sure your initial unemployment claim is still active or reopenable. If it's been closed for too long, you might need to file a new claim entirely.

•How do I check if my claim is still active?

•Log into your Washington ESD account online. It should show your claim status and benefit year dates.
