Is unemployment retroactive - Washington ESD backdating question
Filed my Washington ESD claim last week but I've been out of work for almost a month now. My supervisor told me unemployment benefits can be backdated but I'm not sure if that's actually true? Can Washington ESD make payments retroactive to when I first became unemployed or do they only start from when I filed? Really need to know because I have rent due and bills piling up from the weeks before I applied.

Yes, Washington ESD can backdate unemployment claims but there are specific rules. You typically have to show good cause for why you didn't file sooner. The maximum backdate period is usually one year from when you file, but they'll only approve it if you can prove you had a valid reason for the delay in filing.

•What counts as good cause? I honestly just didn't know I was supposed to file right away - thought I had to wait longer.

•Not knowing isn't usually considered good cause unfortunately. They look for things like illness, family emergency, or misinformation from your employer.

i went through this same thing last year, they did backdate mine but i had to provide medical records showing i was too sick to file earlier. took like 6 weeks to get approved tho

•Six weeks?? That's so long when you need the money now. Did they pay everything at once when it finally went through?

Demi Hall
•yeah they paid it all in one lump sum but man those 6 weeks were rough

If you're having trouble getting through to Washington ESD to discuss backdating, I found Claimyr really helpful. It's a service that helps you actually reach an agent instead of sitting on hold forever. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Might be worth checking out since backdating requests usually need to be discussed with an actual person.

•Never heard of that before but anything is better than trying to call and getting hung up on constantly. Is it legit?

•Yeah it's at claimyr.com. They basically handle the calling process for you so you don't have to waste hours on hold. Really saved me when I needed to get my adjudication issue resolved.

THE SYSTEM IS SO BROKEN!! Why should people have to pay for a service just to talk to Washington ESD agents?! This is taxpayer funded and we deserve better customer service than this ridiculous phone maze!

•I totally get the frustration but at least there are options now. Before Claimyr I literally spent 8+ hours a day calling for two weeks straight.

•That's exactly my point though - we shouldn't NEED outside services to access our own benefits!

Back to the original question - you'll need to submit a written request for backdating with your specific circumstances. Washington ESD has forms for this but you might need to call to get the right paperwork. Document everything about why you couldn't file sooner.

Rosie Harper
•Do you know what form number it is? I've been looking on their website but there are so many different forms.

Elliott luviBorBatman
•I think it's part of the general claim modification process but I'm not 100% sure on the exact form. Definitely worth calling to confirm.

just a heads up that even if they approve backdating, you still have to file weekly claims for all those past weeks retroactively. its not automatic

Rosie Harper
•Wait what? So I'd have to remember exactly what I did for job searches 3-4 weeks ago?
0 coins
Caesar Grant
•yeah exactly, they want your job search activities for each week. better start trying to remember now

My brother got his backdated but only for 2 weeks because he waited too long to file. Washington ESD is pretty strict about the good cause requirement. He had to write a whole letter explaining his situation and provide documentation.

Rosie Harper
•What kind of documentation did he need to provide? I'm worried I don't have enough proof.

•He had to show medical records and proof he was dealing with his dad's funeral arrangements. They wanted official documents for everything.

honestly the whole process is such a pain, but if you really need those retroactive payments its worth trying. worst they can say is no

•True, I guess I have nothing to lose by asking. Just don't want to mess up my current claim somehow.

•Requesting backdating won't affect your current claim status, so you're safe to try.

Quick question - does anyone know if being laid off vs fired affects backdating eligibility? I was technically terminated but it wasn't for cause.
0 coins
Elliott luviBorBatman
•The reason for your job separation affects your overall eligibility but shouldn't impact backdating specifically. That's more about why you delayed filing.

•Thanks, that makes sense. I was worried it might complicate things.

Update on the Claimyr thing - I used them again last week to check on my claim status and got through to an agent in like 20 minutes. Way better than the 3+ hour holds I was dealing with before. Definitely recommend if you need to actually talk to someone about your backdating request.

•That's really helpful to know. I think I'm going to need to call them anyway to get this sorted out properly.

•Still think it's ridiculous we need a third party service but if it works it works I guess.

Thanks everyone for all the advice. Sounds like I should definitely try for the backdating even if my chances aren't great. Going to start gathering any documentation I can find and maybe try that Claimyr service to actually get through to someone.

•Good luck! Make sure to be really specific about your circumstances in your request letter.

One more tip - if they deny your backdating request, you can appeal that decision too. My brother didn't know that initially and almost gave up.

Rosie Harper
•Good to know there's an appeal option if needed. Hopefully it won't come to that but nice to have a backup plan.

Philip Cowan
•Yeah the appeal process is a whole other thing but at least the option exists.

real talk though, even if you get backdating approved, washington esd payments take forever. dont expect to see money for weeks even after approval

•Ugh that's what I was afraid of. Really need something sooner than that for bills.

Caesar Grant
•yeah its rough, maybe look into food banks or other assistance while you wait

Final thought - make sure you're continuing to file your weekly claims while this backdating request is being processed. Don't let any current weeks lapse thinking the backdating will cover everything.
0 coins
Rosie Harper
•Definitely doing that. Don't want to mess up anything going forward while trying to fix the past weeks.

Elliott luviBorBatman
•Smart approach. Keep everything current while working on the retroactive stuff.

Does anyone know if there's a limit to how many weeks they'll backdate? I've heard different things from different people.
0 coins
Elliott luviBorBatman
•Technically up to one year from your filing date, but practically they rarely approve more than a few weeks unless you have really compelling circumstances.
0 coins
Gemma Andrews
•That makes sense. Probably not worth trying for more than a month or so back then.

just realized i never mentioned - when they did approve my backdating, i had to redo all my job search logs for those weeks too. was a huge pain trying to remember what i applied for
0 coins
Rosie Harper
•Oh no, I didn't even think about the job search requirements. I wasn't keeping track of applications before I filed.
0 coins
Demi Hall
•yeah you need like 3 job search activities per week minimum, better start making a list of what you can remember

For what it's worth, when I talked to the Washington ESD agent through Claimyr about my issue, she was actually really helpful in explaining exactly what documentation I needed. Sometimes it's worth the conversation just to get clear guidance before you submit anything.
0 coins
Rosie Harper
•That's a really good point. Better to know exactly what they want than guess and potentially submit the wrong stuff.

Mateusius Townsend
•Exactly. Saved me from wasting time on paperwork that wouldn't have helped my case anyway.

Update for anyone following this - I decided to try the Claimyr service and actually got through to a Washington ESD agent today. She explained that my situation probably doesn't qualify for backdating since I don't have good cause, but at least now I know for sure instead of wondering. Going to focus on getting my current claims processed quickly instead.

•Sorry it didn't work out for the backdating, but at least you got a definitive answer instead of being in limbo.

This whole thread has been super helpful. I'm in a similar situation and was wondering about backdating too. Sounds like it's pretty hard to get approved unless you have serious documentation.
0 coins
Rosie Harper
•Yeah, definitely harder than I expected. But worth asking if you think you have a legitimate reason for the delay.

Pedro Sawyer
•Thanks for sharing your experience. Probably going to skip trying for it and just focus on current claims.

One last tip for anyone reading this later - if you do try for backdating, make your request as soon as possible after filing your initial claim. The longer you wait, the harder it gets to justify.

Rosie Harper
•Wish I had known that from the beginning. Definitely good advice for future reference.

•Live and learn, right? At least your current claim should process normally now.
